Terms and Conditions
1. Definitions
In these Terms and Conditions, the following words shall have the meanings set out below:
2. Cottage Food Disclaimer
Products are homemade in a home kitchen operating under the Michigan Cottage Food Law. While every effort is made to ensure quality and safety, Products are made in a non-commercial kitchen and may carry inherent risks. The Supplier makes no warranties, express or implied, regarding merchantability or fitness for a particular purpose.
3. Ingredients and Allergens
All Products may contain or come into contact with common allergens including, but not limited to, soy, wheat, dairy, and nuts.
It is the Customer’s responsibility to inform the Supplier of any allergy requirements before confirming an order. The Customer also agrees to inform their guests of all allergy information. The Supplier shall not be liable for any allergic reaction resulting from the consumption of Products.
4. Orders and Quotations
All quotations are valid for 48 hours from the date of issue.
Orders require a minimum of 14 days’ notice. Rush orders may be accepted subject to availability and incur a surcharge equal to double the original order price.
Products made based on photographs or images provided by the Customer will be the Supplier’s interpretation and may not be exact replicas.
5. Payment and Retainer
A non-refundable retainer of 50% of the total order price is required within 48 hours to secure the booking. Failure to pay within this timeframe will result in cancellation of the order.
Payment methods accepted: cash, CashApp, PayPal, and tap-to-pay, final order will usually have a 2.5%-3.5% increase due to payment method/taxes.
The remaining balance is due on or before the scheduled pickup or delivery date, prior to the Product leaving the Supplier’s premises.
If paying by cash, the exact change is appreciated. For electronic payments, funds must be received before Product release.
6. Delivery and Pickup
Delivery is available at the Supplier’s discretion and may incur additional charges.
Delivery dates and times must be mutually agreed upon. Failure of the Customer to be present at the agreed time may result in the Product being returned to the Supplier’s premises for Customer pickup.
Once the Product is handed over to the Customer or their designated representative, all responsibility for its care, transportation, and storage transfers to the Customer. The Supplier is not liable for any damage incurred thereafter.
If a third party is collecting the Product, a signed release form is required confirming receipt of the Product in good condition.
7. Cancellation, Refunds, and Postponement
The retainer is strictly non-refundable.
Cancellations made up to 2 weeks prior to the event date will receive a refund minus the retainer and cost of any non-recoverable supplies.
No refunds will be issued for cancellations made within 7 days of the event date.
Refunds, if applicable, will be processed within 30 days of cancellation notification.
Event postponements are subject to availability and must be communicated promptly.
8. Limitation of Liability and Indemnification
The Supplier’s liability shall be limited to the total amount paid by the Customer for the Product.
The Supplier shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to allergic reactions or foodborne illness.
The Customer agrees to indemnify, defend, and hold harmless the Supplier from any claims, damages, liabilities, costs, or expenses arising from the use, consumption, or misuse of the Products.
9. Acknowledgment of Risk
By placing an order, the Customer acknowledges and accepts the risks associated with consuming homemade Products produced under Michigan Cottage Food Law. The Customer accepts responsibility for proper storage and timely consumption of Products according to provided instructions.
10. Force Majeure
The Supplier shall not be liable for any failure or delay in performance due to causes beyond reasonable control, including but not limited to natural disasters, illness, or government restrictions.
11. Use of Images
The Supplier reserves the right to use photographs or images of any Product created for promotional or publication purposes unless otherwise agreed in writing.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Michigan.
By placing an order with Jasmine Cake House, Co., the Customer acknowledges and agrees to these Terms and Conditions.
