PARISI SPEED SCHOOL
WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA RELEASE

Operator: D&T Murphy and Associates Inc. d/b/a Parisi Speed School

1. ACKNOWLEDGMENT OF VOLUNTARY PARTICIPATION
I, the undersigned parent or legal guardian, hereby acknowledge that I am voluntarily enrolling my child in the Parisi Speed School program (including the Pee Wee program for ages 4–7) operated by D&T Murphy and Associates Inc. d/b/a Parisi Speed School at Gold’s Gym Middletown, NY.

I understand that participation in athletic training programs is voluntary and involves inherent risks.

2. ASSUMPTION OF RISK
I acknowledge and fully understand that participation in athletic training, sports performance activities, and related programs involves inherent and unavoidable risks, including but not limited to:

Slips, trips, and falls
Muscle strains, sprains, and fractures
Contact with equipment or other participants
General physical exertion risks
Injuries arising from the nature of youth athletic activity
I expressly acknowledge that such risks may result in serious injury, permanent disability, or death, and that these risks may arise even when reasonable care is exercised.

I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Released Parties (defined below).

3. REPRESENTATION OF HEALTH
I represent and warrant that:

My child is in good physical condition and able to participate in athletic activity
My child has no medical condition that would prevent safe participation
I maintain valid and sufficient medical insurance coverage for my child
I understand that no medical services, diagnosis, or treatment will be provided by Parisi Speed School, Gold’s Gym, or their staff.

4. RELEASE OF LIABILITY (BROAD FORM RELEASE)
In consideration for my child being permitted to participate in the program and use the facilities, I, on behalf of myself, my child, and all related parties, hereby fully release, waive, discharge, and covenant not to sue:

D&T Murphy and Associates Inc. d/b/a Parisi Speed School
Gold’s Gym Middletown (Franchise)
Parisi Speed School (Franchisor/Licensor)
Gold’s Gym (Franchisor and parent companies)
All affiliated entities, subsidiaries, and related businesses
Their respective officers, directors, owners, members, managers, employees, contractors, agents, representatives, volunteers, and assigns
(collectively referred to as the “Released Parties”)

FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

Personal injury
Death
Property damage or loss
Emotional distress
Any other damages
WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, arising out of or related to:

Participation in any program or activity
Use of facilities or equipment
Presence on or around the premises
Any activities conducted on or off-site

5. INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, or expenses (including attorneys’ fees) arising out of or related to:

My child’s participation in the program
Any actions or conduct of my child
Any claims brought by or on behalf of my child

6. ACKNOWLEDGMENT OF NEGLIGENCE WAIVER
I expressly acknowledge that this waiver is intended to be as broad and inclusive as permitted under the laws of the State of New York, and that it includes a waiver of claims arising from the negligence of the Released Parties to the fullest extent permitted by law.

7. MEDIA RELEASE (PHOTO & VIDEO USE)
I hereby grant to D&T Murphy and Associates Inc. d/b/a Parisi Speed School, Gold’s Gym, and all affiliated entities the irrevocable, perpetual, worldwide, royalty-free right and permission to:

Photograph
Record video
Capture audio
Use my child’s name, image, likeness, and voice
for purposes including, but not limited to:

Marketing and advertising
Social media content
Promotional materials
Website and digital media
Print materials and campaigns
I acknowledge and agree that:

Media may be captured at any time, without prior notice
I will receive no compensation for such use
All media becomes the sole property of the Released Parties
I waive any right to inspect or approve final materials
I release all claims related to privacy, publicity, or likeness

8. EMERGENCY MEDICAL AUTHORIZATION
In the event of an emergency, I authorize staff to obtain medical treatment for my child. I understand that I am financially responsible for any medical services rendered.

9. SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. GOVERNING LAW
This agreement shall be governed by and interpreted in accordance with the laws of the State of New York.

11. ACKNOWLEDGMENT AND SIGNATURE
I HAVE READ THIS AGREEMENT CAREFULLY.
I FULLY UNDERSTAND ITS TERMS.
I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.

PROMOTIONAL RELEASE: In additional consideration of being permitted by The Parisi Speed School and Gold's Gym to participate in its training program and
to use its facilities, I hereby permit The Parisi Speed School and Gold's Gym to use my child's name, image, photo(s), videos, and likeness for promotional purposes limited to its kids exercise and training programs and facilities. The Parisi Speed School’s and Gold's Gym's promotional mediums include but are not limited to print, radio, video, television, social media, and the Internet. I acknowledge that I have read this release and waiver and fully understood its contents. I have been fully and completely advised of the potential dangers incidental to having my child engaged in the activity and instruction of kids exercise and training, and I am fully aware of the legal consequences of signing this release. I voluntarily agree to the terms and conditions stated above.
