The following sets forth the terms and conditions of this {contractName} between you, {client_name} hereinafter “Client(s)”, and Artist(s), {sp_name} {sp_company}, hereinafter “Artist(s)” for performance of {contractType} on the contracted date and time. This {contractName} sets forth the general terms and conditions of {contractType} contracted by Client(s) and executed by Artist(s).
ARTIST(S) OBLIGATIONS
ARTIST(s) agree to: Provide Client(s) with the clearly outlined proposal above which includes and is not limited to: Client(s) name and service location, and type of service(s).Arrive at all scheduled appointments on time.Dress appropriately for the nature and location of the event.Provide the agreed upon service(s) for 45 - 60 minutes each, depending on complexity, unexpected interruptions, creative license, and comfort. The service(s) does not include staying for touch ups, however this service is always available.Provide all necessary tools and products to complete professional, high end styles.Provide properly sanitized equipment and tools.Force Majeure: Cancellation and release of liability from this contract and any and all its clauses. Including but not limited to: outbreaks, epidemics, pandemics, in addition to other standard force majeure events, fire, flood, act of God, war, governmental action, act of terrorism, natural disaster. *A non-refundable, transferable deposit of the deposit fee and signature of the contract is required to secure the desired date. Remittance of the non-refundable, transferable deposit indicates agreement to all contract terms.*Force Majeure provision: the deposit is transferable up to 24 months in the event of rescheduling due to Force Majeure.
CLIENT OBLIGATIONS
CLIENT(S) AGREE TO: Provide Artist(s) with all information needed by the Artist(s) to successfully perform duties agreed upon in contract including but not limited to Client(s) name, address, phone, payment, allergies, sensitivities, or any other health related issue that may impact service procedures.Arrive for his/her appointment(s) on time, and ensure any party receiving a service on the contracted date will also arrive on time. Client(s) will notify Artist(s) if he/she or any party involved will be delayed for any appointment.A getting ready window of time, with the start and ready times as determined by Artist(s) with input from Client(s).PARKING: Any costs associated with parking are the responsibility of Client(s), including but not limited to: hotel valet, off site public paid parking, and/or off site private estate third party valet services. Parking that is off site of the getting ready location will be subject to an additional travel fee of $50. Off site is defined as 400 or more yards from the main entrance of the getting ready location address.
RELEASE OF LIABILITY & WAIVER
I, the Client(s), hereby certify that I have divulged and made known to Artist(s), prior to service, any and all known allergies and/or sensitivities to any cosmetic and/or food ingredient or substance, natural or man-made. I, the Client(s), have also made known to Artist(s) any beauty or health procedure that I may have had that may impact the nature of the service Artist(s) is to provide. I, the Client(s), hereby release and agree to hold Artist(s) harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the Artist(s), or that may otherwise arise in any way in connection with any services received from Artist(s). I understand that this release discharges Artist(s) from any liability or claim that I, my heirs, or any personal representatives may have against the Artist(s) with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from the Artist(s). This consent and liability release extends to Artist(s) and any associates of said Artist(s).All products used are hypoallergenic. Any allergies and/or skin conditions or illness that could cause harm during the application or styling process that could risk the health of the Artist(s) and/or Client(s) and/or any associates of the Artist(s) must be reported by the Client(s) to the Artist(s) prior to application or styling and, if need be, a sample test of products may be performed on the skin and or hair to test reaction.Client(s) agree to release Artist(s) and any associates from liability for any skin complications, allergic reactions or illness caused from or due to product application, techniques or services provided.The Client(s) agree to release Artist(s) and any associates from liability for any damages accidentally caused during the service to personal property or belongings of the client.
SOCIAL MEDIA
Client(s) may be photographed before and after service. By virtue of the inclusion in this contract, Client(s) agree that photographs he/she are in could be used in any of the following ways, including but not limited to: Facebook - (if the post from the business page is shared), Instagram, business website, portfolio reproductions/marketing pieces, business cards. Social media clause includes any and all contractors signed through Artist(s). If Client(s) do not agree to have his/her image used in any of the above capacities, please note when signing the contract so the artist can be prepared to accommodate his/her comfort.
DELIGHT
Client(s) will be asked if there is anything about the customized and finished styling that he/she would like to change. Artist(s) thrives on accentuating each person’s styles, personality, and comfort level. Styling will be determined with Client(s) while we casually and warmly discuss his/her vision and ideas. Personality and personal style is always taken into account as well. It is strongly encouraged to answer these questions honestly and openly to allow Artist(s) to deliver exceptional service.
UNDERSTANDING & ELECTRONIC SIGNATURE CONSENT
I, the Client(s), have read and fully understand this agreement and all information detailed above. I, the Client(s) understand the service and accept the risks. All of my questions have been answered to my satisfaction and I consent to the terms of this agreement. I, the Client(s) have read this contract describing Artist(s) services and agree that it reflects the discussion I had with Artist(s) and my intention to participate in full in this arrangement. I, the Client(s) understand that life & business are unpredictable and will not hold Artist(s) liable regardless of the outcome. By agreeing here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By your Approval and signature here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary. It is strongly encouraged to answer these questions honestly and openly to allow Artist(s) to deliver the exceptional service and finished application of her reputation.
