Maui Basketball Association

The Maui Basketball Association Fall season has been pushed back to January. All games are on Sundays with the location to be determined. The registration fee is $120 for the season. If the player is playing in two age division's there is an additional $60 double registration fee. All questions can be sent to mauibasketballassociation@gmail.com. MAHALO!

I, the undersigned, do hereby agree to the terms set forth in this document in consideration of my participating in certain activities with Maui Basketball Association, LLC on property operated by Maui County. Such activities (the "Activities") include: a youth basketball league, including practices, tournaments and related activities. I forever release, waive and discharge Maui Basketball Association, LLC and Maui County, their respective members, managers, agents, employees, officers, representatives, successors and assigns, (collectively referred to as "Maui Basketball Association") from all loss, demands, liability, claims, actions, judgments, and executions which I may have or claim to have, or which my heirs, personal representatives, executors, administrators and assigns may have or claim to have against Maui Basketball Association and/or Maui County for all personal injuries known or unknown, including illness, any bodily injury and death, any damage to real or personal property, and any other personal or financial injury or damages caused by or arising out of the above described Activities, or in any way related thereto, including but not limited to any damage or injuries caused by animals or spectators. I recognize that the above-described Activities and related Activities may involve the risk of serious injury or death to myself, and I hereby assume all of the known and unknown risks and hazards of such activities and the risk of such damage or injury. I further agree and acknowledge that engaging in these Activities may be dangerous, that I am engaging in these Activities at my own risk and that I will take safety precautions to avoid injury or harm to me and others while engaging in these Activities. I further certify that I assume the risk of any medical or physical condition Imay have.

I forever indemnify and hold harmless Maui Basketball Association from any damages or claims made against Maui Basketball Association and Maui County as a result of, or arising out of, my participation in any Activities with Maui Basketball Association. I further forever indemnify Maui Basketball Association against any costs and attorney's fees incurred by it as a result of any actions arising out of any Activities that I may be participating in which generates a claim. This release of Maui Basketball Association from any and all liability or claims that I may have for injuries and damages arising out of my participation in any Activities with Maui Basketball Association includes losses caused by the action, inaction or negligence of Maui Basketball Association.

The severe acute respiratory syndrome coronavirus 2, SAR-CoV-2 (“coronavirus”), causes the illness COVID-19 which has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely dangerous and the coronavirus is extremely contagious and believed to be spread from person-to-person contact. As a result, federal, state and local governments and health agencies recommend established guidelines to reduce the risk of spreading the coronavirus. These include requiring social distancing and, in many locations, prohibiting the congregation of large groups of people. These guidelines are for the safety of the public and should be followed. Notwithstanding recommendations and guidelines by these entities, it must be understood that the coronavirus and COVID-19 are continuing threats to the health and lives of the citizens of Hawai‘i. MAUI BASKETBALL ASSOCIATION, LLC ("MAUI BASKETBALL ASSOCIATION"), their respective members, managers, agents, employees, officers, representatives, successors and assigns, (collectively referred to as "Maui Basketball Association") cannot guarantee that you or your child(ren) will not come into contact with or become infected by the coronavirus. Your mere participation in certain activities could increase your risk and your child(ren)’s risk of becoming infected by the coronavirus and developing COVID-19.By signing this agreement, I, on behalf of myself and my minor child(ren) identified below, acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and/or I may be exposed to or infected by the coronavirus by participating in any activities and that such exposure may result in personal injury, illness, permanent disability or death. Not withstanding the risk of infection, my minor child(ren) and I wish to voluntarily participate in the following activities (the "Activities"): a youth basketball league, including practices, tournaments and related activities. Further, I, and on behalf of my minor child(ren) identified below, state and agree as follows:1. I understand that although MAUI BASKETBALL ASSOCIATION have taken precautions to provide proper care, instruction and directions regarding the activities, it is impossible for MAUI BASKETBALL ASSOCIATION to guarantee absolute safety from infection by the coronavirus. 2. I understand that the risk of becoming exposed to or infected by the coronavirus, and the risk of developing COVID-19 by participating in the activities includes the risk arising out of or related to the actions, omissions, or negligence of myself and others including, but not limited to, MAUI BASKETBALL ASSOCIATION. 3. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury or harm to myself or my minor child(ren) including, but not limited to, personal injury, disability, death, and illness, including developing COVID-19; and any damage, loss, claim, liability, or expense, of any kind, that I may experience or incur, arising out of, caused by, or in any way related to exposure to the coronavirus or COVID-19 by participating in the activities.4. I hereby release, waive, covenant not to sue, discharge, and hold harmless MAUI BASKETBALL ASSOCIATION from any and all liabilities, claims, actions, damages, costs or expenses of any kind arising out of, caused by or relating or in any way related to exposure to the coronavirus or COVID-19 by participating in the activities. I understand and agree that this release and waiver of claims includes any claims based on the actions, omissions, or negligence of MAUI BASKETBALL ASSOCIATION, whether a coronavirus infection occurs before, during,or after participating in the activities.5. I hereby forever indemnify and hold harmless MAUI BASKETBALL ASSOCIATION from any damages or claims made against MAUI BASKETBALL ASSOCIATION as a result of, arising out of, or in any way related to exposure to the coronavirus or COVID-19 through my or my child(ren)'s participating in the activities, including but not limited to any costs and attorneys fees incurred by MAUI BASKETBALL ASSOCIATION related thereto..

BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF I AM INJURED OR PROPERTY IS DAMAGED DURING MY PARTICIPATING IN THE ACTIVITIES, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST MAUI BASKETBALL ASSOCIATION, EVEN IF SUCH INJURY OR DAMAGE IS CAUSED BY THE ACTION, INACTION OR NEGLIGENCE OF MAUI BASKETBALL ASSOCIATION. I UNDERSTAND THAT I FOREVER GIVE UP THE RIGHT TO SUE OR MAKE A CLAIM AGAINST MAUI BASKETBALL ASSOCIATION IF I SUFFER ANY INJURY OR PROPERTY DAMAGE EVEN THOUGH I DO NOT KNOW WHAT OR HOW EXTENSIVE THE INJURY OR DAMAGE MAY BE. I HAVE READ THIS RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT AND UNDERSTAND ALL OF ITS TERMS. I EXECUTE THIS DOCUMENT VOLUNTARY AND WITH FULL KNOWLEDGE OF ITS LEGAL SIGNIFICANCE.

do hereby agree and consent that he/she/they may participate in the following activities (the "Activities") with MAUI BASKETBALL ASSOCIATION, LLC: a youth basketball league, including practices, tournaments and related activities. I do further agree not to sue MAUI BASKETBALL ASSOCIATION, LLC, their respective members, managers, agents, employees, officers ,representatives, successors and assigns, (collectively referred to as "MAUI BASKETBALL ASSOCIATION) for any claim which may be related in any way to participating in the activities, including but not limited to, any claim arising out of, or in any way related to exposure to the coronavirus or COVID-19 through my child(ren)'s participating in the activities and to forever indemnify and hold harmless MAUI BASKETBALL ASSOCIATION from any claim related thereto. I am aware that I am signing this document on behalf of said minor child(ren) and understand the risks of injury and property damage relating to participating in the activities. I am aware of the legal consequences of signing this document and agree to be specifically bound to all the terms and conditions herein on behalf of the minor child(ren).
