TERMS AND CONDITIONS
These terms and conditions ("Terms") govern the submission and participation of your artwork in the 3rd Saturdays in DTO exhibition organized by Holt x Palm (the "Organizer"). By submitting your artwork to the Exhibition, you agree to comply with these Terms and any additional guidelines provided by the Organizer.
1. Submission Eligibility: a. Artists of all skill levels, backgrounds, and ages are eligible to submit their artwork. b. Artwork must be original, created by the submitting artist, and not infringe upon any third-party rights.
2. Submission Process: a. Submissions must be made through the online submission form provided by the Organizer. b. Each artist may submit a maximum of 3 artworks. c. All submissions must include high-quality images of the artwork, along with relevant information as requested in the submission form.
3. Submission Deadline: a. The deadline for artwork submissions may vary and is typically required at minimum 7 days prior to the show date. b. Organizer reserves the right to accept or decline late submissions at thier discretion.
4. Selection Process: a. Artworks will be reviewed and selected by a panel of judges chosen by the Organizer. b. The decision of the judges is final and not subject to appeal. c. Selected artists will be notified by email.
5. Artwork Delivery: a. If your artwork is selected, you are responsible for delivering it to the designated Exhibition location, as specified by the Organizer. b. Artworks must be securely packaged to prevent damage during transportation. c. All transportation costs, insurance, and handling fees are the responsibility of the artist. Please note, we do not retain original packaging material.
6. Artwork Display: a. The Organizer reserves the right to display the selected artworks at their discretion. If multiple submissions are accepted, we reserve the right to display all of the submissions, a portion or none. We do not guarantee work will be displayed upon approval. b. The Organizer will not be held responsible for any damage, loss, or theft of the artwork during the Exhibition or any other time. c. Artworks must remain on display for the duration of the Exhibition.
7. Sales and Commission: a. Artwork will be available for sale during the Exhibition. b. The Organizer will facilitate the sale of artwork and retain a commission of 30% on each sale. Payments to artists will be processed within 7-10 business days of cleared funds. Organizer reserves the right to enter in negotations with a seller if needed and offer up to a 15% discount on art pieces without authorization from the artist.
8. Copyright and Usage Rights: a. Artists retain the copyright to their artwork. b. By submitting their artwork, artists grant the Organizer the right to use images of the artwork or the artist for promotional purposes in any form whether it be digital, social media, print, television or any other medium found appropriate by the Organizer and without any further permissions required in perpetuity.
9. Liability: a. The Organizer will take reasonable care to protect the artworks but will not be held liable for any loss, theft, or damage. b. Artists are encouraged to obtain their own insurance coverage for their artworks.
10. Withdrawal of Artworks: a. Artworks cannot be withdrawn from the Exhibition before its conclusion without the Organizer's prior written consent.
11. Artwork Pick-up: Typically, artists can pick up their artwork the week prior to the following event. We will email pick-up dates along with the approval email. Any artwork that has been left at the gallery for over 90 days after the pick-up date will be considered abandoned. The gallery is not obligated to notify artists or remind them of pick up dates or provide any notice of abandonement beyond this email. All artwork that is classified as abandoned may be donated, sold, or disposed of at the discretion of the gallery and without any further authorization from the artist.
11. Termination: a. The Organizer reserves the right to cancel or terminate the Exhibition for any reason.
12. Agreement: a. By submitting your artwork, you agree to abide by these Terms and any additional guidelines provided by the Organizer.
13. Governing Law: a. These Terms are governed by the laws of the state of California.
By submitting your artwork to the Exhibition, you acknowledge that you have read, understood, and agreed to these Terms. Failure to comply with these Terms may result in the removal of your artwork from the Exhibition. The Organizer reserves the right to amend these Terms as necessary and will notify artists of any changes.
