VERSION FOR MINORS

I acknowledge the risk of participating in climbing, bouldering, and related training includes injuries, illness, property damage, or death which may be caused by:

1. falling off of climbing walls which may involve hitting the ground, people or other structures;
2. the actions of other participants including their falls;
3. the health, fitness, and technique of the participant;
4. climbing as intended.

I understand that this description of risks of participating in climbing, bouldering, and related training are not complete and that other risks, including unknown risks, may result in injuries, illness, property damage, or death.

I, as parent/guardian with legal responsibility for this minor participant, give the minor child listed below permission to attend or participate in climbing, bouldering, and related activities, events, camps, training, competitions, or services organized, sponsored, run, supported, or sanctioned by Climbing Association of Manitoba Incorporated (“Climbing Activities”).

In consideration of the minor child attending or participating in Climbing Activities, I, for myself, my minor child, and our heirs, executors, administrators and assigns, do hereby release, waive, indemnify, discharge, and agree not to sue Climbing Association of Manitoba Incorporated, and their successors, officers, directors, employees, volunteers, instructors, agents, partners, and representatives (“Released Parties”) for all claims, actions, causes of action, settlements, demands and liabilities for damages, losses, costs, expenses and sums of money of any nature or kind whatsoever in law or in equity in any manner arising now or in the future from their attendance or participation in Climbing Activities including any claims that involve the negligent acts or omissions or breach of duty of care of the Released Parties.

The laws of the Province of Manitoba and the federal laws of Canada applicable in Manitoba govern this agreement. The courts of the Province of Manitoba have exclusive jurisdiction for any claims arising from this agreement.

If any part of this agreement is unenforceable, the remaining parts remain enforceable.

I am not relying on any oral or written statement regarding the safety of the Climbing Activities other than what is written in this agreement.
