1: Commissions paid to Consignor is 40% of total selling price. Any applicable shipping and credit card processing fees will be deducted from the total sale amount (less taxes) before the consignor / consignee split is made. Example: $500 sale total (no tax included) - $15 (3% card processing fee) - $25 (free shipping over $500) = $460 x 0.40 = $184 paid out to the Consignor. Consignment Commission Percentages above 40% for Select items will be articulated on your Consignment Intake List (emailed to you with everything itemized). If the customer makes a purchase online under $500, they pay for the shipping. If a customer pays cash, there are no card processing fees.
2: Genuine Design has full authority in setting the product prices. We thouroughly reasearch every item to asses its value based on condition and global market. We always aim to get the most for our Consignor's. We maintain the right to change prices at any given time. No harrassment, bargaining, or negotiating terms/ pricing.
3: Closet Clean’s: are provided under the basis you have 20 or more items to consign. We charge an hourly rate of $50 per hour in order to perform a closet clean. Travel time (to and from your home) is charged at 1 hour time on top of the cleaning itself. We charge an upfront deposit of $250 and will either refund the difference or charge more if need be (must be paid on-site). No Show Fee: The $250 deposit will be kept if a Consignor is not at home or the agreed upon location and time for a Closet Clean. The Consignor must cancel AT LEAST 24 hours before the appointed time.
4: Shipping To Us: is at the Consignor’s expense. There will be no reimbursement for shipping to us. Genuine Design is not responsible for product lost or damaged in the mail. This form must be signed prior to us accepting any items. Items that are identified in poor condition and unfit to sell are donated to Big Brothers Big Sisters Foundation or disposed of unless the Consignor wishes to pay “Request an Item Back” charges as listed above. Genuine Design will notify the Consignor by email first and give 72 hours for you to choose a course of action. If there is no response after 72 hours, the item(s) will be donated.
5: Dropping Off Product In-Store: If we can assess the items at the time of drop off, we will. If it is too busy in the store, we will need to fit the full assessment in within 3 business days. Any items we do not accept must be picked up within 72 hours or they will be donated. We unfortunately do not have the space to store extra items. Thank you for understanding!
6: Items Accepted: The item(s) must be (a) on our list of approved brands or approved by a Genuine Design employee, (b) 100% authentic (ideally will include any original receipts, packaging, or tags), and (c) in good condition. The Consignor will be charged a fee upfront if the consigned product needs to be cleaned or fixed. Shoe cleaning and pricing is outsourced to Brillare Shoe Care (www.brillare.ca). Clothing is cleaned by Randell's.
7: Counterfeit Items: If an item submitted to us is found to be counterfeit, Consignor will be immediately notified. The item will either be donated or can be sent back to Consignor for additional fees (see #7 "Request Item Back").
8: Request an item/ product back: a $50 processing fee per item is charged if a Consignor requests any item/ product(s) back. This is in place to cover labour, authentication fees, and any other expenses we incur. If the item/ product(s) needs to be shipped, the Consignor must agree to pay for the full amount of return shipping.
9: Cleaning Fees: For items 20 or less, we will charge you up front for any associated fees. For more than 20 items, we will email you an invoice within 72 hours of receiving your items. This invoice MUST be paid within 72 hours of receipt. Due to extremely limited storage space, we do not have room to store items that are not being sent out for cleaning or being prepped to enter into our inventory. Therefore a 5% fee of outstanding fees will be charged to your account every 24 hrs until the invoice is paid. No exceptions.
10: Payouts: Please reach our to us for an update on your items no more than once a month. We will provide an update within 72 hours and ask you how you would like your balance paid out. We pay out via E-transfer in the first 2 weeks of every month OR Store Credit. Your first E-transfer is free. Otherwise every E-transfer will have a $1.50 fee for each payout in order to cover banking fees. This will be taken off the total payout amount per payout. Your payout balance expires after 2 years.
11: Termination Clause: If Genuine Design encounters a situation where the Consignor does not abide by the Terms & Conditions or Harassment occurs, the business contract will become null/ void. Any remaining amounts owed to the Consignor will be paid out on the last of month. Any remaining product may be sent back only AFTER applicable fees are paid to Genuine Design.
12: Terms and Conditions are subject to change without notice.
These terms are a legal agreement between Genuine Design. ( “we” or “us”) and you as the Consignor. You should read all the terms before indicating acceptance. These terms apply to the store, website, social media, and any new features that we may introduce from time to time. If new terms accompany any of those new features, then those terms will apply. By using our website, affiliates, and consigning, you accept these terms. If you do not accept them, do not use this website, affiliates, or consign with us. By signing this form, you also acknowledge you are the rightful owner of any consigned items and have full authority to sell them at the time of consignment. By consigning items with us, you are transferring temporary ownership to us. This means your items are now covered under Genuine Design's insurance while they are in our possession. **Jewlery is only covered up to $5,000 in value**
You are bound by these terms even if you do not read all the terms.
