TERMS & CONDITIONS AGREEMENT:
Dentist/Employer Placement Agreement (Revised April 1, 2024)
1. Daily Dental Solutions, inc., is a Temporary and Permanent Placement Service. The Daily Dental Solutions, inc., Temporaries (DDS, inc. Temporary) are not employees of Daily Dental Solutions, inc., nor are they treated as employees for the purposes of taxes, workman’s compensation, or insurance coverage. Accordingly, Daily Dental Solutions, inc., is not liable for damages, directly or indirectly, which may result from the failure of any temporary to report to work as scheduled, or for the acts or omissions of a temporary placement during the performance of their duties including but not limited to any act or omission constituting or raising the issue of malpractice on the part of the hygienist or other said temporary placed. Daily Dental Solutions, inc., as well as the DDS, inc. Temporary are not responsible to any damage of instruments, equipment, etc. related to placement of any said Temporary. Please contact Daily Dental Solutions, inc., immediately if any problems arise.
2. Temporaries for Daily Dental Solutions, inc., are to be paid directly by the dentist/employer. The dentist/employer needs to provide Daily Dental Solutions, inc. pay dates & how the DDS, inc. Temporary is to be paid before any assignment is covered by Daily Dental Solutions, inc. The dentist/employer will determine if the DDS, inc. Temporary will be paid as an employee or independent contractor. The dentist/employer is to notify Daily Dental Solutions, inc. before an assignment if other arrangements need to be made for payment to the Temporary and when the DDS, inc. Temporary can expect payment. If payment information changes Daily Dental Solutions, inc. is to be notified immediately.
3. DDS, inc. Temporaries are independently contracting through Daily Dental Solutions, inc., for temporary or permanent placement services only and are solely responsible for their schedules, transportation, vehicular insurance, licenses, permits, or any other insurance necessary for the fulfillment of their duties including but not limited to malpractice insurance.
4. Daily Dental Solutions, inc., is not responsible or liable for any damages suffered should the dentist/employer fail to comply with applicable state laws and regulations.
5. Daily Dental Solutions, inc., is not responsible or liable for any damages suffered by any Temporary who fails to comply with applicable state laws and regulations. The DDS, inc. Temporary is not an employee of Daily Dental Solutions, inc., and is responsible and liable for self. Daily Dental Solutions, inc., does not promote, endorse or condone any acts by any Temporary to practice outside the scope of practice set forth by the State Board of Dentistry. Daily Dental Solutions, inc., advises all Temporaries to strictly stay within all guidelines set forth by all state laws & regulations. When Temporaries are placed in a dental office they are under the supervision of the dentist for that day, and must stay within the State Dental Act, as well as any Rules &/or Regulations set by the State Dental Board. DDS, inc. Temporaries are to stay within the scope of their ability to practice at all times.
6. Cancellation Policy: is as such, Once a Temporary has been requested to work in your office a 24-hour business day cancellation is required by phone; any online cancellations require a minimum of a 48-hour business day notice prior to the date of the assignment by 10 am Central Standard Time (CST). You are required to call our office to cancel to any assignment within 24-hour business day of the assignment. Anything less than 24-hour business day notice by phone and dentist/employer will be responsible for paying the DDS, inc. Temporary the 5hour minimum and the Temporary Placement fee to Daily Dental Solutions, inc. Online cancellations require 48-business hours or you will be responsible for paying the Temporary the 5 hour minimum & all fees due to Daily Dental Solutions, inc. When cancelling an assignment(s) you are required to provide specific dates to be cancelled and the dates will be provided on the Cancellation Form. Fees will be based on the current Temporary and Permanent Placement Fee Schedule. We close Fridays at 12 pm all cancellations for Monday (or the next business day) must be received by phone no later than 10 am CST on Friday. No Exceptions. If your office has requested a DDS, inc. Temporary for an assignment we are working on it. All assignments are worked on until covered, all avenues have been exhausted, or you have cancelled the request. If you are no longer in need of temporary coverage your office is responsible for cancelling the request by 10 am the business day before. Any assignment that is covered and has not been cancelled by 10 am the business day before will be responsible for the Temporary Placement Fee and the 5 hour minimum will be due to the DDS, inc. Temporary. Any assignments called in & requested with less than a 24 hour notice are short notice. For Short Notice Requests all fees will apply (including the Short Notice Placement fee as well as the 5 hour minimum to the DDS, inc. Temporary). The 10 am cancellation notice the business day before does not apply to Short Notice Requests. You will be responsible for all applicable fees for any Short Notice Requests where we have less than a 24 hour business day notice. We are closed weekends and all major holidays (New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day & the day after, Christmas Eve, Christmas Day).
