TAPPY FEET DISCLAIMER, RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

By borrowing Tappy Feet, LLC ("Tappy Feet") tap dance shoes, by using our portable tap dance floor, or by tap dancing with us (at a studio or anywhere else) (collectively, the "Activities"), in consideration of being permitted to participate in these Activities you freely and fully agree to the following, without reservation: Tappy Feet (including its promoters, sponsors, charitable beneficiaries, employees, agents, event staff, affiliates, and other individuals and parties acting on behalf of or in conjunction with Tappy Feet or its services) will not be held responsible for, and cannot assume or be assigned ANY liability for ANY injury, damage to property, or incidental or consequential damages that may result from ANY participation in the Activities. This exemption from ANY and ALL civil liability specifically includes, but is not in any way limited to, liability for injuries and damages that may result from occurrences such as tripping/falling (including but not in any way limited to, e.g., splinters, sprained ankles, twisted knees, or possibly even hitting your head), hazards associated with dim lighting, ill health or health complications resulting from known or unknown underlying medical conditions, consumption of food, alcohol, or drugs (including both legal and illegal drugs and, of course, including marijuana), as well as any physical or verbal contact with other persons or parties also participating in or nearby the Activities, whether incidental, accidental, or intentional. By printing your name and signing below, you affirm you have read, understand, and agree to this disclaimer, release, waiver of liability, and assumption of risk agreement and have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to you and intend your signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

PHOTOGRAPHY, AUDIO, AND VIDEOGRAPHY WAIVER, DISCLAIMER, AND RELEASE AGREEMENT

AGREEMENT: For valuable consideration received, I, the undersigned, hereby freely, fully, and voluntarily grant to Tappy Feet (including its promoters, sponsors, charitable beneficiaries, employees, agents, event staff, affiliates, and other individuals and parties acting on behalf of or in conjunction with Tappy Feet or its services) the absolute and irrevocable right and permission to use any photograph, film, audio, or video recordings made, created, owned, controlled, or authorized by Tappy Feet of any function, event, or activity that Tappy Feet provides, sponsors, or participates in (collectively, the "Events") that contains my name, image, photograph, voice, video, or other likeness (including but not limited to information about myself, profiles, any oral or written quotations, statements, and other related materials and information) (collectively, the "Materials") in any and all markets, media, social media, and technology, whether now known (e.g., on our website, Facebook, YouTube, Twitter, etc or hereafter devised, in perpetuity. I further acknowledge that Tappy Feet will be the sole and exclusive owner of all rights in and to the Materials, including my appearance(s) thereon, all recording(s) thereof, and any and all ideas, contributions, and suggestions offered by me in connection therewith for all purposes, under copyright and otherwise. Tappy Feet will have the exclusive right to exploit the Events and Materials, including my appearance therein, without restriction and for any and all purposes whatsoever. Tappy Feet may exercise any of these rights, itself, or through any successors, transferees, licensees, distributors, or other parties, and may assign the rights granted hereunder to any third party without my consent. I hereby further release and discharge Tappy Feet (including its promoters, sponsors, charitable beneficiaries, employees, agents, event staff, affiliates, and other individuals and parties acting on behalf of or in conjunction with Tappy Feet or its services) from any and all claims and demands whatsoever arising out of or in connection with any use of the Materials, including any claims that I may have based on the so-called rights of privacy, publicity, or any other right that may arise based on Tappy Feet's use of my name, image, likeness, or appearance. I agree that I have no legal interest in the Materials and understand that the Materials will become the property of Tappy Feet, which has the right to edit, exhibit, duplicate, distribute, or use in any manner whatsoever said Materials worldwide and in perpetuity and for any other purpose whatsoever, including but not limited to publicity, marketing, advertising, fundraising, and/or trade.
