          • This Questionnaire must be filled out completely by the Vendor(s) to enable preparation of the Form 1.

            The Form 1 is required to be served on your prospective Purchaser(s) to finalise your contract.

            Has the vendor been notified that a building on the land has been identified as part of a South Australian Building Cladding Audit initiated in 2017 and conducted by the former Department of Planning, Transport and Infrastructure in conjunction with the Metropolitan Fire Service, Country Fire Service and councils:

          • a) As having aluminium composite panels installed on the exterior of the building?*
          • b) As constituting a moderate, high, or extreme risk as a result of that installation?*
          • c) As requiring remediation to reduce the risk to an acceptable level?*
          • d) As not having had the necessary remedial work performed or a determination made by the appropriate authority of the relevant council (within the meaning of section 157 of the Planning, Development and Infrastructure Act 2016) that no further action is required?*
          • Particulars relating asbestos at workplaces

            asbestos and asbestos containing material have the same meaning as in the Work Health and Safety Regulations 2012; workplace has the same meaning as in the Work Health and Safety Act 2012.

            1. A register is not required to be prepared for a workplace-
              1. if a register has already been prepared for the workplace; or
              2. if- 
                1. the workplace is a building that ws constructed after 31 December 2003; and
                2. no asbestos has been identified at the workplace; and
                3. no asbestos is likely to be present at the workplace from time to time.

            See regulation 425 of the Work Health and Safety Regulations 2012.

          • 2. A person with management or control of a workplace who plans to relinguish management or control must ensure (so far as is resonably practicable) that the asbestos register is given to the persob assuming management or control of the workplace.

          • Notice to the Vendor or the person signing this Questionnaire

            Sections 7 and 9 of the Land and Business (Sale and Conveyancing) Act 1994, require the Vendor and the agent to provide certain information to the purchaser of the land. This document will be used to prepare the Form 1 and then provide that information to the purchaser and must be completed accurately.

            • Confirm that, to the best of my/our knowledge and after making reasonable checks, the information I/we have provided is true, correct and complete.
               
            • I/We understand that if any information is missing or incorrect, it may place the proposed sale of the property at risk and may make me/us responsible for any claims made by the Purchaser.
               
            • If I/we am signing on behalf of the Vendor(s), I/we confirm that I/we have written authority to do so as their appointed representative or attorney.
               
            • I/We agree to advise Tuckfield Conveyancing and the Agent if new information about the property arises; if any notices are received or if any information changes (eg: a refinance), before the Form 1 is issued.
