AGREEMENT
Do not sign this Agreement unless you understand that you have the same liability as all Tenants for rent and other monies owed.
Co-Signer agrees unconditionally, absolutely and continually to guarantee the performance by all Tenant(s) of all obligations under the Rental Agreement, including but not limited to; timely and full payment of Rent, Fees, Utility or Service Charges, Damage to Property, Cleaning and Repair Costs, Early Termination Charges, Lease Break Fees, Late Fees, Legal Fees and Collection Costs and all other sums which may become due under the Rental Agreement.
Co-Signer agrees that the obligations as Co-Signer will continue and will not be affected by amendments, addendums, modifications, Sublease Agreements, rent increases, roommate changes or deletions, unit changes, transfers, extensions or renewals of or to the Rental Agreement which may be agreed to from time to time between Tenant(s) and Owner/Agent. Co-Signer waives their right to any notice of any such amendments, renewals, extensions, new Rental Agreements, Sublease Agreements, addendums, etc.
The liability of the Co-Signer is direct and unconditional and may be enforced without requiring Owner/Agent first to exercise, enforce or exhaust any rights or remedy against Tenant(s). Co-Signer waives presentment, demand, protest, and notice to which Co-signer might be entitled. If the Owner/Agent of the Premises delays or fails to exercise lease rights, pursue remedies, give notices, or make demands to Co-Signer, it will not be considered a waiver of the Owner/Agent’s rights against Co-Signer. All of the Owner/Agent’s remedies against the Tenant(s) apply to the Co-Signer as well. The Co-signer understands that the Tenant(s) may have additional Tenant(s) on the Rental Agreement and all Tenant(s) and Co-signer(s) are Jointly and Severally Liable for the full amount due to The Campus Lofts. If Tenant(s) subleases the premises, Co-signer(s) will remain liable under the terms of this agreement for the performance of the Sub-Tenant(s).
Co-Signer recognizes that Owner/Agent has agreed to lease to Tenant(s) because of this guarantee and that if the continued validity of this guarantee is no longer enforceable, for any reason, this shall be considered a material non-compliance with the Rental Agreement and Owner/Agent may terminate the Rental Agreement. Co-Signer agrees that any suit or action based on this Agreement may be brought in any state or federal court sitting in the county in which the property is located. Co-signer agrees to personal jurisdiction in such court. Co-signer agrees to pay all costs and attorney fees incurred by Owner/Agent in enforcing this Co-Signer Agreement and/or the Rental Agreement.
Owner/Agent recommends that the Co-Signer obtains a copy of the Rental Agreement and read it. This Co-Signer Agreement applies even if the Co-Signer does not do so. Owner/Agent will furnish Co-Signer a copy of the Rental Agreement upon written request.
If any clause of this Agreement is illegal, invalid or uneforceable under present or future laws effective during the term, then it is the intention of the parties hereto that the remainder of this Agreement shall not be affected thereby, and it is also the intention of the parties of this Agreement that in lieu of each clause or provision that is illegal or invalid or unenforceable, there will be added as a part of the Agrement a clause or provision similar in terms to such illegal, invalid or unenforceable clause or provision as may be possible and be legal, valid and enforceable.
Co-signer understands and agrees that the term "Tenant" and "Tenant(s)" means All Tenants on Lease Agreement (i.e., Tenant et al [and all others] on the Lease Agreement).
