  • All travel involves inherent risks, and it is crucial for our clients to comprehend their responsibilities in relation to this. When a reservation is made, an agreement is entered into between you, MMV by Vanessa and other service providers responsible for your Vacation/Tour/Group package. If you are booking for others in your travel party, you are accepting the following terms on their behalf and are responsible for ensuring their awareness and acceptance of the terms prior to booking. All reservations are subject to the following Terms and Conditions:

    SUPPLIER
    I understand that MMV by Vanessa and its employees are not the source or supplier of the travel services I have requested, and act solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold MMV by Vanessa and its employees responsible should any of these suppliers:

    1. fail to provide the travel services I have purchased

    2. fail to comply with any applicable law

    3. engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

    DOCUMENT ACCURACY
    I agree I will review my travel documents for accuracy upon receipt and understand that I may contact MMV by Vanessa, within 24 hours, if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money. Conversely, cancellation of any aspect of my travel arrangements may result in financial penalties, in accordance with the supplier’s cancellation policies.

    TRAVEL DOCUMENTS
    Travel documents must be presented when required by the service provider. Failure to present the appropriate voucher(s) could results in a service provider declining to honor the reservation. Should this happen, MMV by Vanessa and its employees are not responsible for any additional costs or loss of payments encountered. I understand I bound by each supplier's individual Terms and Conditions. I understand that fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.  Conversely, cancellation of any aspect of my travel arrangements may result in financial penalties, in accordance with the supplier’s cancellation policies. I have been advised to use a form of payment other than cash or check that may offer me the opportunity to dispute the charge should a vendor cease operating.

    ​DOCUMENTATION/PROOF OF CITIZENSHIP
    I understand it is the responsibility of each traveler to ensure they have the required documents for entry to the destination. For travelers under the age of 18, I will ensure a responsible adult has ensured the required documents for entry to the destination. In the event that I am denied entry for any reason, I understand no refund for unused services will be considered.  I understand that a passport must have a validity date of at least 6 months after my return date and names on airline tickets must appear exactly as shown on passport. 

    ​PRIVACY NOTICE
    Privacy Notice (TSA Update: August 13, 2009):  The Transportation Security Administration (TSA) requires you to provide your full name, date of birth, and gender for the purpose of watch list screening, under the authority of 49 U.S.C section 114, the Intelligence reform and Terrorism prevention Act of 2004 and 49 C.F.F parts 1540 and 1560.  You may also provide your Redress Number, if available.  Failure to provide your full name, date of birth and gender may result in denial of transport or denial of authority to enter the boarding area.  TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice.  For more on TSA privacy policies, or to review the system of records notice and the privacy impact assessment, please see the TSA website at www.tsa.gov.

    ​I understand that the Transportation Security Administration requires me to carry a government issued identification card in order to board a flight.  I have been advised that the name, date of birth and gender that appears on my identification card must exactly match the same such data that is listed on my airline ticket and in my booking records.  I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.

    MMV by Vanessa is not responsible for the issuance of travel identification such as passports and/or visas and travelers should ensure they have or have been approved for the appropriate documents before purchasing travel.

    ​​NOTE: Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov. Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements.  To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov.

  • RESERVATION & PAYMENTS
    Payment terms fluctuate based on supplier/group package. Deposit and Full payment terms are outlined on your invoice/contract. All payments must be made by credit or debit card. There is no fee to pay via credit card or gift cards unless required by the travel supplier. 

    Pricing and availability is subject to change until a deposit is made and processed by the travel supplier. Depending on the supplier and travel dates, full payment may be required at time of booking. Travel documents will be emailed or mailed after receipt of final payment and when received by the supplier. Group reservations and certain tours/packages may have different payment due dates, date change fees and cancellation fees. Prices and itineraries for group tours are secured upon receipt of signed contract and deposit. In the event that the balance is not paid by the due date, MMV by Vanessa reserves the right to cancel the reservation and a cancellation fee will be applicable. 

    SUPPLIER IMPOSED PRICE INCREASES
    I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by MMV by Vanessa to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize MMV by Vanessa to charge payment for such additional amounts after I have been notified of pricing change.

    ​CANCELLATION FEES
    In the event that you must cancel your reservation prior to departure, cancellation fees will be per those stated on the contract/itinerary/invoice.

    ​CREDIT CARDS
    My authorization to use my credit/debit card number for payment indicates my agreement with these booking Terms and Conditions.

    In the context of travel agency services, "chargeback" refers to the process where a customer disputes a charge on their credit card statement, and the funds are reversed. Here are terms and conditions related to chargebacks for travel agent services:

    I agree to make payments for travel services as per the agreed-upon terms.
    In the event of a chargeback initiated by myself (or a traveler I represent) without valid reason, the travel agency reserves the right to take appropriate action to recover the disputed amount.

