BCA BOATING RULES AND REGULATIONS

In the case of any rule(s) herein that have been determined to be unclear or in contradiction to other rules or policies, BCA staff is granted discretion to interpret such regulations in a manner that honors the overall intention of the Boating Policy until such time that the BCA Board has approved any necessary changes to the rule(s).

General Registration and Info

1. Members of the Brandermill Community Association, Inc. (“BCA”) must comply with BCA policies to register and rent a boat space and storage space and use the amenities. The BCA may refuse to register any boat for a member that has failed to comply with the BCA Boating Rules and Regulations and/or is not in good standing.
   
   
2. Boats are any watercraft including, but not limited to, sailboats, catamarans, canoes, Jon boats, paddle boats, pontoon boats, windsurfers, kayaks, inflatable boats, and paddle boards that can be used on the Swift Creek Reservoir. The BCA reserves the right to restrict the type and size of boats stored on Association property. Except for Locked Storage, watercrafts operated only by gas-powered motors are not allowed to be stored on Association property.
   
   
3. All boats stored on personal and BCA property are subject to BCA’s governing documents, shall be owned entirely by a BCA member or tenant, and must be registered with the BCA. BCA members may use the Swift Creek Reservoir and boat launches on Association property. The BCA sets the annual boat space rental fees. The completed rental agreement will require a copy of the current registration and/or license with the County and State. Such documents must show the member’s or tenant’s property address within the Brandermill Community.
   
   
4. Registration with the Association is for the boating year and includes payment of a non-refundable boat space rental fee, which covers the rented space and BCA sticker. Rental spaces renew on January 1; payment is due by January 31. Payments received after January 31 are considered late and will incur a late fee. An updated rental agreement and documentation will be required for the registration/renewal process.
   
   
5. As set out in the Code of Virginia’s Title on Taxation, Section 58.1-3902 – The BCA must provide the county tax assessor with an annual list of boats and boat owners. The code provision reads, in relevant part: “Every person . . . operating in the Commonwealth a marina or boat storage place which accommodates more than four boats shall, on or before February 1 of each year, upon the request of the commissioner of the revenue of the county or city in which such marina or boat storage place is located, file with the commissioner of the revenue a list giving the name and address of the owner and operator, if such is available, and the name and number of each boat physically located and normally kept at his marina or boating storage place as of the preceding January 1.”
   
   
6. Boat owners must place boats in their assigned spots with the current year BCA sticker immediately following boat registration or renewal unless otherwise communicated to the Association. The sticker must be displayed in a clearly visible location on the exterior of the boat/trailer. Failure to comply could result in loss of space and reassignment to another boat owner. Boats/trailers are only considered fully registered once the current BCA sticker is placed on the boat(s) and the agreement is returned.
   
   
7. Stored boats cannot be substituted or changed without prior notice and confirmation from the BCA. Failure to pay the boat space rental fee or comply with the boating rules, including continued unsightly conditions, may cause termination of the space rental and removal of the boat/trailer.
   
   
8. The only permitted item to be stored or secured at/to your assigned post is the approved registered boat and approved registered professionally manufactured dolly if needed to launch your boat. All items are subject to Compliance Inspections.
   
   
9. Boats/trailers found on Association property that are not registered or do not have a record of ownership with the BCA will be identified as abandoned. If the boat/trailer has a registration number on it, the Association will search for the owner through the Virginia Department of Game and Inland Fisheries database and contact the owner. If the Association cannot locate ownership information, the boat will be marked with a yellow non-compliance tow sticker with a request to contact the Association within 14 days. Failure to comply will result in the removal of the boat by the BCA. To receive your boat back, a recovery fee of $150.00 or the fee imposed by the third-party vendor, whichever is greater. The recovery fee will be collected prior to the item(s) being returned.
   
   
10. Generators may be placed on the shoreline for battery charging. Batteries may be charged between the hours of 7 am-7 pm. No overnight charging will be permitted. See Chesterfield County Code of Ordinances, Code 1978, § 20-14, Article I, Section 18-6.
    
    
11. The BCA Boat Charging Agreement must be completed and submitted to the Association office, along with the annual boat registration paperwork for boats being stored and charged along the shoreline.
    
    
12. Boat owners are responsible for cleaning up any fuel spills associated with their boats and contacting Chesterfield Emergency at 911.
    
    
13. When a registered boat owner ceases to be a BCA member or sells the boat, registration is automatically canceled. The owner must remove the boat/trailer from the rental space, remove the BCA sticker, and immediately notify the BCA. This allows the office to keep the Association and County’s records current.
    
