Terms of Agreement
In consideration of the permission granted to you by ScholarMatch, Inc. (“ScholarMatch”) to participate in one or more of their projects, programs, and/or activities (the “Activities”), and of your participation therein, whether in person or remotely via computer, internet, telephone, electronic device or otherwise, you make the representations and agreements below, on which you understand ScholarMatch is relying.
By consenting to this agreement, you hereby forever covenant not to sue and do release, discharge, and waive all rights against, ScholarMatch, and directors, officers, employees, volunteers, agents, representatives, successors, and assigns (individually and/or collectively, the “Releasees”) for, from, and against any and all responsibility, liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise out of or in connection with, either directly or indirectly, your participation in the Activities.
You hereby expressly, knowingly and intentionally waive any and all rights, benefits and protections of California Civil Code Section 1542, which provides, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party” and of any other state or federal statute or common law principle limiting the scope of a general release.
You further agree to defend, hold harmless, and indemnify the Releasees against any claim, damage, loss, or expense of whatever kind or nature that is/are caused by, arise out of, or are a result of, your participation in the Activities, whether or not your acts or omissions are intentional, reckless or negligent.
You attest that You are of sound mind, in good health and possess no physical or mental conditions that would hinder or prevent you from participating in the Activities.
You agree that ScholarMatch and its personnel (including its volunteers) have the right to enforce rules, instructions and standards of conduct and integrity in connection with the Activities and you agree to comply fully with such rules, instructions and standards. You understand that your failure to do so may result in termination of your participation in the Activities.
In addition to the foregoing, you hereby grant permission to ScholarMatch and ScholarMatch’s research partners to collect information about who you are, your contact details, academic history and performance, participation in the Activities, application behavior, interests, feedback and other personal information you provide, and activities during and after college. The foregoing information is only used by ScholarMatch and ScholarMatch’s research partners for use in the Activities, to conduct research to evaluate the efficacy of this program, and otherwise in furtherance of the charitable mission of ScholarMatch, Inc., and will not be shared with any other organizations without your permission, other than in the instances stated below, unless required by applicable law or in case of an imminent threat to safety or health.
In addition to the foregoing, you hereby grant permission to ScholarMatch to share your information in the following circumstances: (i) to publicize your name, statements, image, likeness and/or voice in still photographs or videos on their website and in their publicity, promotional materials, and otherwise so long as such use is in connection with the Activities or in furtherance of the charitable mission of ScholarMatch; and (ii) to provide your information (including, but not limited to, your name, address, high school and email address), to universities, colleges, scholarship providers or other post- secondary institutions to which you have applied or may in future apply, and you understand and agree that such institutions may use this information for many purposes in their discretion including, but not limited to, in identifying your participation in the Activities, reviewing and considering your application, and making admission or scholarship decisions; (iii) to share with ScholarMatch’s research partners to conduct research and to contact you after the conclusion of the program to conduct surveys; (iv) to share with public and private bodies, academic institutions, and nonprofits, including but not limited to National Student Clearinghouse and College Board, to conduct research in connection with the Activities or in furtherance of the charitable mission of ScholarMatch; and (v) to share with partners who referred you to ScholarMatch in furtherance of the charitable mission of ScholarMatchand ScholarMatch’s research partners may contact you after the conclusion of the program to conduct surveys, which you can opt out of at any time.
In addition to the foregoing, you hereby grant permission to ScholarMatch to share anonymized, aggregated information to ScholarMatch’s funders, partners, and supporters for research and educational purposes and otherwise in furtherance of the charitable mission of ScholarMatch.
By consenting to this agreement, you authorize ScholarMatch and its vendors and service partners (collectively, “We”) to share personal data that we collect about you, including your personally identifiable information (“PII”), through this application and through your participation in the Activities, with College Board, a non-profit organization. You further authorize College Board to share your personal data, as well as personal data that College Board may store about you, with its academic partner(s) for the sole purpose of conducting research and analysis concerning the Activities and their effectiveness. College Board and its academic partners may publicly report their findings, however those findings will not disclose any PII.
You also authorize ScholarMatch to collect personal information, academic information, photos and quotes from you, and you grant ScholarMatch permission to use this information to evaluate and improve its programs and to report this information to its funders, partners and supporters for research and educational purposes and for other purposes relating to ScholarMatch’s mission. You understand and agree that ScholarMatch may use pictures and quotes submitted in promotional materials or on its website and hereby grant ScholarMatch a non-exclusive, worldwide license to such pictures and quotes for marketing and other commercial purposes.
You understand and agree that this agreement does not amend, modify or replace any other agreements, waivers or releases that you have entered into with or in favor of ScholarMatch, or create or imply any limitations on any of the terms or conditions of such agreements, waivers or releases.
You understand that if you are not 18 years of age or older, ScholarMatch will ask you to provide parental contact information and that ScholarMatch has a policy of granting your parent or guardian the opportunity to opt out of your participation in this program at any time and that, if your parent opts out, you will cease your participation in the Activities.
If you provide information about any other person (parent, guardian or emergency contact) we assume you have that person’s consent to provide that information.
Students can opt out from the program at any time. Your personal information and the information that you share with your ScholarMatch College Coach will be used to help guide you through the college planning process.
By consenting below, you agree that you have read in full and understand the above and you agree to be bound by the terms, conditions, obligations, and responsibilities set forth in this Agreement, and you intend that this Agreement will be binding not only on you, but also on your agents, representatives, heirs, estate, successors, and assigns.
