1. Purchase.
E-Gift Cards may be purchased at www.gilt.com/egiftcards or by clicking here. In order to purchase an E-Gift Card you will need the following information, including but not limited to, recipient email address, recipient name, and a valid credit card. The value of an E-Gift Card will show up in the recipients' account as an account credit. The purchase of an E-Gift Card is non-refundable or cancellable.
2. Use.
In order to use an E-Gift Card the recipient must be a member of Gilt, Gilt Fuse or Gilt Man.
3. Priority of Credit Use.
When making a purchase with an E-Gift Card, the value of the purchase plus any shipping/handling fees and sales tax, if applicable, will be automatically deducted from your account credits. Priority of Credit Use shall be as follows: first, credits that have an expiration date (for example, referral credits), and second, credits that do not have an expiration date (for example, E-Gift Card). Within a specific class of credits, credits will be used according to their age (oldest being used first).
4. Referral Credits.
If purchaser buys an E-Gift Card for a non-member of Gilt, Gilt Fuse or Gilt Man, and the recipient then becomes a member of same, the purchaser will not receive any referral fee if the recipient's first purchase is of an E-Gift Card.
5. Cancellation and Expiration.
The purchaser of an E-Gift Card can cancel said purchase within the earlier of
(i) fifteen (15) minutes of said purchase or
(ii) delivery of an email confirmation of said purchase.
After delivery of an email confirmation of said purchase the E-Gift Card cannot be cancelled and the purchase is final and non-refundable. E-Gift Cards do not have an expiration date.
6. Limitations.
(i) E-Gift Cards may only be used on the Gilt, Gilt Fuse or Gilt Man websites, toward the purchase of eligible products. If a purchase exceeds the amount of the E-Gift Card, the balance must be paid with a credit card or other available payment method;
(ii) E-Gift Cards cannot be used to purchase other E-Gift Cards;
(iii) E-Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law.
(iv) Unused E-Gift Card account credits may not be transferred.
7. Policies.
E-Gift Cards and their use are subject to these terms and conditions as well as the terms and conditions and privacy policies located athttp://www.gilt.com/company/termsOfUse, http://www.gilt.com/company/privacy,http://www.giltman.com/company/termsOfUse,http://www.giltman.com/company/privacy,http://www.giltfuse.com/company/termsOfUse,http://www.giltfuse.com/company/privacy. Gilt Groupe may provide E-Gift Card purchasers with information about the redemption status of E-Gift Cards.
8. Risk of Loss.
Please safeguard your E-Gift Card. The risk of loss and title for E-Gift Card pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. If your E-Gift Card is lost or stolen, and you have proof of purchase, Gilt Groupe (in its sole discretion) may issue a replacement for the balance shown on its records. Gilt Groupe is not responsible if an E-Gift Card is lost, stolen, destroyed or used without your permission.
9. Limitation of Liability.
GILT GROUPE AND ITS SUBSIDIARIES AND AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO E-GIFT CARD, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT AN E-GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH E-GIFT CARD.
10. Modification.
Gilt Groupe reserves the right to make changes to these terms and conditions at any time. If Gilt Groupe makes a material modification to these terms and conditions, it will notify you by displaying a prominent announcement above the text of these terms and conditions, as appropriate, for thirty (30) days, and that will be deemed sufficient notification, of such changes. Should you wish to terminate your account due to a modification, you may do so by sending an email with the subject line "Termination" to the following email address: support@gilt.com. If you choose to continue using the website, you agree that by doing so you will be deemed to accept the new terms and conditions, as relevant.
11. General.
If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Headings are for reference purposes only and do not limit the scope or extent of such section. These terms and conditions and the relationship between you and Gilt Groupe will be governed by the laws of the State of New York without regard to its conflict of law provisions. You and Gilt Groupe agree to submit to the personal jurisdiction of the federal and state courts located in the State of New York with respect to any legal proceedings that may arise in connection with these terms and conditions. The failure of Gilt Groupe to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Gilt Groupe does not guarantee it will take action against all breaches of these terms and conditions.