    
14. Rental spaces shall not be assigned, subleased, or pledged by the boat owner to another individual or party.
    
    
15. The BCA may reassign rental spaces to accommodate boats of varying sizes.
    
    
16. No boat may be left in any location on BCA property other than its assigned spot overnight.
    
    
17. Failure to pay the rental charge or comply with the boating rules, including continued unsightly conditions, may cause termination of the space rental agreement and removal of the boat/trailer.

T-Racks/Posts/Boat on Trailer/Marina Rentals

• Any member who stores a boat on a T-Rack or post is considered a T-Rack/Post Renter.
• Any member who stores a boat on a personal trailer at Commodore Pointe (The Landing) is considered a boat-on-trailer
  renter.
• Any member who rents a slip at the Marina is considered a Marina Renter.

1. Storage areas on BCA property are located at Sunday Park, The Landing at Commodore Point, Harbour Pointe, Waterside Park, and waterfront homes.
   
   
2. Waterfront posts are reserved for approved larger boats such as pontoons, catamarans, and sailboats. Some larger Jon boats/rowboats and canoes may also be moored to posts. T-racks are reserved for smaller boats such as canoes, kayaks, Jon boats, paddleboards, and small sailboats. Posts (not along the water) are reserved for trailers, boats on trailers, and kayak
   trailers.
   
   
3. Due to the variety in sizes/types of boats, the BCA, in its sole discretion, may determine if any boat or other craft is incompatible with its current spot. The BCA may reassign rental spaces to accommodate boats of varying sizes or when erosion makes specific spaces unusable.
   
   
4. Due to space limitations, members may rent only one space per rental type, i.e., Boat on Trailer, T-Rack, Beach, Post, or Marina. If additional space is available and the BCA agrees, the boat owner may be assigned multiple spaces.
   
   
5. A maximum of two boats may be stored per t-rack space, space permitted, laying side by side next to each other, not stacked on top of each other. Watercraft(s) should not touch or impact another’s property.
   
   
6. T-Racks with two boats on them (where one is a bigger size boat - like a Jon boat or a big canoe) that are stacked on top of each other due to not enough room to place both boats side by side prior to 2024 will be allowed to continue utilizing the T-Rack until such time that one of the boats is sold or replaced with another one, then at this time, the boats will need to be stored side by side and not stacked, making the bigger one not able to be on the same T-Rack space as an additional boat.
   
   
7. Boats stored on Association Property may be inspected without notice.
   
   
8. Boats stored at The Landing at Commodore Point boat and trailer area must be stored on a serviceable trailer intended for only boat hauling and storage. Except for Locked Storage, watercrafts operated only by gas-powered motors cannot be stored on Association property.
   
   
9. No boat cradle or other structure may be used without the prior approval of BCA. Boat trailers may not be used as cradles on the beach.
   
   
10. Small boats beached on the shore should be pulled entirely out of the water or secured at the bow and stern to prevent damage to adjacent boats. Boats stored in cradles should be secured to the cradle and assigned post. Large boats, such as pontoons, should be secured from both the port and starboard bow (unless there is a single central bow cleat) and to the assigned post. Large boats must use a stern anchor as well.
    
    
11. Boats must be stored with tight-fitting covers that do not collect water or must be stored upside down. If covering your boat, you must use a commercial-grade product made for the specific purpose of covering/protecting boats. Covers that are in disrepair or were not designed for use as a boat will be considered unsightly/unkempt condition in accordance with General Covenants Part 1, Paragraph 5, and subject to covenant enforcement. Concrete blocks, bricks, or similar items are not permitted to keep boat covers tight and secure.
    
    
12. Boat owners are responsible for checking and inspecting their boats periodically, especially following severe weather, to assure their stability and free them of excess water and debris. All boats must be locked and secured to post or t-rack.
    
    
13. Boat owners are responsible for any damage caused by their improperly secured boat or trailer.

Home Waterfront Boat Storage

• Waterfront property is defined as a residential lot that is contiguous with waterfront open space/buffer.
  
  1. A waterfront property owner may apply for permission to store and adequately secure one motorized boat and one non-motorized larger vessel near the water’s edge, secured to a home dock or posts within the property site lines. Small vessels, including kayaks and paddle boards, are not permitted in the buffer area. If your boat is improperly secured, it is subject to violation. If your boat is not secured from both sides and anchored to a post, dock, or tied to a tree, your boat is improperly stored.
  
  2. All boats stored at waterfront homes must be registered with the Association, and the annual boat storage fee will be assessed. The ARB and BCA must approve the placement of boats, posts, docks, cradles, or other structures.
  
