Effective as of the date of execution of this Agreement, I hereby authorize the Citrus Heights Police Department (“CHPD”) and its officers to act as my agent for the purpose of enforcing all California Penal Code trespassing laws and the Citrus Heights Municipal Codes that may occur on my property or business. This Agreement shall remain in full force and effect for one year from the date of execution of this Agreement, unless specifically terminated sooner by the CHPD. Any such termination or
revocation by the CHPD can be made at the discretion of the CHPD at any time and for any reason.[Initials: ___________.]

I further acknowledge and agree that this Agreement does not and will not be construed to guarantee, either express or implied, any particular outcome or result, and that there is no affirmative obligation for the City or CHPD to perform or take any particular course of action under this Agreement. As such, I acknowledge
and agree that CHPD has, and will maintain throughout the life of this Agreement, until terminated, the sole and complete discretion to determine the enforcement actions to be undertaken pursuant this Agreement. Likewise, the City Prosecutor shall have, and will maintain at all times, the sole and complete discretion to
determine whether any of alleged individual(s) found on your premises will be criminally prosecuted under the law. Accordingly, I agree to cooperate and be present in all court proceedings, if any, or upon request from the City Prosecutor during all stages of the prosecution, if any, of the individual(s) found and

I, and my business, agree to indemnify, protect, defend, save and hold harmless the City of Citrus Heights, including the CHPD, its officers, employees, agents, and volunteers from any and all claims or causes of action for death or injury to persons, or damages to property or business resulting from the acts or omissions
in connection with this Agreement, or resulting from the intentional or negligent acts, errors or omissions of myself, my company, or my agents, or from any violation of any federal, state or municipal law or ordinance, except for loss caused solely by the gross negligence of the City or CHPD. I acknowledge and agree that the duty to this indemnification and hold harmless clause includes the duty to defend as set forth in Section 2778 of the California Civil Code. This indemnification and hold harmless clause shall survive the expiration or termination of this Agreement and is a material element of consideration.
