Non-Member Waiver for Tennis/ Swim clinics and or Lessons

The undersigned understands and agrees that while on the premises of Brookside Club of Saratoga (“Club”), whether using the tennis courts, the pool, the diving board, any equipment, participating in any classes, clinics, lessons, or social events offered by the Club, making general use of the facilities (including walking tours of the premises), or simply being present on the premises, he or she is doing so at his or her own risk. If the undersigned is accompanied by a minor child or children on the premises, that adult guest is required to supervise that child or children the entire time while on the premises, even when that child or children is/are taking a class of any kind. The undersigned will assume all the risk for the minor child(ren) while on Club premises when either engaged in any particular activity or simply being present on the premises. The undersigned understands that the Club shall not be liable for any damages arising from personal injuries or property damage sustained in, on, or about the premises of the Club, specifically including, but not limited to, all club facilities (indoors and outside), the pool area, locker rooms, tennis courts, all recreation areas, all exercise areas, kitchen, and parking lots. The undersigned assumes full responsibility for any injuries or damages which may occur to him/her or minor children accompanied by him/her while on the Club's premises, regardless of whether such injuries or damages are caused by the negligence of the Club or any of its employees or agents, and the undersigned expressly agrees, on his/her own behalf and on the behalf of the minor child(ren) accompanied by him/her, to fully and forever release and discharge the Club, its Board of Directors, employees, assigns, and agents from any action or cause of
action arising out of the undersigned’s presence upon or use of the Club's facilities.

I/we hereby release Brookside Club of Saratoga, and its employees from all responsibility or liability of any nature whatsoever for any damages, injuries, or other losses that I/we or she may incur while participating in this activity.
The undersigned also expressly acknowledges that by submitting below he or she is relinquishing all rights he or she may have to sue Brookside Club of Saratoga for injuries arising out of the use of the Club’s facilities or its services. This release is intended to be interpreted as broadly as allowed under California law.
