Informed Consent and Acknowledgement

ASSUMPTION OF RISK  

The undersigned states that he/she understands that the MVP Swimmers. and its/their officers, employees, and  agents, is/are not and shall not be responsible for or liable for any illness, death, injury to person or damage to property  arising from, related to, or resulting from the programs provided and the undersigned hereby forever releases, discharges  and holds harmless MVP Swimmers. and its/their officers, employees, and agents, from any and all claims, liabilities,  suits, and/or damages of any kind that the undersigned, the swimmer, and/or his/her heirs, administrators, representatives, executors or assigns have, may have or claim to have resulting in any way from his/her participation in said program(s).

 

RELEASE OF LIABILITY 

In consideration of being allowed to participate in any way in the MVP Swimmers c/o MVP Lifeguards. program, its related events and  activities, I , the undersigned, acknowledge, appreciate, and agree that: The risk of injury from the activities involved in this  program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment,  and personal discipline may reduce this risk, the risk of serious injury does exist; and, I KNOWINGLY AND FREELY ASSUME  ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and  assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and  conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation,  I will remove myself from participation and bring such to the attention of the Company immediately; and, I, for myself  and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD  HARMLESS MVP Swimmers c/o MVP Lifeguards., their officers, officials, agents and/or employees, other participants, sponsoring  agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releasees”), WITH  RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM  THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I HAVE READ THIS RELEASE  OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT , FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN  UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 

FOR PARENTS/GUARDIANS OF PARTICIPANTS OF MINORITY AGE 

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her  release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree  to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or  participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law. 

MVP SWIMMERS c/o MVP LIFEGUARDS, LLC PHOTO RELEASE FORM

I hereby grant MVP SWIMMERS c/o MVP LIFEGUARDS, LLC permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of MVP SWIMMERS c/o MVP LIFEGUARDS, LLC and will not be returned.

I hereby irrevocably authorize MVP SWIMMERS c/o MVP LIFEGUARDS, LLC to edit, alter, copy exhibit, publish, or distribute these photos for any lawful purpose. Inaddition, I waive any right to inspect or approve the finished product
wherein my likeness appears. Additionally, I waive any right to royalties or
other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge MVP SWIMMERS c/o MVP LIFEGUARDS, LLC from all claims, demands, and causes of action which I, my heirs,representatives, executors, administrators, or any other persons acting on
my behalf or on behalf of my estate have or may have by reason of this
authorization.

Medical Release and Authorization

As Parent and/or Guardian of the named adventurer, I hereby authorize the diagnosis and treatment by a qualified and licensed medical professional, of the minor child, in the event of a medical emergency, which in the opinion of the attending medical professional, requires immediate attention to prevent further endangerment of the minor’s life, physical disfigurement, physical impairment, or other undue pain, suffering or discomfort, if delayed.

Permission is hereby granted to the attending physician to proceed with any medical or minor surgical treatment, x-ray examination and immunizations for the named athlete. In the event of an emergency arising out of serious illness, the need for major surgery, or significant accidental injury, I understand that every attempt will be made by the attending physician to contact me in the most expeditious way possible. This authorization is granted only after a reasonable effort has been made to reach me.

Permission is also granted to MVP Swimmers, and its affiliates including Directors, Coaches, and Team Parents to provide the needed emergency treatment prior to the child’s admission to the medical facility.

Release authorized on the dates and/or duration of the registered season.

This release is authorized and executed of my own free will, with the sole purpose of authorizing medical treatment under emergency circumstances, for the protection of life and limb of the named minor child, in my absence.

Confirmation

BY ACKNOWLEDGING AND SIGNING BELOW, I AM DELIVERING AN ELECTRONIC SIGNATURE THAT WILL HAVE THE SAME EFFECT AS AN ORIGINAL MANUAL PAPER SIGNATURE. THE ELECTRONIC SIGNATURE WILL BE EQUALLY AS BINDING AS AN ORIGINAL MANUAL PAPER SIGNATURE.