7. Placement Fees are subject to change at any time. You will be notified should any changes be made that would directly affect any placement you already have scheduled. If you do not have the current fee schedule Daily Dental Solutions, inc., will provide you with a fee schedule upon request.
8. All DDS, inc. Temporaries are placed in your office with confidence. Once a DDS, inc., Temporary has been scheduled for your office, all requests for scheduling &/or cancelling of a DDS, inc., Temporary must be made through Daily Dental Solutions, inc. Do not solicit any DDS, inc., Temporary for additional days, cancelling assignments, or for contacts of other Temporaries or individuals looking for temporary and/or permanent employment. Do not ask the DDS, inc. Temporary for personal email or phone numbers. It is agreed that if you, or any of your employees/associates, hire a DDS, inc., Temporary for additional work (within 1 year (365 days) of last temporary placement by Daily Dental Solutions, inc.), regardless of whether the said Temporary is working as an employee, independent contractor, or through another staffing/employment/temporary service, you will be responsible for payment of the Daily Dental Solutions, inc. Temporary placement fees for each day worked by the Temporary or the full permanent placement fee. Permanent Fees are due upon receipt. As a courtesy to dental offices in good standing we will accept payment arrangements where fees are paid at 30, 60, 90, 120, 150, and 180 days.
9. It is agreed that you and your employees are not to refer any DDS, inc., Temporaries to any other dentists or dental offices for temporary or permanent placement within 1 year (365 days) of the Temporary’s last scheduled placement day. It is agreed if you or any dentist office in your directive hires a Daily Dental Solutions, inc., Temporary for temporary or permanent placement, you will be responsible to pay the Temporary or Permanent Placement fee according to the current Daily Dental Solutions, inc., Placement fee schedule. The DDS, inc. Temporary must no longer be an active Temporary with us or all fees apply.
10. Daily Dental Solutions, inc., places Temporaries with you in confidence and trust. Should you choose to refer or identify said Temporary to another dentist/employer who hires the Temporary on a permanent or temporary basis, you will be responsible for the payment of the appropriate fees.
11. Please notify Daily Dental Solutions, inc., immediately if you have any concerns regarding a DDS, inc. Temporary. We want to address any problems/issues/concerns that arise immediately.
12. Temporary Placement fees will be invoiced each month for each day of placement in an office. Temporary fees will be charged for each Temporary placed in an office, regardless of who is placed. As a courtesy to dental offices in good standing the Permanent Placement fees are invoiced at 30, 60, 90, 120, 150, 180 days of employment. However, any offices hiring a DDS, inc. Temporary without the express knowledge of Daily Dental Solutions, inc. the permanent placement fee will be due immediately, due in full, and no payment arrangements will be made, regardless of the number of days worked. All invoices are due upon receipt. All accounts that exceed 20 days without payment will be charged a $75 late fee charge per month or 9.99% interest whichever is greater. If at anytime said account is turned over for collections you will be responsible for any/all fees charged by Daily Dental Solutions, inc., in addition to any/all additional charges for collections. In addition, all billing disputes must be made in writing and must be received by Daily Dental Solutions, inc., within fifteen (15) days of the invoice date, otherwise all invoices shall be considered valid.
13. DDS, inc. Temporaries are to be treated with professionalism and respect at all times by you, any and all employees, including any Dentist(s), of any dental offices they are placed in.
14. All returned checks for payment of services will be charged a return check fee. This fee is currently set at $75 per check. We are located in Oklahoma and will only accept payment in the form of checks in the state of Oklahoma. Any dental offices outside of the State of Oklahoma must pay online, and have a credit card on file with Daily Dental Solutions, inc.
15. Should the event arise that it becomes necessary for Daily Dental Solutions, inc., to obtain the services of an attorney, collection agency or filing small claims affidavits to collect any sums arising out of the relationship between Daily Dental Solutions, inc. and you, the client, will be responsible for all expenses incurred. This includes any and all: attorney fees and costs, court related fees and costs, and/or collection fees and costs, regardless of whether or not the matter is resolved in or out of court, with or without litigation. You, the client will be responsible for collection costs incurred by Daily Dental Solutions, inc., in connection with accounts over 20 days past due.
By signing below, you agree to all terms and conditions set forth within this agreement. This agreement must be signed by Dentist or in Clinical or Corporate Dentistry signed by CEO, COO or President, as well as, resident/supervising Dentist. Please return both pages of agreement.
