Please electronically sign this Disclaimer, Release and Indemnification of Hadassah (the “Release”) using JOTFORM.
I am aware that this is a time of ongoing conflict and hostility in Israel which, from time to time and with or without warning, may include times of war even if not existing currently. I understand and voluntarily assume the dangers and risks of attending this Trip and traveling to Israel, including risks associated with my safety and security and/or risks that could result in damage or physical, emotional or psychological injury, harm, illness, or death. Nevertheless, I have decided to voluntarily participate in the Trip and agree to accept any and all such dangers and risks involved with participating in this Trip. By signing this release, I agree that Hadassah is not liable for any such damage or physical, emotional or psychological injury, harm, illness, or death and I release Hadassah2 from any liability arising as a result of my participation on this Trip.
By registering and participating in a Hadassah sponsored trip and/or certain pre- and post-extension tours, which include associated travel to, from and within Israel and/or other countries, as applicable (the “Trip”), I (as used herein “I” includes myself, my family members, next of kin, heirs and representatives, agents, successors and assigns) agree to the following:
A. General
- I am familiar with and understand the activities involved in the Trip and I agree to follow and be bound by all instructions, rules, restrictions and policies with respect to the Trip contained in the Trip registration forms or otherwise hereafter established including any health or security related requirements that may be established during the Trip, or as otherwise provided by the Israeli police or other Israeli security forces. In the event of emergency conditions that might emerge in Israel as a result of deterioration in the security situation, participants are required to adhere to additional security guidelines as may be issued to them by Hadassah and/or by Israeli security forces. In the event I am coming to Israel during a time of war or ongoing conflict and hostility, I understand that I must take extra precautions and follow guidelines issued by Israeli authorities, be aware of locations of bomb shelters and ensure I keep current with safety and security regulations and instructions, which are also published in local media.
- I acknowledge and agree that, notwithstanding any security arrangements that may be made by Hadassah, Hadassah does not guarantee and is not liable or responsible for my personal safety or the safety of my property while participating in the Trip, any Trip-related activities, or any travel before, during and after the Trip, including, but not limited to, personal travel, airline travel, ground transportation, public transportation and travel reserved through a ride-share application, meals, lodging, and recreational activities.
- I understand and agree that Hadassah acts only as an agent for the Trip participants in making arrangements with third parties regarding the Trip. The tickets, coupons, tariffs, rules or contracts currently in use by any carrier, hotel, restaurant, or other contractor rendering services shall constitute the sole contract between such contractor and me and Hadassah does not guarantee any rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects.
- All rights are reserved to adjust registration fees, costs or other expenses in connection with participating in the Trip or any Trip-related activities at any time and to substitute accommodations and/or services of a similar category when deemed necessary. Itineraries, activities, fees, and speaker-lecturers are subject to change without notice, and such substitution or withdrawal is not a basis for participant cancellation or refund.
- I further agree that I assume full responsibility for, and that Hadassah shall not be liable or responsible for, any personal travel prior to, during or after the conclusion of the Trip, Trip-related activities that I choose to partake in or any goods or services that I obtain from third party vendors prior to, during or after the conclusion of the Trip.
- I understand and voluntarily assume all risks, whether or not foreseeable, of attending the Trip, participating in Trip-related activities, domestic and international travel, travel during the Trip, and traveling to, from and within Israel and/or other countries, as applicable, including risks associated with my safety and security and/or risks that could result in damage or physical, emotional or psychological injury, harm, illness, death, disease or other damage.
- Hadassah reserves the right to decline to accept or dismiss any Trip participant at any time before or during the Trip, for any reason whatsoever, including failure to complete the Trip payment, registration forms and/or this Release in accordance with the published schedule, failure to comply with any instructions, rules, restrictions or policies contained in the Trip registration forms or otherwise hereafter established with respect to the Trip, including any health or security related requirements, or in the event a participant’s mental or physical condition or general behavior or deportment impedes the operation of the Trip or affects the rights, welfare or enjoyment of other Trip participants.
