  • This Agreement is between Click n Smile and {nameclient}{companyName} (hereinafter “Client”).

    PAYMENT: Client agrees to pay the refundable deposit upon signing the contract in order to officially reserve this date, along with any remaining fee, at least 2 weeks before the event day. Failure of Client to pay will result in a breach of this Agreement (and forfeiture of all deposits paid) and will release Click n Smile of all obligations in connection with this Agreement.

    OVERTIME: The rate for coverage beyond agreed hours is $100.00 per hour.

    OPERATION REQUIREMENTS: Client acknowledges Click n Smile must have access to the event space at least one to two hours prior to the rental service start time. Client will arrange for an appropriate space for the photo booth at event's venue. (8' deep x 8' wide x 8' high) space must be level and solid. The Photo Booth may be placed in an exterior location provided it is protected from weather. Client will ensure that a table for guest print-outs/digital sharing, and one standard, three-prong outlet (110V, 10 amps 3 prong) will be made available to {{brand.name}} on the day of the event. Client is responsible for providing power for the Photo Booth. Client agrees Click n Smile will not be held liable for any lack of service due to client’s failure to provide these minimal requirements.

    EQUIPMENT DAMAGE: Client will not be reimbursed for rental time lost due to willful or accidental damages to equipment inflicted by client or guests. Should client or any guest be physically or verbally violent towards Click n Smile staff or equipment, Click n Smile holds the right to end the rental service early with no compensation for lost rental time to client. Client acknowledges that it shall be responsible for any damage or loss to Click n Smile equipment caused by any misuse of the Photo Booth equipment by client or clients guests.

    REFUSAL/DISRUPTION OF SERVICE: We are not the “fun police”, but in some very rare occurrences we reserve the right to immediately refuse service, pack up, and depart from the venue. Service will be disrupted without a refund if the attendants are harassed, threatened, or abused by any guests or the equipment is damaged by the guests.

    LIMITATION OF LIABILITY: While every reasonable effort will be made to produce and deliver an outstanding service, Click n Smile entire liability to Client for any breach of this Agreement, claim, loss, or injury arising from Click n Smile performance is limited to a refund to Client of amount paid for its services less the value of the services provided.

    CANCELLATION & DATE CHANGES: Any request for a date change must be made at least 30 days in advance of the original event date. Change is subject to photo booth availability and receipt of a new Contract. If there is no availability for the alternate date, time or location, the refundable deposit shall be returned and event cancelled. Any cancellation occurring less than thirty (30) days prior to the event date shall forfeit ALL payments received.No refund will be given if client elects to not use all of the time rented from Click n Smile. For example, if your rental is from 4pm-10pm yet the party ends early at 9 pm and you instruct our attendant to tear down and leave early, you will not be eligible for a refund of the 1 hour that did not get used.I, the undersigned client, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and I am fully familiar with the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.
