  • Part II: Legal Requirements of Charter School Board Membership

    (1) Louisiana law (Bulletin 126) states that a charter school board "should consist of members with a diverse set of professional skills and practical work experience in the areas of education, non-profit and/or for-profit administration or operations, community development, finance, and law."  

  • (3) The Louisiana Charter School Board Legal Handbook states that charter school boards have three basic fiduciary

    duties (legal duties): duty of care, duty of loyalty, and duty of obedience.

    (A) Duty of Care - "exercising sound, legal, and ethical board best practices and acting on an informed basis." The first example of this duty given in the handbook is "being an active Board member and participant"

  • (B) Duty of Loyalty - "giving undivided allegiance when making decisions affecting your school' Two examples of this duty given in the handbook are "never using school information for personal gain' and "avoiding conflicts of interest".

  • (C) Duty of Obedience - "acting in furtherance of the law and the school 's goals and mission' ". Two examples from the handbook are "acting on congruence with the Board 's purpose, articles of incorporation, and bylaws" and "being mission aligned so that your actions are consistent with the school's goals, vision, and mission."
