The volunteer desires to provide services for Pryde Fitpire LLC and engage in activities related to serving as a volunteer by performing associated duties. A volunteer is defined as someone whom willingly performs a service or undertaking without pay.
Volunteers understand that the scope of a volunteers’ relationship is limited to a volunteer position and Pryde Fitpire LLC and that no compensation is expected in return for services provided by volunteer. Pryde Fitpire LLC will not provide any benefits traditionally associated with employment to a volunteer; and that the volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of volunteer services to Pryde Fitpire LLC.
(1) Waiver and Release: I, the volunteer, release and forever discharge and hold harmless Pryde Fitpire LLC and assigns form any and all liability, claims, demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise for the services I, the volunteer, provide to Pryde Fitpire LLC. I understand and acknowledge that this Waiver and Release discharges Pryde Fitpire LLC from and liability or claims that I may have against Pryde Fitpire LLC with respect to bodily injury, illness, death, or property damage that may result from the services that I provide to Pryde Fitpire LLC or occurring while I am providing volunteer services.
(2) Insurance: Further, I understand that Pryde Fitpire LLC does NOT assume any responsibility for or obligation to provide me, the volunteer, with financial or other assistance, including but not limited to medical health or disability benefits or insurance of any nature in the event of such injury or medical expenses incurred by me.
(3) Medical Treatment: I hereby release and forever discharge Pryde Fitpire LLC from any claim whatsoever which may arise or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with any emergency during my tenure as a volConfidentiality: I agree to maintain the confidentiality of any proprietary information disclosed to me during my volunteer activities.unteer with Pryde Fitpire LLC.
(4) Assumption and Risk: I hereby expressly assume the risk of injury or harm from these activities and release Pryde Fitpire LLC from all liability for injury, illness, death or property damage resulting from the services that I provide as a volunteer or occurring while I am providing volunteer services at Pryde Fitpire LLC. I understand that the services that I provide to Pryde Fitpire LLC may include activities that may be hazardous to me, including but not limited to:
(A.) Physical Exertion: I understand that my volunteer activities may involve physical exertion, including but not limited to cardiovascular activities, strength training, and flexibility exercises. I acknowledge that such activities carry inherent risks of injury, including the risk of musculoskeletal injuries, sprains, strains, and, in rare instances, more serious injuries such as heart attacks or stroke.
(B.) Environmental Factors: I am aware that the volunteer activities may take place in various environments, both indoor and outdoor, and may be subject to unpredictable weather conditions. I acknowledge the risks associated with exposure to elements, such as extreme temperatures, precipitation, and uneven terrain.
(C.) Equipment Usage: I understand that I may be required to use equipment during my volunteer activities. I acknowledge the risks associated with the use of equipment, including the risk of injury due to improper use or malfunction.
(D.) Health Conditions: I affirm that I am in good physical condition and have no medical conditions or physical limitations that would prevent me from safely participating in the volunteer activities. I acknowledge the responsibility to inform Pryde Fitpire LLC of any changes in my health status that may affect my ability to volunteer safely.
(E.) Supervision: I understand that while Pryde Fitpire LLC will make reasonable efforts to provide supervision and guidance during volunteer activities, there may be inherent risks associated with unsupervised or self-directed activities.
(5) Photographic Release: I grant and convey to Pryde Fitpire LLC all the right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Pryde Fitpire LLC in connections with my providing volunteer services to Pryde Fitpire LLC.
(6) Dress Code and Professionalism: As a volunteer with Pryde Fitpire LLC you are a representative of the organization and are expected to follow these guidelines:
(A.) Respect: I agree to treat all individuals associated with Pryde Fitpire LLC, including staff, fellow volunteers, and participants, with respect and courtesy. I will refrain from engaging in any form of harassment, discrimination, or disrespectful behavior.
(B.) Attire: I will adhere to the dress code and attire guidelines provided by Pryde Fitpire LLC, maintaining a professional and appropriate appearance during my volunteer activities.
(C.) Punctuality: I will make a commitment to arrive on time for scheduled volunteer activities and will notify Pryde Fitpire LLC promptly if I am unable to fulfill my volunteer obligations.
(D.) Conflict Resolution: In the event of any disputes or conflicts during my volunteer service, I agree to address concerns in a professional and constructive manner, seeking resolution through appropriate channels.
(7) Medical Authorization: In the event of an emergency, I authorize Pryde Fitpire LLC to seek and consent to medical treatment on my behalf.
(8) Confidentiality: I agree to maintain the confidentiality of any proprietary information disclosed to me during my volunteer activities.
(9) Termination or Dismissal of Assignment:
(A.) Cause for Termination: Pryde Fitpire LLC reserves the right to terminate or dismiss my volunteer assignment for reasons including but not limited to a breach of this agreement, failure to adhere to professional and behavioral standards, or any actions that may be detrimental to the well-being and reputation of Pryde Fitpire LLC.
(B.) Notice: In the event of termination or dismissal, Pryde Fitpire LLC will provide reasonable notice and, when possible, communicate the reasons for such action.
(C.). Return of Property: Upon termination or dismissal, I agree to promptly return any equipment, materials, or property belonging to Pryde Fitpire LLC that is in my possession.
(10) Term: This agreement shall remain in effect for the duration of my volunteer services with Pryde Fitpire LLC.
(11) Other: I expressly agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the state of Texas and that this Release shall be governed by and interpreted in accordance with the laws of the state of Texas. I agree that in the event that any clause or provision of this Waiver and Release is deemed invalid, the enforceability of the remaining provisions of this release shall not be affected.
