Royal Stixx Baseball Academy, LLC

The Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Royal Stixx Baseball Academy has put in place preventative measures to reduce the spread of COVID-19 and other diseases, as outlined above; however, Royal Stixx Baseball Academy cannot guarantee that Participants will not become infected with COVID-19 or other diseases. Further, attending SwingCity Sports lessons and events could increase Participants' risk of contracting COVID-19 or other diseases.

By signing this Agreement, I acknowledge the contagious nature of COVID-19 and other diseases and voluntarily assume the risk that Participants and Spectators may be exposed to or infected by COVID-19 or other diseases by attending Royal Stixx Baseball Academy lessons and events and such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 or other diseases at Royal Stixx Baseball Academy lessons and events may result from the actions, omissions, or negligence of myself and others, including, but not limited to Royal Stixx Baseball Academy instructors, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to Participants (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or Child Participant may experience or incur in connection with my or Child Participant's attendance at Royal Stixx Baseball Academy events or participation in Royal Stixx Baseball Academy programming ("Claims"). On my behalf, and on behalf of Child Participant and my significant other, I hereby release, covenant not to sue, discharge, and hold harmless Royal Stixx Baseball Academy LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Royal Stixx Baseball Academy and its employees, volunteers, officers, directors, agents, contractors, insurers, representatives, affiliates, partners, successors and assigns whether a COVID-19 or other infection occurs before, during, or after participation in any Royal Stixx Baseball Academy lessons or events.

I hereby waive and release Royal Stixx Baseball Academy from any and all liability for any injury or illness incurred throughout the duration of any Baseball & Softball season, facility rental, individual/group lesson, camp, clinic or program.

I have no knowledge of any physical impairment that would affect my/my child’s participation in any and all aspects of participation included at Royal Stixx Baseball Academy.

I expressly agree to release and discharge Royal Stixx Baseball Academy and all affiliates, employees, representatives, successors or assigns, from any and all claims or causes of action.

This waiver and release of liabilities, without limitation, covers all injuries to me/my child which may occur. Regardless of negligence, as a result of (a) my/my child's use of any and all Royal Stixx Baseball Academy’s equipment, products and amenities, (b) the sudden unforeseen malfunctioning of any equipment, (c) our instruction or supervision, and (d) me/my child slipping and/or falling while in Royal Stixx Baseball Academy, or on Royal Stixx Baseball Academy’s premises, including adjacent sidewalks and parking areas.

I acknowledge that I have carefully read this waiver and release and fully understand that is a release of liability.

I agree to voluntarily give up the right that I may otherwise have to bring a legal action against Royal Stixx Baseball Academy for negligence, or any other personal injury or property damage of loss action.
