Rental Agreement - Great Plains 1206 NT 12 Foot No-till Drill

(Renter) agrees to rent from the Kent Conservation District (KCD), Great Plains 1206 NT No-till Drill (Equipment), subject to the following terms and conditions:

Pick-up Location (Unless otherwise specified): Bob Klein Farm

• Renter will pay KCD the sum of $200.00 per day of possession (not days of use) or $20.00 an acre whichever is greater.
• Equipment will be delivered and picked up at a rate of $2.00 a mile if Renter elects delivery.
• $100 will be charged upon scheduling and signing Rental Agreement, including a non- refundable $25.00 administration fee and a $75.00 deposit prior to taking Equipment. Upon Equipment return, deposit will be credited to outstanding rental balance.
• If Renter fails to take possession of Equipment when scheduled, without notifying KCD, deposit is forfeited.
• If equipment is not cleaned-out of seed, Renter will pay $100.00 clean-out fee.
• Renter will pay $200.00 per day penalty fee for each day Equipment is kept beyond agreed return date.
• Balance of rental fees and any additional charges will be due 30 days after planting, if late payment, $75.00 deposit will be forfeited.
• KCD will discount 10% total amount due under Rental Agreement for MAEAP Verified Farms.

• KCD will provide operating manual and technical instructions to Renter. However, KCD makes no warranty, either expressed or implied as to satisfactory results from Equipment use.
• Renter may hire Conservation District Agricultural Technician at an agreed upon rate for custom application to be negotiated with Technician. Otherwise, Renter(s) must personally operate Equipment.
• Operating SPEED LIMIT of 5.5 miles per hour when using Equipment.
• Transporting SPEED LIMIT of 25 miles per hour on road.
• Renter will not take Equipment out of Kent County without prior consent from KCD. Renter will only use Equipment on locations listed below.
• Equipment will NOT be transferred to another individual without KCD permission.
• Labor, power, lubrication, final calibrations (seed rate, depth control, etc and supplies necessary to operate and transport Equipment to Renter's site, will be furnished by Renter, unless otherwise agreed to by both parties.
• DO NOT reset meter under any circumstances. If meter has been tampered with, you will be charged for 80 acres use per day.
• Renter agrees to pick up and return Equipment to designated shelter place, unless otherwise directed by KCD. Renter will notify KCD as soon as Renter has finished using Equipment.

• Renter will keep and maintain Equipment in good state of repair and cover, house or otherwise protect Equipment from adverse weather conditions during Rental Agreement duration. Renter will pay KCD for replacement and/or repair of Equipment not returned in good condition for any reason including if Equipment is: lost, or stolen, or is damaged.
• Renter will not attempt to repair equipment without prior consent from KCD. Renter will notify KCD immediately if any damage to Equipment occurs. KCD will arrange for replacement or repair and Renter will pay those amounts as invoiced.
• Renter will allow KCD or its agents to enter Renter's property at any time to inspect or secure return of Equipment.
• Renter agrees at its sole expense to maintain during Rental Agreement duration public liability, property damage, and fire with extended coverage, theft and comprehensive insurance with(list company) and agrees to indemnify and hold KCD harmless as to any liability which may arise out of the landowner's transportation and/or operations of no-till drill including, any and all injuries or damage of any person or property. Renter understands the complexity and dangers in Equipment operation and assumes all responsibility in using Equipment. Includes grain box, native grass box, and small seed box for even, mixed plantings!

Complete and submit this form and technician will be in contact to schedule appointment. Renter must pick-up Equipment at appointed time or call 616-222-5846 to reschedule within 30 minutes or Rental Agreement will be terminated and deposit forfeited. KCD will confirm or reschedule appointment by phone at least 24 hours before the scheduled appointment.