    MMV by Vanessa encourages clients to address any concerns or disputes directly with the travel agency before initiating a chargeback.
    The travel agency is committed to resolving issues promptly and professionally.

    Chargebacks initiated for valid reasons, such as unauthorized transactions or fraudulent activities, will be addressed in accordance with applicable laws and regulations.

    I understand that should I determine a chargeback is necessary, I am responsible for providing accurate information and ensuring that any dispute or chargeback request is based on legitimate reasons/.

    I agree to communicate with the MMV by Vanessa and provide necessary information during any chargeback investigation.

    MMV by Vanessa may impose reasonable fees or penalties for chargebacks initiated without valid grounds.

    I agree to provide any required documentation or evidence related to the chargeback to facilitate a fair and timely resolution. By engaging in travel services with MMV by Vanessa, I agree to these terms and conditions related to chargebacks. These terms are designed to ensure fair and transparent processes in the event of payment disputes.

  • INJURY, DAMAGE, OR LOSS
    I accept that MMV by Vanessa and its employees are not responsible for, nor will I attempt to hold either of them liable for any injury, damage or loss I may suffer on the account of any conditions, actions or omissions that are beyond reasonable control. I agree that this disclaimer includes the entire traveling party and that in the event of any disputes; they may only be litigated in the state of Florida, Osceola County, with a maximum penalty not to exceed the total earned by MMV by Vanessa and its employees in the original transaction.

    RESPONSIBILITY
    Clients are responsible for ensuring they meet entry requirements, possess necessary documents, and adhere to local laws and customs. MMV by Vanessa and its employees are not able to provide travel or legal advice concerning previous or ongoing legal concerns of a travel party member and entry requirements of any country. MMV by Vanessa is not liable for the loss of any payments due to a client's inability to meet entry requirements.

    HEALTH AND SAFETY
    Clients are responsible for assessing their health and suitability for travel. Vaccinations and health precautions are the traveler's responsibility.

    FOREIGN GOVERNMENTS
    I agree that foreign governments may change or amend their entrance requirements at any time, and may impose health, medical or quarantine requirements at any time, and it is my responsibility to understand those requirements and any changes to them. I hereby hold harmless Mystical Memories Vacations for any and all damages that I may incur as a result of governmental actions that may interfere with my travels.

    I agree that travel suppliers may impose medical, health or other safety requirements or restrictions at any time, and it is my responsibility to understand those requirements and any changes to them. I hereby hold harmless Mystical Memories Vacations for any and all damages that I may incur as a result of supplier requirements that may interfere with my travels.”

    FORCE MAJEURE
    MMV by Vanessa is not liable for changes, cancellations, or disruptions caused by unforeseen events or circumstances beyond their control.

  • CONDUCT OF TRAVELERS
    All travelers in your party are expected to conduct themselves in a manner that does not disrupt the enjoyment of others during the vacation.

    Should any person's actions or implied actions result in the cancellation of their vacation or removal from transportation or property, MMV by Vanessa and the travel supplier are not responsible for any fees incurred or money lost.

    A loss in the ability to complete the vacation due to actions disrupting the enjoyment of others will result in the loss of all money paid. Additionally, it may result in additional fees, fines, or travel costs, which are wholly the responsibility of the travelers involved.

    MMV by Vanessa is not liable for any traveler's actions while traveling. The company will not act as a representative or liaison for either the traveler or the supplier in the event of disruptions due to traveler behavior.

    AIR TRANSPORTATION
    MMV by Vanessa is not responsible for unforeseen flight delays or schedule changes imposed by an airline. Air schedules may be subject to change at the discretion of the airline. Any cancellations or changes to airlines reservations are subject to any cancellation penalties imposed by the airline. 

    ​LOST/DAMAGED BAGGAGE
    Lost/damaged baggage is the responsibility of the supplier/airline and not MMV by Vanessa.

    ​EXCESS BAGGAGE CHARGES
    MMV by Vanessa is not responsible for excess baggage charges.

    TYPOGRAPHICAL ERRORS
    In the event of a typographical error, MMV by Vanessa reserves the right to re-price or change any quote or reservation with or without notice.

    UNUSED SERVICES
    I understand unused services are non-refundable and non-transferable.

    ​TRAVEL INSURANCE

    Travel insurance covering risks inherent in travel, such as supplier bankruptcy, trip interruption, and medical or personal emergencies, has been offered for purchase. The purchase of medical and trip cancellation/interruption insurance is strongly recommended and is available to add to my travel package prior to travel.

