CONSENT & RELEASE

In consideration for the opportunity to participate in an activity, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned individual (“you”) hereby irrevocably consents to the unlimited reproduction, distribution, and use by Drivosity, LLC and its affiliates (collectively, “Drivosity”) of your name; image; likeness; voice; signature; statements, quotes, stories and anecdotes provided by you; all of your other personal or commercial attributes or identifying features; and any interior or exterior photographs, videos, or other depictions of your home or office, which may or may not contain images of your family, friends, or pets (each, a “Likeness”).

Drivosity may reproduce, distribute, modify, publicly display, publicly perform, and use any Likeness for any purpose related to Drivosity business; and in any form or medium now existing or later developed (the “Media”). Drivosity shall be the exclusive owner of all right, title, and interest in and to any materials it creates and the Media, together with all related intellectual property rights. You hereby irrevocably transfer, sell, and assign to Drivosity all of your worldwide right, title, and interest, if any, in and to any and all videos/films, photographs, scripts, text, audio or visual elements, and all other materials and items that Drivosity creates or has created in any Media incorporating your Likeness, together with all rights of copyright and all other intellectual property or proprietary rights. You hereby waive any and all rights of publicity, rights of privacy, and character rights associated with Drivosity’s use of a Likeness and you hereby release Drivosity from all claims arising out of Drivosity’s use of a Likeness. Drivosity may, in its sole discretion, modify, change, adapt, or otherwise alter a Likeness.

This Consent & Release does not obligate Drivosity to use or commercially exploit a Likeness. Drivosity may transfer or exercise the rights granted in this Consent & Release without providing notice to you, receiving your consent, or compensating you. You warrant that you are authorized to execute this Consent & Release and your execution of this Consent & Release will not result in a breach or violation of any other agreement. Upon Drivosity’s request, you agree to take such actions and execute such documents as Drivosity determines to be necessary in furtherance of this Consent & Release. The invalidity of any portion of this Consent & Release shall not affect the enforceability of the remainder of this Consent & Release. This Consent & Release shall be governed by the laws of the State of Florida. Venue for any lawsuits related to this Consent & Release shall be in Orange County, Florida. You hereby consent to the exclusive jurisdiction of the federal and state courts located in

Orange County, Florida. Copies of an executed version of this Consent & Release may be treated as an original for all purposes.

IN THE CASE OF AN INDIVIDUAL PICTURED BEING A MINOR:

The undersigned, the parent or legal guardian of the individual referenced herein, hereby agrees to this Consent & Release on behalf of the individual and further agrees that the individual shall be bound by the provisions of this Consent & Release.
