PART II - Terms and Conditions:

1. Agreement. This Agreement for Services (the "Agreement") will apply to all services provided by Little Weirdos Dog Training And Behaviour Consulting Inc. (the "Company"

2. Fees: You agree to pay us the fees for the services as specified on our website or email communications when the sessions are booked and confirmed by us. Fees are non-refundable.

3.Payment. Payment for all services is required by the specified date indicated upon booking services by cash, credit card/visa or e-transfer. All amounts payable for services are subject to GST. All quotes for services are valid for a period of thirty (30) days. If any payments are not received prior to the commencement of services, the Company has the right in its discretion to withhold the service.

4.Cancellation We understand that circumstances may arise where you need to cancel or reschedule a session. We value your time and our trainer's availability, and we have implemented the following cancellation policy to ensure fairness and efficient scheduling:

a. A minimum of 48 hours' notice is required for any cancellation or rescheduling of a session. To provide sufficient time to adjust the schedule, we appreciate receiving cancellation or rescheduling requests as soon as possible. If you cancel a session with less than 48 hours' notice, a late cancellation fee of $75 will be charged. The late cancellation fee compensates our trainers for their reserved time and lost opportunities to accept other jobs. We understand that emergencies and extenuating circumstances happen, and we reserve the right to waive the cancellation fee on a case-by-case basis.

b. A "no-show" occurs either when sessions are cancelled the day of a scheduled session, or when you fail to cancel a session and the trainer arrives at the scheduled time but cannot provide the services. In the event of a no-show. you will be charged the full fee for the scheduled session and the session will be counted towards the number of sessions in the package/program.

c.To cancel or reschedule a session, please notify us by emailing littleweirdostraining@gmail.com or through our online booking system on our website. Provide your name. the date and time of the session, and the reason for cancellation or request for rescheduling. We will confirm your cancellation or rescheduling request and provide any relevant instructions or follow-up information.

d. We will endeavor to make all sessions, but as a small company. we may be faced with unexpected circumstances outside of our control that interfere with our ability to make a session. The Company reserves the right to reschedule an appointment at any time by notice toyou. In the event that we cannot make a session, we will consult with you as to the best time to reschedule and you will not be charged any additional fees.

5. Results. We cannot guarantee results, as each animal has unique circumstances, needs, and personality. Training takes time and the commitment of the guardian to follow through with any recommended training following the sessions. Any recommendations of the Company are specific to the pet for which sessions have been completed by the Company, and should not be used on other pets.

 6. Liability. Our services are informational only and are to be used at your own risk. You acknowledge that you are voluntarily participating in dog/cat training with knowledge of potential dangers, including dog/cat bites or attacks and complications arising therefrom. The Company shall not be liable to you or any third party for any loss, injury, or liability of any kind. You are responsible for your pets at all times and are advised to have adequate pet or house insurance to cover liability in the event of damage or injury caused by your dog/cat to any person or property. You are aware that participation in any dog/cat training class may result in illness, accident, injury, death to you, anyone in the sessions, other pets, or your pet. You agree you are aware of these risks and dangers and assume all responsibility for them. In addition, you assume full responsibility for damages and injuries (i) to your dog/cat, (ii) caused directly or indirectly by your dog/cat or other pets or persons in the sessions, and/or (iii) to pets, persons or property during the sessions. YOU, FOR YOURSELF, YOUR HEIRS,

EXECUTORS, ADMINISTRATORS AND ASSIGNS, HEREBY RELEASE AND AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS, REPRESENTATIVES AND AGENTS FROM ANY AND ALL ACTIONS, SUITS, DAMAGES, CLAIMS, LOSSES, AND DEMANDS OF ANY KIND. WHICH YOU, YOUR HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS HAD, NOW HAVE OR HEREAFTER MAY HAVE BY REASON OF ANY MATTER ARISING FROM OR IN CONNECTION WITH YOU DOG/CAT AND YOUR DOG'S/CAT'S PARTICIPATION IN ANY SESSIONS, INCLUDING WITHOUT LIMITATION ANY ILLNESS, INJURY, ACCIDENT, DEATH OR DAMAGE TO PERSON, PETS OR PROPERTY.

 

7. Photography. You consent to the photography, videotaping and video-recording of your sessions. You agree that the Company has the right to publish, release, or play such content, including images of you or your pet, including for promotional purposes and inclusion on our website and social media. without seeking any further permission and without compensation You release the Company from any liability connected with the taking, recording, digitizing, or publication and use of photographs or video recording. By initialing the line below, you are opting into this policy as this is not mandatory.

 

8. Vaccinations and Illness

a) For in person sessions, proof is required for all animals in the home to be up-to-date on their vaccinations prior to sessions commencing. Some exceptions may apply ona case-by-case basis. b) In order to protect other animals we may be in contact with, you are required to notify your trainer if any animals in the home are ill prior to a scheduled session. Your trainer will work with you to reschedule your session(s

9. Termination. We reserve the right to terminate this Agreement and cancel future sessions if, in our sole opinion, your dog/cat is dangerous to our trainers or if the training is not in the best interests of you, your dog/cat, or our trainers. If we terminate for any of these reasons we will refund to youthe fees you have paid which are attributable to any unused sessions.

10. Privacy Policy. Our privacy policy can be found on our website at www.littleweirdos.ca

11. Intellectual Property. The materials and information provided by the Company in our sessions are the intellectual property of the Company. You may not use, display, reproduce, publish, post, or distribute any information you receive from the Company for any public or commercial purpose without our specific written permission. All trade names and logos of the Company are proprietary to the Company and cannot be used or reproduced without our prior consent.

12. General
a. Any disputes relating to the services offered by our Company or these terms and conditions shall be referred to a single arbitrator as agreed between the parties, or in the event of failure to agree, then as appointed by the Court of Kings Bench of Alberta. b. By scheduling or accepting services from the Company, you are representing that you are the legal owner of the pet for which the services are scheduled. c. Our services and this Agreement are governed by the laws of the Province of Alberta. We do not represent that our services are appropriate or available for use in other locations. Those who choose to access our services from outside Alberta do so voluntarily and are responsible for compliance with their local laws.

d. This Agreement and the services and bookings chosen by you through email or our website and confirmed by us constitute the entire agreement between you and us with respect to the services provided by us to you and there are no other agreements, undertakings, representations, warranties or understandings, written or oral, express or implied, other than as set out herein.

e. If any provision of this Agreement is held to be invalid or unenforceable, in whole or in part, the invalid or unenforceable provision or portion will be severed from this Agreement and will not affect the legality, validity or enforceability of any other provision of this Agreement.

f. By scheduling or accepting services from the Company, you are agreeing to the terms and conditions in this Agreement. We reserve the right to update our terms and conditions from time to time. You will be deemed to have accepted those changes by, among other things, continuing to access or use our services. Any updates will be posted on our website and will take immediate effect. We encourage you to check our website frequently to see the current terms and conditions in effect and any changes that may have been made to them.

g. If you have purchased a session-based program, all unused sessions will expire one year after purchase.

h. If you have purchased a time-based program (e.g., 12-week program), all unused sessions will expire one week and one day after the 12 weeks has ended.