- I agree that no refund will be given if I am dismissed and/or otherwise removed from or leave the Trip for any reason (voluntarily or involuntarily) and that I shall be responsible to pay any and all associated fees and expenses in connection therewith, including without limitation, return fare, shipping of baggage, or any and all damages caused by my actions or involving me. Hadassah reserves the right to cancel the Trip at any time due to low enrollment, health risks, security, or any other reason whatsoever within its sole discretion.
- I further acknowledge and agree to Hadassah’s Terms and Conditions and Privacy Statement, and consent to receiving additional communications regarding the Trip and/or Hadassah from Hadassah, Ayelet Tours, Ltd., and/or other third parties providing arrangements in connection with the Trip.
B. Travel Warnings
I acknowledge that Hadassah has no control over or responsibility for any adverse effect on the Trip arising from or relating to any war or ongoing conflict and hostility in Israel and/or diplomatic relations between the United States or my country (if I am not a United States citizen or resident) and Israel and/or any other countries to which I may be traveling. I further acknowledge that the United States or my country (if I am not a United States citizen or resident) has laws, rules, regulations, orders, policies, guidance, travel recommendations and sanctions which may be specific to travel to Israel and/or any other countries to which I may be traveling and that it is my sole responsibility to comply with all such laws, rules, regulations, orders, policies, guidance, travel recommendations and sanctions including, but not limited to, the sanctions programs administered by the United States’ Department of Treasury’s Office of Foreign Assets Control.3
If I am a United States citizen or resident, I acknowledge that I have read, and understand the contents of the current (1) Travel Advisories and Alerts issued by the U.S. Department of State4, (2) Security Alerts and Health Alerts issued by the U.S. Embassy in Israel5, and (3) Travel Health Notices issued by the Centers for Disease Control and Prevention6 (such travel advisories, alerts and notices collectively referred to herein as “U.S. Travel Warnings”), which, among other things, advise United States citizens and residents on the general security environment and health risks worldwide and in Israel and reiterate threats to American citizens and U.S. interests in those locations. I understand that the current U.S. Travel Warnings are subject to change at any time, and my agreement to this Release will remain in full force and effect in the event of any changes thereto.
If I am not a United States citizen or resident, I acknowledge that Hadassah has advised me to check any travel alerts, advisories, notices, and warnings to Israel and/or any other countries to which I may be traveling, issued by my own country, which are subject to change at any time and my agreement to this Release will remain in full force and effect in the event of any changes thereto.
Notwithstanding the U.S. Travel Warnings or any other travel alerts, advisories, notices, and warnings referenced herein and the dangers they warn of, I understand the dangers and risks involved and have decided to voluntarily participate in the Trip. I understand and agree that Hadassah shall not be obligated to take any special precautions or provide extra staffing for me in light of this Trip or any of the U.S. Travel Warnings or any other travel alerts, advisories, notices, and warnings referenced herein, including if I am traveling to Israel during a war or ongoing conflict and hostility. I am aware that this is a time of ongoing conflict and hostility in Israel. Furthermore, the current security situation will likely dictate additional travel restrictions from time to time, and I acknowledge that I am responsible to familiarize myself with them and abide by them. I hereby agree to accept any and all risks associated with participating in the Trip.
C. Medical
1. I understand that the Trip may include certain vigorous activities and I am aware of, able to, and will take responsibility for placing upon myself appropriate physical limitations reasonably calculated to avoid injury, harm or illness and I agree that Hadassah is not responsible for imposing such limitations. By participating in the Trip, I certify that I am physically fit to do so and have no known health conditions that impair or prevent me from participating in the Trip.
2. I hereby give consent and authority to Hadassah to make decisions regarding my medical treatment and to obtain and arrange for medical treatment, if possible, on my behalf if I am injured or require medical attention during my participation in the Trip or any Trip-related activities. I understand that Hadassah’s ability to obtain and arrange for medical treatment on my behalf if I am injured or require medical attention during my participation in the Trip or any Trip-related activities may be affected by the ongoing conflict and hostility in Israel and I understand and agree that Hadassah is not responsible to provide such treatment if, in Hadassah’s assessment, conditions do not permit it. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation as well as all death related expenses, such as transportation of the body and funeral expenses.