    Insurance providers and suppliers may have specific timeframes, criteria or requirements associated with the purchase of insurance. MMV by Vanessa does not have the ability to chage or override these requirements. Agents, employees, and representatives of MMV by Vanessa are not licensed insurance agents. It is my responsibility to understand the insurance policy. Any detailed questions regarding insurance should be directed to the insurance or travel supplier.

    If I choose not to purchase travel insurance or decide to purchase it independently (not through MMV by Vanessa), I understand I must confirm or decline insurance in writing to MMV by Vanessa. Confirmation or declination can be communicated via agency forms, email, or other written correspondence.

    By engaging in travel arrangements with MMV by Vanessa, I acknowledge and understand the importance of travel insurance and the need to confirm or decline coverage in writing. I understand it is essential to review and comprehend the terms of any insurance policy to ensure appropriate coverage for my travel needs.

    ​TRAVEL SERVICE REQUESTS
    Hotel preferences such as bedding, room location or configuration, and amenities, are on a request basis only. MMV by Vanessa does not guarantee the fulfillment of any requests.

    ​CONSTRUCTION/RESTORATION/RECOVERY
    MMV by Vanessa is not responsible for any inconvenience arising from hotel or accommodation construction, restoration, or property recovery.

    ​WEBSITE AND BROCHURE ACCURACY

    MMV by Vanessa is not responsible for factors beyond their control that may alter accommodations, trains, flights, or activities purchased for my travel.

    All photographs featured in brochures and/or on the website are purely representational. They do not guarantee that everything will be exactly as depicted upon arrival at my destination.

    By engaging in travel arrangements with MMV by Vanessa, I understand and accept that certain aspects of my travel experience may be subject to factors beyond MMV by Vanessa's control, and that representational photographs serve as visual indications rather than absolute guarantees. 

    ​ACT OF GOD
    MMV by Vanessa and/or its suppliers does not and cannot assume liability for any loss, damage or injury resulting from an Act of God or any other greater force.

    MMV BY VANESSA'S RESPONSIBILITY
    The liability of MMV by Vanessa, agents and affiliates (collectively "indemnified Parties") for any loss, damage, or injury of any nature or kind whatsoever, arising out of its own acts, omissions or negligence, is limited to the amount paid for the vacation package. Except as set out above, MMV by Vanessa will not be liable for any loss, damage or injury of any kind whatsoever to person or property. MMV by Vanessa is not liable for any third-party omissions. 

  • CLAIMS
    Any claims against MMV by Vanessa must be made in writing.
    Claims must be received by MMV by Vanessa no later than 30 days after the event causing the claim. Claims made after the 30-day period will not be responded to or considered.

    I agree that this claims procedure applies to my entire traveling party.
    I understand it is important to adhere to the specified claims procedure to ensure timely and effective handling of any concerns or issues related to my travel experience with MMV by Vanessa. I understand it is my responsibility to communicate this agreement to all members of my traveling party.

    ​DISPUTE RESOLUTION
    The exclusive venue for all claims, actions or proceedings against MMV by Vanessa arising out of this contract shall be in Osceola County, Florida and such claims, actions or proceedings shall be determined according to the laws of Florida with a maximum penalty not to exceed the total earned by MMV by Vanessa and its representatives, in the original transaction. 

    ​SEVERABILITY
    The invalidity of any provision contained here in shall not affect the validity of any other provision. My reservation deposit indicates acceptance of the above Terms and Conditions and limits on responsibility.

    ​LIABILITY LIMITATION
    MMV by Vanessa, acts only as agent for Client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the Client's benefit, and on the express condition that MMV by Vanessa shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection there with. MMV by Vanessa, shall not be liable for any injuries or any damage to any client/traveler or be subject to any claim, demand, injury, or damages, whatsoever, including without limitation, those damages from acts of passive or active negligence on the part of MMV by Vanessa, its officers or agents. I hereby expressly release and discharge MMV by Vanessa from all such claims, demands, injuries, damages, actions or causes of action. I acknowledge that I have carefully read this paragraph and fully understands that this is a waiver and release of liability.

  • I agree to the MMV by Vanessa Terms and Conditions. I understand payment of a deposit or payment towards a vacation with MMV by Vanessa confirms agreement with the terms detailed within this document.

    I understand it is my responsibility to communicate these terms to all members of my travel party to ensure a smooth and enjoyable vacation experience for everyone involved.  

    I further acknowledge that I have been offered travel insurance to protect my investment. My agreement represents the acceptance of these terms for myself and as a representative of all within my travel party.
