TERMS OF SERVICE
These terms and conditions (“Terms and Conditions”) govern the relationship between Vacations By Jim (“VBJ” and/or “us/our”) and you, the purchaser and/or traveler (“Client” and “passenger” and “you/your”). By planning travel with VBJ, you agree to be bound by these terms and acknowledge that VBJ acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to VBJ.
Vacations By Jim – Terms & Conditions
At Vacations By Jim, our goal is to make your travel planning smooth, enjoyable, and stress-free. The following Terms and Conditions are designed to clearly outline responsibilities and expectations so that we can provide you with the best possible service while protecting both you and our business.
1. Agency Role
Vacations By Jim (“VBJ”) acts solely as a booking agent for disclosed principal suppliers, including but not limited to airlines, cruise lines, hotels, tour operators, and other travel providers. VBJ does not own, operate, or control these suppliers and is not liable for their acts or omissions.
2. Supplier Terms & Conditions
All travel services are subject to the terms and conditions of the respective suppliers. By booking travel through VBJ, you agree to be bound by those supplier terms in addition to these Terms & Conditions.
3. Pricing & Availability
Travel prices and availability are subject to change without notice until a booking is confirmed. VBJ is not responsible for price increases, supplier-imposed fees, or changes in itinerary after booking.
4. Payments & Authorization
By submitting a credit card authorization, you agree to allow Vacations By Jim to charge your payment method for travel services purchased on your behalf.
If you have any questions or concerns regarding a charge, you agree to contact Vacations By Jim directly so that we may assist in resolving the issue.
Except in cases of fraud, you agree not to initiate a chargeback or payment dispute without first making a good-faith effort to resolve the matter with Vacations By Jim. In the event a chargeback is improperly initiated, Vacations By Jim reserves the right to recover any costs, fees, or expenses associated with the dispute, including administrative and legal fees where permitted.
5. Cancellations & Refunds
All cancellations, changes, and refunds are subject to the terms and conditions of the travel supplier. VBJ does not control supplier policies and cannot guarantee refunds.
6. Travel Insurance
Vacations By Jim strongly recommends the purchase of comprehensive travel insurance to protect your travel investment. Travel insurance may provide coverage for trip cancellation, trip interruption, travel delays, medical expenses, emergency evacuation, and other unforeseen circumstances.
Travel plans can change unexpectedly due to illness, weather, supplier changes, or other events beyond anyone’s control. Without travel insurance, you may be subject to cancellation penalties and loss of funds in accordance with supplier terms and conditions.
By declining travel insurance, you acknowledge that you understand the potential risks and accept full financial responsibility for any losses that may occur. Vacations By Jim is not responsible for any costs incurred due to lack of insurance coverage.
7. Travel Documents & Requirements
Clients are responsible for ensuring they have valid passports, visas, and any required documentation for travel. Requirements vary by destination and may change at any time.
VBJ is not responsible for denied boarding, entry, or additional costs resulting from improper or missing documentation.
8. Health & Safety
Clients are responsible for understanding and complying with any health requirements, including vaccinations, testing, or entry restrictions imposed by destinations or suppliers.
9. Client Responsibility
You are responsible for reviewing all booking confirmations, itineraries, and travel documents for accuracy and notifying VBJ immediately of any errors.
You are also responsible for complying with all supplier rules, regulations, and codes of conduct. VBJ is not responsible for denied services or disruptions due to failure to comply.
10. Force Majeure
Vacations By Jim shall not be liable for any failure or delay in performance of its obligations due to circumstances beyond its control, including but not limited to acts of God, weather events, natural disasters, pandemics, government actions, travel restrictions, labor strikes, civil unrest, supplier defaults, or other unforeseen events.
In such circumstances, refunds, credits, or changes to travel arrangements will be subject solely to the terms and conditions of the travel suppliers. Vacations By Jim does not guarantee refunds or compensation in situations where travel is impacted by force majeure events.
11. Limitation of Liability
VBJ shall not be liable for any injury, loss, damage, delay, or inconvenience caused by any supplier or third party. By booking with VBJ, you agree to release VBJ from liability related to travel services provided by suppliers.
12. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Georgia. Any disputes shall be resolved in the appropriate courts within that jurisdiction.
13. Acceptance of Terms
By booking travel through Vacations By Jim, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
