Waiver of Liability & Informed Consent Release
Between Canada Foundation 13152031 (o/a Sispack Kennels & K9) “Released Party”/”Trainer” and “The Releasing Party”/ “Client.”
I understand my involvement with Sispack Kennels & K9 is not without risk to
myself, members of my family, or animals in my care and assume any and all risks associated with the engagement in dog training classes, private consultations, boarding, walking, daycare or other related
services offered by Sispack Kennels & K9.
I agree that I have provided Sispack Kennels & K9 with the most up to date and
accurate information including but not limited to the; medical, temperament and legal involvement of my animal(s). I understand that failure to do so may result in and is not limited to; the termination of services without refund or legal action.
I understand that all dogs participating in services rendered by Sispack Kennels & K9 must be free of any infectious disease and must be current on all appropriate vaccinations and receiving monthly prevention for the treatment of fleas and ticks.
I grant permission to Sispack Kennels & K9 to use my animal(s) photograph(s) and/or
video(s) taken during the time of services for educational and promotional purposes in any type of media.
I understand that Sispack Kennels & K9 cannot guarantee any animal’s temperament or health. Despite health screenings, the possibility exists that an animal could be harboring illness or parasites that could be transmitted to other pets.
I understand that Sispack Kennels & K9 does not make any guarantees in relation to
the temperament or results of their services.
I understand that there will be no refund after the initiation of services provided by Sispack Kennels & K9.
I understand that Sispack Kennels & K9 is not responsible for any missed appointments/classes as the result of the client. In the event of a schedule change on behalf of Sispack Kennels & K9, a make-up class or service will be rescheduled at no additional cost to the client.
I agree to abide by any training methods or rules Sispack Kennels & K9 has deemed
necessary for the animal enrolled in their services. I acknowledge that failure in doing so will result in the termination of services without refund of any/all payment.
I agree and am aware that I will be held financially and legally responsible as the result of any harm done by or inflicted by the animal(s) in my care.
I grant permission to Sispack Kennels & K9 to act on behalf in the event of a medical
emergency in the event I am unavailable or unable to be contacted. I agree to assume any financial liability as a result.
I expressly release Sispack Kennels & K9 from any liability and any damages arising out
of this Boarding/Training agreement.
I, the Client and releasing party and the undersigned, have engaged myself and my dog in dog training classes, private consultations, boarding, walking, daycare or other related services offered by Sispack Kennels & K9, The Released Party.
By signing hereunder, I certify that I have been informed and understand that there is always some unavoidable risk of injury involved when working with animals. I acknowledge that there remains a possibility of injury to myself, my dog, my family members, or third parties. Additionally, I have had the full opportunity to discuss all concerns I have about the foregoing risks with Sispack Kennels & K9 and it authorized representatives. I have also made all inquires and investigations to my
satisfaction related to such risks, including but not limited to, an examination of the training, play, and boarding area. I hereby accept and assume, without reservation, all risks associated with my participation in classes, boarding, walking or any other business activities conducted by Sispack Kennels & K9 including, but not limited to: the risks of any and all injuries to myself, my dog and
any of my family members or third parties who may attend; the risks that my dog may cause injury to other persons and/or dogs while boarding/training.
As lawful consideration for participating in services rendered by Sispack Kennels & K9, I, for myself, my heirs, executors, administrators, legal representatives, successors and assigns hereby waive, release, discharge Sispack Kennels & K9, for any and all damages, losses, claims, or hardships to any person or persons, including claims arising from the Release Party’s own negligence, and all costs associated therewith, including attorney fees, court costs and consultant fees, arising from my participation in any and all services offered by Sispack Kennels & K9 The Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Should the Releasing Party assert a claim to the contrary to what has been agreed to in this Waiver
of Liability and Informed Consent Release, the claiming party shall be for all expenses (including attorney’s fees, court costs and consultant fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and Releasing Party. Every provision herein is intended to be severable. If anyone or more of the provisions found to be unenforceable or invalid,
that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable.
