  • THIS LEASE AGREEMENT, made and entered into on this day of    , 20            by and between MADISON MINI STORAGE of Madison, whose mailing address is P.O. Box 131, Madison, FL 32340, as LESSOR (hereinafter called "MADISON MINI STORAGE"), and

  • (hereinafter call "LESSEE")

     

    IN CASE OF EMERGENCY, LESSEE authorizes MADISON MINI STORAGE to serve notices or contact the following party:

     

  • Important: The following information will be filled out by Madison Mini Storage. You WILL NOT have to enter anymore fields.

  • Subject to the terms and conditions set forth in this Lease, MADISON MINI STORAGE hereby leases to LESSEE unit number in a building known as MADISON MINI STORAGE at 1098 E Hwy 90, Madison, Florida.

  • Term

  • 1. The term of this Lease shall commence and end on the following dates, unless sooner terminated in accordance with the termination provision herein.

  • 2. If LESSEE or MADISON MINI STORAGE does not give notice of termination as provided for in this Lease and if LESSEE is not in default hereunder, then this Lease will extend to the end of the next calender month and will automatically be extended on the first day of each calendar month thereafter until termination has been issued in accordance with the TERMINATION provision herein. All provisions of this Lease shall continue in full force and effect as long as the Lease continues. 

  • Rent

  • 1.LESSEE agrees to pay MADISON MINI STORAGE $ per month as rent for the unit plus any and all tax levied thereon by any governmental authority. This monthly rent shall be paid in advance on the first day of the month for which the rent is due. IF RENT IS NOT PAID BY THE FIFTH OF THE MONTH IT IS DUE, LESSEE WILL BE REQUIRED TO PAY AN ADDITIONAL $10.00 LATE CHARGE FOR ADMINISTRATIVE AND HANDLING EXPENSES.

    2.LESSEE shall pay a security deposit of  $    against damage to the leased unit, which may also be applied to any delinquent rent and/or late charges or returned check fees. The deposit is not prepaid rent, and it will be refunded at the termination of the Lease provided the required 15 day notice has been given, there is no damage to the premises, rent deficiency, breach of provisions provided for in the TERMINATION paragraph herein, or any default under any provision of this Lease. In the event of damage to the unit, rent deficiency, breach of provisions provided for in the TERMINATION paragraph herein, or any default under this Lease by LESSEE, MADISON MINI STORAGE will retain the security deposit and apply such deposit to the restoration or delinquent rents, late charges, or any fees that might be due and earned under the terms of this Lease, the additional costs shall be paid to MADISON MINI STORAGE by LESSEE upon request by MADISON MINI STORAGE.

    3.If the initial period as described under TERM herein ends on a day other than the last day of a calendar month and LESSEE has not served written notice of termination as provided for herein, the LESSEE shall pay no later than ten (10) days prior to the end of the initial period, to MADISON MINI STORAGE, the amount specified in RENT, paragraph #1 above, as rent for the remainder of the calendar month in which the initial period ends, if payment has not been previously made.

  • Termination

  • 1.LESSEE shall give fifteen (15) days notice of intent to vacate the storage unit or to terminate the lease contract. Refunds will be as follows: (1) for leases less than one month, the security deposit will not be refunded; (2) refunds of rent shall not esceed 1/2 month's rent or the unused rent already paid, whichever is less; and (3) the security deposit will not be refunded if payments are not tiely or if unit is not left clean. 

  • Default

  • 1. LESSEE agrees that MADISON MINI STORAGE is hereby given, in addition to such liens and remedies provided by the law to secure and collect rent, a contractual lien against all of LESSEE'S property now or at any time hereafter stored in the leased unit or on the premises.
    2. LESSEE shall be in default if it has not paid the stipulated rent, including the $10.00 late charge, or any other sums due MADISON MINI STORAGE, by the 5th day of the month or within five days after any other period for which such payment is due. Upon default, MADISON MINI STORAGE is authorized and shall have the right to place its own locks on the door of the unit immediately upon such default and without notice to LESSEE, provided MADISON MINI STORAGE shall then send notice of default by registered mail or acknowledged hand delivery to LESSEE'S address shown above or to such other address as LESSEE shall later furnish to MADISON MINI STORAGE in writing.
    3. Any notice sent to LESSEE pursuant to this section shall state that unless the default is corrected with fifteen (15) days of the notice, MADISON MINI STORAGE shall publish in a local newspaper, once a week for two consecutive weeks, a notice of intent to sell the contents of the unit at a public auction, at a specified time, date, and place. If LESSEE does not pay all stipulated rent, including late fees or any other sums due MADISON MINI STORAGE prior to the time of sale, the contents will be sold and the proceeds of such sale shall first be allocated to MADISON MINI STORAGE to pay the amount owed it, including reasonable cost of such sale and notice thereof, including attorney fees, then to a second month's rent if LESSEE has still not notified MADISON MINI STORAGE of its intention to terminate this agreement, and the balance, If any, to be paid to the LESSEE. LESSEE and MADISON MINI STORAGE hereby specifically agree that, in addition to all other remedies provided herein and by law, the procedures of Florida Statute 83.807 and the Self-Storage Facility Act effective July 1,1982, for the sale of the contents and application of proceeds therefrom shall be also incorporated herein by reference.

