Wild Ferns Parent Waiver Release Form

Both parents please initial and sign where indicated. If you are one parent who is the primary caretaker you may write N/A in Parent 2 sections.

I grant permission for my child (printed full name of participant)

 

• (the "Participant") to participate in all planned activities for the duration of all Wild Ferns Nature Program that I have registered the Participant in for the 2023-2024 season. I understand that the programs involve activities and group interactions that may be new to the Participant, and that they come with uncertainties beyond what the Participant may be used to dealing with at home. These include uneven terrain, extreme weather, standing and moving water, communicable diseases, areas that may result in encounters with animals, reptiles and insects that could result in infections, bites and various transmitted diseases and climbing and other activities such that may result in falls, collisions or being struck by wayward objects as well as other activities. I am aware of these risks and I am acknowledging them on behalf of the Participant. I realize that no environment is risk-free, and so I have instructed the Participant on the importance of abiding by Wild Ferns Nature Program's rules as well as instructions of Wild Ferns Nature Program staff, and the Participant and I both agree that he or she is familiar with these rules and will obey.

 

• I understand that participation in activities can expose the Participant to risk and possible injuries, which include without limitation, bumps, bruises, cuts, strains, sprains, concussions, broken bones, stings, bites, heat exhaustion, heat stroke, allergic reactions and other possible trauma. I understand that there is a qualified certified First Aider on site and grant permission for them to treat the Participant in the event of an injury.

 

• I recognize that the program has a potential for communicable diseases and that Wild Ferns Nature Program recommends and requires that all participants and staff be appropriately immunized for, at minimum, the following diseases: tetanus, mumps, measles, rubella, polio, pertussis (whooping cough), diphtheria, and covid-19. If the Participant shows symptoms that reasonably indicate the presence of a communicable or contagious disease, I agree that if I cannot be contacted, the Wild Ferns Nature Program's staff may take the temporary measures they deem necessary to protect the health status of the Participant and the program community generally. I release and forever discharge Wild Ferns Nature Program and any Released Party (hereafter defined) from all causes of action, suits, claims, demands, or any other damages or costs associated with actions taken by the Released Parties relative to the health, sickness and treatment of the Participant associated with a vaccine-preventable disease. I further agree to defend, indemnify and hold harmless the Released Parties, and each of them, with respect to any current or future disputed or alleged claims or causes of action by anyone including, without limitation the Participant, relative to the health, sickness and treatment of Participant associated with a vaccine preventable disease.

 

• I recognize that Wild Ferns Nature Program reserves the right to postpone or cancel programs/sessions due to unsafe weather conditions or other unforeseen circumstances. Where possible Wild Ferns Nature Program will attempt to reschedule, but this may not be possible. I will not hold Wild Ferns Nature Program liable for loss of fees or programs due to weather or other unforeseen circumstances that will jeopardize the health and safety of staff and participants.

 

• All tools and materials will be provided by Wild Ferns Nature Program. Participants are discouraged from bringing additional items to sessions as they may be lost, stolen, or damaged. I will not hold Wild Ferns Nature Program responsible for any lost, stolen or damaged personal items.

 

• I understand that it is my responsibility to ensure that the Participant is dressed properly for weather conditions as this is a program based entirely outdoors in Prospect Park. I understand that the Participant may be refused admission to a session if the Participant is not clothed properly for the conditions and I will not hold Wild Ferns Nature Program responsible including for any loss of fees or programs.

 

• While participating in the Wild Ferns Nature Program, I understand that the Participant will be required to listen and follow the guidance of Wild Ferns Nature Program staff. This includes expectations for age-appropriate behavior and an ability to respect the health and safety of any member of the group. If for any reason the Participant is unable or unwilling to follow expectations or acts in an unsafe manner towards themselves or others, the Participant may be removed from the session or the entire program. I understand that Wild Ferns Nature Program reserves the right to deny access to a Participant who has been disruptive in the past or sent home because of behavior issues.

 

• In the event that:
  • the Participant's behavior is felt to be unsafe or unmanageable;
  • an illness or injury should arise in which a doctor's diagnosis is required;
  • unsafe weather conditions develop;
  • or other unsafe conditions develop that require Participant's removal from

    I authorize Wild Ferns Nature Program to dismiss the Participant early, in which case I will assume responsibility for transporting the Participant from the program at a time specified based on communication with Wild Ferns Nature Program staff.

• From time to time, Wild Ferns Nature Program may suggest the purchase of certain products or gear for use during programming. These purchases are not required and I understand that Wild Ferns Nature Program makes no representation regarding the fitness of these products or gear for any purpose. I will not hold Wild Ferns Nature Program liable for any claim arising out of any injury to Participant or his or her property as a result of use of any recommended products or gear.

• I further agree, on behalf of myself, and in my legal capacity as parent/guardian of Participant, and all legal successors and proxies, to release and HEREBY DO RELEASE, WAIVE AND COVENANT NOT TO SUE Wild Ferns Nature Program and each and every one of its officers, directors, owners, employees, agents, staff, contractors, insurers, affiliates, attorneys, or any other person associated with any or all of them who might be liable (the "Released Party") from any causes of action, claims, suits, liabilities, or demands or costs of any nature. These include, but are not limited to claims of negligence and claims associated with risks or injuries which I, Participant, and all legal successors and proxies may have, now or in the future, against Wild Ferns Nature Program or any Released Party because of personal injury, property damage, disability, death, sickness, diseases, or accident of any kind, arising out of or in any way related to the Program and activities including without limitation claims resulting from uneven terrain, extreme weather, standing and moving water, communicable diseases, areas that may result in encounters with animals, reptiles and insects that could result in infections, bites and various transmitted diseases, climbing and other activities, bumps, bruises, cuts, strains, sprains, concussions, broken bones, stings, bites, heat exhaustion, heat stroke, allergic reactions, other possible trauma, lost, stolen or damaged personal items, and any loss of fees or programs. I agree that this release, waiver, and covenant not to sue applies however the injury or damage occurs. It includes, but is not limited to, the negligence of Wild Ferns Nature Program or any Released Party. I further agree that it applies whether participation is supervised or unsupervised.

• I acknowledge that I have read and fully understand this entire form, and accept the risks involved with the above Participant's engagement in the activities at Wild Ferns Nature Program.
