I (April Gregory and AG Marketing & Consulting Group dba Wonder Woman Marketing, “Company”) respect your privacy and must insist that you respect the privacy of fellow Event participants. By signing below, you agree not to violate the publicity or privacy rights of any Event participant. I respect your confidential and proprietary information, ideas, plans and trade secrets (collectively, “Confidential Information”) and must insist that you respect the same rights of fellow Event participants and of the Company.

By signing below, you agree (1) not to infringe any Event participant’s or the Company’s copyright, patent, trademark, trade secret or other intellectual property rights, (2) that any Confidential Information shared by Event participants or any representative of the Company is confidential and proprietary, and belongs solely and exclusively to the participant who discloses it or the Company, (3) you agree not to disclose such information to any other person or use it in any manner other than in discussion with other Event participants during Event sessions. By signing below, you further agree that (4) all materials and information provided to you by the Company are its confidential and proprietary intellectual property, belong solely and exclusively to the Company and may only be used by you as authorized by the Company, and (5) the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited. Further, by signing below, you agree that, if you violate, or display any likelihood or violating, any of your agreements contained in this paragraph, the Company and/or other Event participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

In addition, by signing below, you promise to participate fully, taking results-oriented action, which accurately represents the power and vision of our Event. The service provided is coaching and marketing training and consulting, it is not therapy or counseling, nor financial, legal or tax advice.  The Program instructors are not qualified to provide medical, legal, financial or tax advice, and as such by signing below you indicate you are of sound mind and body and are entering into the Agreement with full understanding of these limitations.

Your participation in and application of the Event is 100% your responsibility, and your results are a direct reflection of your personal interpretation and execution of the information provided, your dedication, desire, and motivation.  We have made every effort to accurately represent the Event and its potential.  By signing below you also agree that there is inherent risk in participating in this event, and there is no guarantee that you will earn money as result of your participation.

By signing you also indicate that you understand that the Event sessions may be photographed and those photos may be used in the future for promotional purposes by April Gregory. I agree that host of A Brand New You Retreat (AG Marketing & Consulting Group dba Wonder Woman Marketing) may use such photos of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising and Web content. 

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, because of their possible liability without fault.

In consideration of my application and permitting me to participate in this event, I hereby take the actions noted below for myself, my executors, administrators, heirs, next of kin, successors, and assigns vis-à-vis the following ENTITIES OR PERSONS: April Gregory, host of A Brand New You Retreat (AG Marketing & Consulting Group dba Wonder Woman Marketing) and/or their employees, representatives, and agents.  

(A) I WAIVE, RELEASE, AND DISCHARGE the entities or persons mentioned in this paragraph from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event;

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise.

I acknowledge that host of A Brand New You Retreat (AG Marketing & Consulting Group dba Wonder Woman Marketing) and their employees or representatives are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on their behalf.

In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following: I am aware of the existence of the risk on my physical appearance to the venue and my participation to the activity of the Organization that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.

I declare that if I experienced symptoms such as fever, fatigue, sore throat, or cough, or any other symptoms relating to COVID-19 or any communicable disease within 5 days of the event or during the event, I will take a covid test and only participate if the test is negative. If any member(s) of my household, have exhibited symptoms within 5 days of the event, I will take a covid test and only participate in the event if the test is negative.

I am fully and personally responsible for my own safety and actions while and during my participation and I recognize that I may be in any case be at risk of contracting COVID-19. With full knowledge of the risks involved, I hereby release, waive, discharge the Organization, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

I agree to indemnify, defend, and hold harmless the Organization from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.

This Event Release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL. I HAVE READ AND UNDERSTAND THE ABOVE.
