  • Building an Appeal to the Senate Review Board Academic (SRBA)

  • When a student has exhausted previous appeal levels, they may be able to appeal to SRBA. The grounds for appealing to SRBA differ from grounds of appeal at previous levels so not all appeals have sufficient grounds to appeal to SRBA. 

    The Senate Review Board Academic’s (SRBA) jurisdiction is limited to the following academic appeals:

    • a scholastic offence;
    • a failure to follow or properly apply a Senate regulation;
    • the Dean’s decision requires a student to withdraw from a program, from the University, or from an Affiliated University College;
    • general marking or grading practices;
    • a failure to observe a procedural requirement at the decanal level; or
    • bias at the decanal level.

    This worksheet will help you to prepare the content and build your appeal submission. This form is not to be used in part of or as a substitution for your submission to SRBA. Your submission must follow the procedure outlined in the applicable policy.

  • When considering submitting an appeal to SRBA, it is your responsibility to understand the appeal procedures, identify your grounds for appeal, and clearly explain your justification and evidence for each identified ground of appeal.

    In this section, you will identify your Grounds for Appeal
  • Let's begin by identifying your grounds for appealing to SRBA. The grounds for SRBA are listed in the Academic Appeals policies for both Undergradaute and Graduate Students, as well as on the SRBA Application for Hearing.  

  • Details of the Appeal

    In this section, we will focus on the Details of your Appeal
  • It's also important to note that your appeal is not a resubmission of your appeal to the previous level - it's a fresh appeal that is based on the decision made at the previous level. 

    For example, if you are appealing the dean's decision to deny your Dean's Waiver request your appeal would focus on the Dean's Decision - not your originally submitted Dean's Waiver.  

    For each ground of appeal you identified, you will need to: 

    1. identify the ground for appeal;
    2. state the argument(s) for each ground;
    3. describe the relevant evidence to support each argument, including references to consecutively numbered exhibits, if any, that are attached to the Details of the Appeal
  • You have indicated that you wish to appeal on the ground:  

    The appeal is against a finding that my conduct amounted to a scholastic offence. 

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    The appeal is for relief against the penalty imposed by the Dean as a result of a scholastic offence.

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    There has been a failure to follow, or to properly apply, a Senate regulation. 

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    The Dean's decision requires me to withdraw from a program, from the University, or from an Affiliated University College.

     

    Please note: SRBA only has jurisdiction to hear an appeal when a Dean’s decision specifically requires you to withdraw. SRBA does not have jurisdiction to hear appeals where the Dean’s decision subsequently triggers the implementation of policy(ies) administered by the Office of the Registrar or the School of Graduate and Postdoctoral Studies requiring your withdrawal.

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    The appeal is against general marking or grading practices.

     

    Please note: The term “general marking or grading practices” refers to the overall marking or grading structure of a course or an assessment as applied to all students in the course. It does not apply to a mark or grade given to you individually. SRBA will look for evidence of unfairness or flaws in the design or implementation of the overall marking or grading structure. 

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    There was a failure to observe a procedural requirement at the prior level. 

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • You have indicated that you wish to appeal on the ground:  

    There was bias at the prior level. 

  • Evidence

    As stated in policy, SRBA will only consider evidence that was available to the Dean whose decision is being appealed.
  • If you have evidence you wish to include that was not previously before the Dean, it may be considered by SRBA. If submitted, SRBA will review and determine if the evidence is revelant, significant, and could not have been available at an earlier stage through reasonable efforts. 

    SRBA requires a written explanation as to why this evidence was not previously available be included at the time of submission.

  • Requested Relief

    In your appeal, state the relief you are requesting if your appeal to SRBA is successful.