  • Use of Leased Unit

  • 1. LESSEE expressly agrees with MADISON MINI STORAGE that it will use the rented unit solely for storage of personal property; that it will not store any explosive or highly flammable materials in the unit; that it will not store perishable goods on the premises;
    in a building known as
    that it will maintain the unit in good condition; that it will surrender the unit in the same condition that the unit was in when it received the unit, reasonable wear and tear expected: and the MADISON MINI STORAGE, or its agents, shall have the right to enter the unit at all times to examine the unit and to make repairs.
    2. LESSEE agrees that any improvements, signs, or modification to the rental unit shall be at LESSEE'S expense and will not be made unless a prior written approval therefor has been obtained from MADISON MINI STORAGE. Any such improvements of a fixed nature will remain with the rental unit, intact, when LESSEE vacates the premises.
    3. LESSEE agrees not to leave trash or debris outside of the leased unit and agrees to be responsible for removing same. LESSEE further agrees that it will not make any use of the unit which would be unlawful or constitute a nuisance.

  • Liability and Insurance

  • 1. LESSEE expressly agrees that it will, at its own expense, obtain its own insurance, if any, on the property stored in the leased unit and that MADISON MINI STORAGE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE TO OR LOSS OF IT'S PROPERTY FROM ANY CAUSE WHATSOEVER, INCLUDING, but without limitation, fire and water damage, vandalism, and theft. LESSEE further agrees to indemnify and hold harmless MADISON MINI STORAGE in connection with any such damage or loss, and from the active or passive acts or ommissions or negligence of the lessor, lessor agents or employees, and LESSEE hereby waives all rights to recover against MADISON MINI STORAGE for any loss. r damage by any cause whatsoever against which LESSEE can insure.

  • No Assignment or Subletting

  • 1. LESSEE may not assign this Lease or sublet any part of the subject premises or any unit therein without the prior written consent of MADISON MINI STORAGE.

  • Legal Fees and Costs

  • 1. LESSEE shall pay MADISON MINI STORAGE reasonable attorney fees for the services of MADISON MINI STORAGE'S attorney and will pay all other costs and expenses to incurred by MADISON MINI STORAGE in the enforcement of this agreement.

  • Conditions

  • 1. Due to the excessively humid climate conditions, lessor shall not be responsible for any damages whatsoever caused or contributed to by mold or mildew or moisture-related contaminations.
    2. Lessee hereby authorizes lessor to release any information regarding lessee and lessee's occupancy as may be required by law or requested by governmental authorities or agencies, law enforcement agencies or courts.
    3. If you are in the military service, you must provide written notice to the lessor. The lessor will rely on this information to determine the applicability of the Service Members Civil Relief Act.
    4. Lessee understands that all unit sizes are approximate and enters into this agreement without reliance on the estimated size of the storage space.
    5. Lessee agrees that in no event shall the total value of all stored property be deemed to exceed $5,000 unless lessor has given permission in writing for lessee to store property exceeding $5,000 in value and lessee has provided proof of insurance to owner o cover the value of stored property. Lessee agrees the maximum liability of lessor to lessee for any claim or suit by lessee, including but not limited to any suit that alleges wrongful or improper foreclosure or sale of contents of a storage unit, is $5,000.

  • Payment Policy

  • 1. LESSEE agrees that Madison Mini Storage will no longer accept a personal or business check from a tenant with a bounced check history.
    1. LESSEE agrees that Madison Mini Storage accounts in default after receiving payment in full by cash or cashiers check may take 2 business days to remove ones lock.
