• CONCILIATION SERVICE - NOTICE OF DISPUTE

    To activate a 'dispute conciliation' clause or 'arbitration' clause in a contract written by Master Builders SA only.

  • Is the contract a Master Builders SA produced contract? Please ensure that you attach a copy of this contract when uploading documents, failure to do so may hinder this process.*
  • What is the type of contract you have?

  • Whoever gives notice of dispute below under the relevent clause in the Master Builders SA contract must provide a non-refundable appointment fee to be retained by Master Builders SA. 

    On receipt of the appointment fee and all documentation relating to the matter, Master Builders SA will appoint a suitably qualified conciliator. 

     

    PLEASE NOTE: If the dispute is not resolved by dispute conciliation either party may refer the dispute to arbitration by notifying the other party in writing.  Whoever gives notice of their intention to refer the dispute to arbitration must give a copy of the notice to Master Builders SA together with a non-refundable subsequent appointment fee.

  • If the contract is NOT a Master Builders SA contract then we are unable to assist you with dispute concilliation, therefore, you would need to appoint an independent concilliator this can be sourced at Legal Services Commission.