D. Insurance
1. I acknowledge that Hadassah has advised me, and it is entirely my responsibility, to purchase and pay for accident, baggage, supplemental international travel health, trip cancellation, and war risk or high-risk insurance to cover reimbursement for trip cancellation, trip delay, missed connections, sickness, accident, medical expenses, evacuation, death, lost baggage, personal effects, etc., and if I already own such insurance or any other personal insurance, to check the terms of my insurance in light of attendance on the Trip, participation in any Trip-related activities, travel to, from and during the Trip, and any U.S. Travel Warnings or any other travel alerts, advisories, notices, and warnings referenced herein.
2. I understand that the insurance carrier makes all determinations regarding the insurance policies and acknowledge that Hadassah has no control over, and accepts no responsibility for, the insurance policies, including, but not limited to, the scope of the coverages, the terms of the policies, the administration of the policies, the determination of benefits or the payment of claims.
3. I also understand that Hadassah does not provide insurance coverage of any kind, including but not limited to workers' compensation insurance for volunteers and/or other Trip participants. I expressly waive any claim for compensation or liability on the part of Hadassah in the event of any injury, death or medical expense incurred during the Trip. I acknowledge that many life insurance policies and other insurance policies on which I may rely on in my country of origin may become void if injury or death occurs in connection with terrorism and/or war and I have been advised to review such policies before traveling to Israel.
E. Publicity Release
I irrevocably grant to Hadassah and its third party vendors, the right to stream, post, photograph, film and/or otherwise record, by any and all methods now or hereafter known, my image, voice and/or likeness in connection with the Trip or any Trip-related activities and to license, distribute, disseminate, display and/or otherwise use my name, voice and/or any stream, post, photograph, image, audio and/or visual recording or likeness in which I may appear or any utterance or statements I may make during the course of my participation in the Trip or any Trip-related activities, including any photographs, images, statements, audio and/or visual recordings recorded or provided by me, or that any other Trip participant and/or any third party may record or provide to Hadassah, or any portion thereof, in any media throughout the world, including but not limited to, all digital media such as websites, emails, virtual meeting platforms, and social media, any number of times, in any and all manners, and by any and all means now or hereafter known, for any advertising, trade, fundraising, promotional or for any other purpose, without approval or any compensation unless required by law. I certify that I own or have the proper rights to license, distribute, disseminate, display and/or otherwise use any photographs, images, statements, audio and/or visual recordings that I may provide to Hadassah for the purposes described in the preceding sentence. I agree that any stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement as described herein shall be owned by Hadassah and shall be Hadassah’s sole and exclusive property, and Hadassah shall have the right to edit any such stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement in Hadassah’s sole discretion. I hereby release Hadassah from any and all liability in connection with the use of my name and/or any such stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement described in this paragraph. I agree to execute, upon request by Hadassah, any and all additional documents necessary to effectuate the intent of the above-mentioned rights.
F. General Release and Indemnification
The term “Claims” as used in this Release shall mean any and all claims and liability of any kind whatsoever, past, present and future, both known and unknown, including those which have not yet arisen or matured, whether in law or in equity, arising from, related to, or in connection with the Trip, the Trip arrangements, my participation in the Trip and any Trip-related activities, travel to, from, during, before and after the Trip (including personal travel, airline travel, travel on public transportation, and travel reserved through a ride-share application), my free time during the Trip, any medical advice, treatment or testing, medical transportation, evacuation, medications, immunizations or vaccinations I may or may not receive, any insurance policies I may or may not obtain, any actions taken in connection with security requirements, including searches of my person or property, my departure, withdrawal, or removal from the Trip and/or any Trip-related activities, any communications or notices or lack thereof before, during or after the Trip, any anti-discrimination laws (including without limitation those protecting persons with disabilities), laws and regulations of any jurisdiction, diplomatic relations, any delay, inconvenience, property damage, loss or theft, any hostile act, government restraint, government act or omission, terrorism or threat of terrorism, war and the hazardous and unpredictable outcomes of war, social unrest, protests, demonstrations or rallies, hostage-taking, kidnapping, local laws and regulations, climatic conditions, breach of contract, occurrence, accident, business interruption, bankruptcy, machinery breakdown, failure or difficulty, visa, passport, vaccination or other entry requirement, substitution or change of hotels, transportation or other services, rates, bookings, reservations or connections, food or drink, insect or other bite, allergic reaction, mortar or rocket fire, fire, natural disaster, epidemic, pandemic, including, without limitation, COVID-19, labor dispute, baggage and property handling, changes to or absence from or cancellation of the Trip program, whether or not foreseen, any other conditions, developments or disruptions, any physical, bodily, emotional or psychological injury, harm, illness, sickness, disease, or death, third party claims and all other claims, causes of actions, suits, penalties, judgments, liabilities, damages, costs, losses or expenses (including attorneys’ fees and expenses) of any nature whatsoever, including but not limited to, claims for negligence on the part of Hadassah or on the part of any other person or entity, including without limitation, transportation operators, tour guides, hotels, restaurants, caterers and other suppliers. I agree that Hadassah’s implementation of the Trip or Trip related activities during a time of war or ongoing conflict and hostility in Israel shall not constitute negligence, reckless, or malicious acts or omissions.