  3. Owners may store additional non-motorized boats in an appropriate screened or covered area on their property. These boats must be registered with the BCA and will be assessed a yearly home boat storage fee.
  
  4. All boats registered with the BCA and stored on BCA or waterfront property must be owned entirely by Brandermill members or tenants.

Home Registration

1. Any member who stores a boat at home must register their boat with the BCA.
   
   
2. All watercraft used on the Swift Creek Reservoir, whether stored on BCA property (t-racks, posts, or waterfront property) or stored at a Brandermill home (in the garage/under the deck), must be registered. The annual home boat storage fee must be paid to the BCA for general identification purposes and use of the Brandermill site.
   
   
3. Boats kept at home must be in an enclosed or screened area such as a garage or shed or kept under a screened deck so the boats are not visible from adjacent property or street.

Parking Passes and Boat Sticker Access

• Brandermill has several designated parking areas available only to our members who obtain our current BCA hangtag. This pass is required for parking privileges in the lower loop (near the boat ramp) at Sunday Park, The Landing at Commodore Pointe, and Harbour Pointe Pool and Clubhouse. Chesterfield County Police regularly patrol these areas. Vehicles parked in these areas not displaying current hang tags are subject to ticketing and/or towing at the owner’s expense.
  
  
• Registered boats may be launched from the beach or boat launch at the designated areas at Sunday Park, The Landing at Commodore Point, Harbour Pointe, and Waterside Park. Designated parking spaces are available for vehicles with boat trailers at Sunday Park in the boat trailer and overflow lot. Members using Association boat ramps/launches must display a current BCA sticker and hangtag.

Conduct

1. Members are fully responsible for the safety of themselves and their guests. Boaters are expected to follow the rules and regulations of all regulatory and law enforcement agencies while on BCA property.
   
   
2. Swimming or wading in the Reservoir from BCA property is not permitted.
   
   
3. Boaters on Swift Creek Reservoir are primarily dependent upon the rescue services of Chesterfield County for emergencies. Please visit Virginia DWR for more boating and safety information.

Violations

All boats/trailers stored on BCA property must adhere to BCA standards or will be found in violation. Standards include:

1. Only boats/trailers are permitted to be stored in rental space.
   
   
2. Ramps, trailers, carts, and other items/materials should not be stored or locked to any beach post or T-rack location.
   
   
3. Boat/trailer owners cannot construct or build structures at any beach post locations.
   
   
4. The current BCA sticker must be displayed in a clearly visible location on the exterior of the boat/trailer. 5. Boatsfound in unkempt condition may be in violation, specifically:
   -No mold or moss present on boat or cover(Members must use environmentally friendly products to clean)
   -Tight-fitting covers that do not collect water
   -Torn seats, broken features, or otherwise unkempt must be repaired, covered, or not visible.
   -Must be in working condition and able to float.

The following course of action will be taken if a boat/trailer is found in violation:

1. The owner will be notified by a violation letter via USPS from the BCA Compliance Department and will have two weeks to correct the violation and inform the BCA upon completion.
   
   
2. If the boat owner fails to fix the violation within two weeks, a second letter will be sent out via USPS, allowing the owner 14 days to correct the violation and comply.
   
   
3. If the violation has not been corrected, the BCA will either place a yellow violation sticker on the boat/trailer as a final notice, which allows the owner one week before the boat will be removed from the assigned spot or send out by certified mail a Hearing Panel Referral Letter to go through the hearing panel process. After the hearing panel process and monetary charges of $900 have been reached, the boat will be removed from the assigned spot, and your spot will be forfeited. The BCA will hold towed item for 30 days before disposal.
   
   
4. Once the boat has been removed from the space, BCA or the towing company will hold the boat for up to 30 days, and then the item will be discarded.
   
   
5. To receive your boat back, the owner will need to contact the BCA and pay a recovery fee of $150.00, or the fee imposed by the third-party vendor, whichever is greater, and/or any outstanding amenity monetary charges. The required monetary charges will be collected prior to the item(s) being returned.

Proceeding to Payment

For your convenience, online payments can be made immediately upon form submission, streamlining the process and ensuring you are all set. No further action will be required until you pick up your sticker.

PLEASE NOTE: Stickers will be ready for pickup one week after submission of this form to allow for processing time.

Amenity renewals will occur in JANUARY. Members will have until January 31st to submit payment to renew space for the 2024 season. Payments received after January 31st will incur a $15 monetary charge per item. Payments not received by March 1st will be considered nonrenewal and will be subject to towing. The BCA will hold the towed item for 30 days before disposal.
