    Please provide your contact details to be used on all online marketing provided by ListedBySeller.ca. This information will be made available to the general public for the purpose of contacting you regarding your property.

  • Ownership Verification

    Before the property information can be uploaded to Realtor.ca, we need to confirm ownership of the property. We need a property tax bill, legal transfer document or assessment report showing you as an owner. We also require a copy of government ID(s) matching the name(s) of each owner on title of the property. This documentation will be kept confidential. We ask for such documentation to avoid fraudulent listings.

    Cooperating Commission: The Property Owner can offer a cooperating commission to Buyer/Tenant Agents as an incentive to entice them to cooperate with the Property Owner for the sale/lease of the Property Owner’s property. The Property Owner is under no obligation to provide a cooperating commission unless a commission agreement is signed with a cooperating agent for their specific buyer/tenant. As previously stated in this agreement, the Property Owner may negotiate a commission arrangement directly with the buyer/tenant’s brokerage to their satisfaction without consulting the Brokerage. The Property Owner should request that a cooperating agent presents their commission agreement prior to or companying their offer.

    If you would like a cooperating commission to be offered to licensed real estate agents, please indicate the amount below. The commission offered can be a fixed amount or a percentage of the sale/lease amount.

    MARKETING AGREEMENT


     

    BETWEEN: LISTEDBYSELLER.CA RE MARKETING GROUP, hereinafter referred to as (the “LBS”) agrees to provide the following products and services to Property Owner.               

    The Property Owner, upon the signing of this Agreement, will pay as remuneration the Service Fee as indicated above by credit card to LBS In-Trust, a one dollar portion of which will be payable to ICI Source Real Asset Services Inc., if the Property is sold or leased, by LBS for the brokerage services provided. This agreement is on a month to month basis and can be cancelled at any time by either party. The Service Fee is non-refundable.  

    The Property Owner agrees that the LBS will not be held liable in any manner whatsoever for any acts or omissions with respect to advertising by LBS or any other party, other than by the LBS's gross negligence or willful act.

    The Property Owner hereby indemnifies and saves harmless LBS and/or any of its employees, servants, or sales representatives from any and all claims, liabilities, suits, actions, losses, costs and legal fees caused by, or arising out of, or resulting from the posting of the property information and documents or other information (including, without limitation, photographs, images, graphics, audio and video recordings, virtual tours, drawings, floor plans, architectural designs, artistic renderings, surveys and listing descriptions as aforesaid.

    LBS does not allow for the advertising of any third party services on any online property marketing related web pages created for the Property Owner by LBS. LBS reserves the right to alter any property related data entered into our system by the Property Owner that does not abide by LBS rules.

    LBS agrees to provide Property Owner with the following products and services following the Service Fee being received by LBS from Property Owner.

     

    • Realtor.ca Listing: The Property Owner’s property will be listed on Realtor.ca. The Property Owner’s direct contact information cannot appear on Realtor.ca because of Canadian Real Estate Association rules. Prospective Buyers/Tenants will be directed on the Realtor.ca listing to a property webpage which will contain your direct contact details. 
    • Property Webpage: We provide you with a professional property webpage with your direct contact information to showcase your property to potential buyers/tenants.
    • Listing Syndication: Your property sale/rental listing may be showcased on partner websites including, but not limited to, Realtor.ca, Homefinder.ca, Ovlix.com, Point2homes.com, partner Listing Brokerage sites and others listed on our website.
    • Photos on Realtor.ca: Pictures are an important component of marketing a property. We truly showcase your property by allowing up to 40 photos on the monthly, 2, 3, 6 and 12-month plans at a time per listing.
    • Execution of Services: The marketing material and listing services shall be completed within 5-7 business days following the Service Fee being paid by the Property Owner to LBS, although the timeline is not guaranteed. The Service Fee is non-refundable.

  • Contact Details on REALTOR.CA®

  • All our properties are listed through our partner brokerage to gain access to REALTOR.CA®. Because of MLS rules, only a brokerage can list a property on REALTOR.CA®, and only their contact details are listed on REALTOR.CA. We cannot list seller/landlord contact details directly on your REALTOR.CA® listing.

    There are three ways a buyer/tenant can contact you through REALTOR.CA®.


    1. The first way is by the buyer/tenant calling the brokerage. A receptionist is available 24/7 to answer calls. They would take down the contact details of the lead and send you a system email.
    2. The second way is by the buyer/tenant clicking Email Realtor on REALTOR.CA and send a message. An email is sent to the brokerage servers and automatically within 5 minutes; you will receive a system email with the information of the lead. This is an automatic process available 24/7.
    3. The third way is by a buyer/tenant clicking Go to Listing on Realtor.ca and seeing your contact details on the property webpage we create for you.


    All leads are sent to you regardless if a buyer/tenant contacts the brokerage only or clicks on the link on REALTOR.CA to view your property webpage.

  • PROPERTY PHOTOS ACKNOWLEDGEMENT

  • The Seller/Landlord hereby confirms that they have paid for and own the property photos they have uploaded to the ListedBySeller.ca website to be used on the MLS.

    Property photos cannot be taken from a previous MLS listing unless you have obtained written consent from the listing agent to use the photos with your listing. 

    Unlawful use of photos can result in your listing being removed without notice and you being fined up to $2,500.

  • MLS SHOWING RULES ACKNOWLEDGEMENT

  • Because of MLS rules, showings cannot be restricted to certain times and dates. The property has to be available to show within a reasonable time frame (24-48 hours). You also cannot ask for seller/tenant documentation up front as a condition of allowing the showing.

    Realtors have to be allowed to show your property on the MLS system. There is no obligation of the seller/landlord to offer a commission to a Realtor showing your property unless you indicated you are offering a co-op commission on the MLS listing.

    Failure to comply with these rules can result in your listing being removed from the MLS without notice with no refund provided.