In consideration of my acceptance to participate in the Trip and/or Trip-related activities, and by signing below, I, for myself, my next of kin, family members, heirs, representatives, agents, successors and assigns, hereby agree to:
(i) Release, waive and discharge Hadassah from any and all Claims;
(ii) Covenant not to sue Hadassah with respect to any and all Claims; and
(iii) Indemnify, defend and hold harmless Hadassah from any and all Claims arising from, related to, or in connection with:
(a) My acts and omissions and any involvement by me in the Trip and/or Trip-related activities, and before, during and after the Trip; and
(b) Any and all Claims made at any time, past, present or future, by me, or any of my family members or any person to whom I am related by blood, adoption or marriage, or their heirs, representatives, agents, successors or assigns.
G. Governing Law/Jurisdiction
I agree that this Release and any and all issues related to this Release and/or the Trip are to be solely and exclusively governed by and enforceable in accordance with the laws of the State of New York without giving regard to its conflict or choice of law provisions. I agree that the State or Federal courts located in the City of New York shall have exclusive jurisdiction to determine disputes arising from, related to, or in connection with, or in any way involving the Trip or this Release, including the applicability of this clause or the validity of this Release, and I consent to the exercise by such courts of personal jurisdiction over me and waive and agree not to assert any objection or defense based on lack of personal or subject matter jurisdiction or venue. I agree to waive my rights, if any, to institute or prosecute suit in any forum other than any State or Federal court located within the City of New York. I agree to pay all reasonable attorneys’ fees and all other costs and expenses which may be incurred by Hadassah in the enforcement of or attempt to enforce this Release, whether by action of law or otherwise. This Release is intended to be as broad and inclusive as permitted by the laws of the State of New York in favor of Hadassah, and if any term or provision of this Release is declared invalid by a court of competent jurisdiction, the remaining terms and provisions of this Release shall remain unimpaired and in full force and effect. In the event that any provision of this Release is determined to be so broad as to be unenforceable, such provision shall be interpreted to be only so broad as is enforceable. Failure by Hadassah at any time to enforce any obligation by me, to claim a breach of any term of this Release or to exercise any power agreed to hereunder will not be construed as a waiver of any right, power or obligation under this Release, will not affect any subsequent breach, and will not prejudice Hadassah as regards to any subsequent action.
I acknowledge that I have read and understand this Release and that it shall be binding on me on behalf of myself, my family members, next of kin, heirs, representatives, agents, successors and assigns. This Release, together with the registration forms for this Trip, contains the entire agreement between the parties to this Release. If there is any inconsistency between the registration forms for this Trip and this Release, this Release shall control. This Release, together with the registration forms for this Trip, supersede any prior or contemporaneous agreements, understandings and negotiations regarding its subject matter. I acknowledge and agree that my electronic signature on this Release using Jotform shall be deemed to be an original handwritten signature for all purposes.
Hadassah Trip Release (updated September 2026)(OVER 21)
[1] Each participant traveling without children must sign this release. For those traveling with children under 21 years old, a different trip release must be signed by the child’s parents or legal guardians who are traveling on the trip on behalf of themselves and the child. If a child is 18 or older such child must also sign a release. Please refer to the trip registration materials for the appropriate trip release.
