Verification Bodies seeking approval by Capturiant (“Applicants,” “Applicant,” or “The Applicant”) must meet the requirements laid out in the Capturiant Standard. This Verification Body agreement sets out further stipulations for approval:
- The Applicant must be a duly constituted, validly existing and in good standing under the laws of the jurisdiction of its organization or incorporation.
- The Applicant must maintain proper financial accounts and abide by high professional standards in all its business practices and, subject to Capturiant’s request, has provided a summary of its financial position.
- The Applicant’s accounts must indicate that it can pay for all services related to business conducted on, with, or in relation to the Capturiant platform on a prompt and timely basis. It must be the Applicant’s practice to honor payment terms.
- The Applicant must have policies in place, including good governance provisions, to guard against bribery, corruption, and money-laundering that are at least as stringent as Capturiant’s own policies. The Applicant will promptly inform Capturiant of any and all non-compliance with, or complaints or allegations of improper conduct in violation of, such policies.
- With respect to anti-money laundering, anti-terrorist financing, sanctions, and “know your client” laws binding on or affecting the Applicant or its property or operations, the Applicant must be in compliance with all legally binding constitutions, treaties, statutes, laws, ordinances, rules, regulations, guidelines, interpretations, permits, judgments, decrees, injunctions, writs, and orders.
- Applicant must disclose any pending lawsuits that may affect the Platform or any Project accepted, which has not already been publicly disclosed.
By signing and submitting below, the undersigned affirms that they are duly authorized to agree to the above terms on behalf of the Applicant, and that they understand that submitting this agreement and/or meeting the criteria listed above do not guarantee approval by Capturiant.
