TERMS AND CONDITIONS

DEFINITIONS
"16PF" is used to denote the 16 Personality Factors Questionnaire, an instrument which assesses temperament and is a registered trade mark of Talogy world-wide, distributed in the RSA by JvR Psychometrics.

"Registered Psychologist" shall refer to a practitioner of psychology duly registered with the South African Health Professions Council (or the equivalent professional body in their country of residence) as a person legally authorised to practice as a Psychologist.

"Registered Psychometrist" shall refer to a practitioner of psychology duly registered with the South African Health Professions Council as a person legally authorised to practice as a Psychometrist (Independent Practice).

1. USE OF CBPP RPORTS
CBPP Software is supplied to practitioners and organizations on the strict condition that the system will be used only by:
a. A registered psychologist;
b. A registered Psychometrist, or
c. An intern psychologist or psychometrist, working under the direct supervision of a registered psychologist.

2. LIABILITY
The developer and distributors severally and individually disclaim any responsibility for the misuse of the reports by psychological practitioners, or any losses whether financial or otherwise which shall arise out of the use of the CBPP reports. Furthermore, the distributors and developer indemnify themselves from any litigation whatsoever which may arise from the use of the reports, from the test results in the reports, or from decisions made on the basis of the reports, whether these decisions are made by the psychological practitioner, by the testee, or by any other person or organisation using the reports.    

3. CONFIDENTIALITY
Reports shall be kept confidential at all times, and may not be distributed to any person outside the practitioner's practice or organisation, or used for any purpose other than psychometric assessment by a registered psychologist or psychometrist.

4. INTELLECTUAL PROPERTY
The CBPP is licensed to practitioners on an annual license for their use, but is not owned by the practitioner. The CBPP remains the intellectual property of the developer, who reserves the right to cancel the agreement entered into with the practitioner, should the reports be used in a way which may be construed to bring either the developer or the distributor into disrepute.
