and travel to the Mission Locations may expose me to foreseen and unforeseen risks and dangers which may be germane to the Mission Locations at the time in which I am there, including but not limited to the risks and dangers of civil conflict, political unrest, revolution, uprising , war, terrorism, violence, crime (organized or otherwise), kidnapping, natural disaster, environmental event, sickness, and disease (collectively, the “Risks”);

2. FURTHER ACKNOWLEDGES, AGREES and REPRESENTS that I UNDERSTAND that there is the possibility of death or severe personal injury inherent to the Risks, 
which include, but are not limited to fractures, loss of limb, loss of digit, spinal cord injury, paralysis, concussion, brain injury, hypoxia, neurological damage, vertigo, loss of consciousness, burns, over-exertion, fatique, cardiac arrest, lacerations, soft-tissue injury, sprains, strains, and tears of the muscles and ligaments, whiplash, and the transmission or contraction of an illness, sickness, or contagious disease (including Covid-19), and that bodily injury to my person may further result in chronic pain and/or mental impairments that include, but are not limited to, loss of mental acuity and executive function, cognitive deficit, emotional issues, depression, anxiety, and post-traumatic stress;

3. FURTHER ACKNOWLEDGES, AGREES and REPRESENTS that I UNDERSTAND that participating in the Mission may involve transfers via motor vehicle, watercraft, train, or airplane, which include risks of collisions and accidents which may further result in any of the personal injuries identified in paragraph two (2) above. Further, HTCNE takes no responsibility whatsoever for vetting any third party travel or transportation carrier that may be involved in transporting Volunteers during the Mission;

4. FURTHER ACKNOWLEDGES, AGREES and REPRESENTS that I UNDERSTAND that the Mission Locations may be in remote, undeveloped, or conflict-stricken areas that can be difficult to access, and may not have available emergency services and medical personnel, which could increase the response time for emergencies one may suffer, and in turn, could increase the risks and/or dangers, and likelihood of injury to the Volunteer as outlined in paragraphs one (1), and two (2) above;

5. ACCEPTS and VOLUNTARILY ASSUMES ALL RISKS OF BODILY INJURY, MENTAL IMPAIRMENT OR DEATH, AND ASSUMES ALL RESPONSIBILITY for any losses, injuries, expenses, costs, and/or damages that may be suffered by my person or property, by any means and howsoever caused, even if caused , in whole or in part, by the negligence or breach of HTCNE and/or any of its present or future directors, officers, shareholders, board members, representatives, agents, employees, staff, contractors, partner organizations, affiliates, associates, joint venturers, related parties, whether foreign or domestic of HTCNE (collectively, the “Organization Group”) occurring while I am participating in the Mission or while at the Mission Locations, and I further AGREE and ACKNOWLEDGE THAT I WILL NOT HOLD THE ORGANIZATION GROUP LIABLE for the losses, injuries, expenses, costs, and/or damages that I may suffer as contemplated herein;

6. HEREBY AGREES NOT TO CLAIM AGAINST OR SUE THE ORGANIZATION GROUP AND TO WAIVE ANY CLAIMS AGAINST THE ORGANIZATION GROUP, for myself and my representatives, dependents, permitted assigns, heirs, executors, administrators, and next of kin (collectively, the “Releasors”), from any and all liability for any loss, damage, disease contraction/transmission, expense or injury, including death, that I may suffer as a result of or in any way related to my participation in the Mission or while at the Mission Locations DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED ON THE PART OF THE ORGANIZATION GROUP, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE ORGANIZATION GROUP TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE MISSION AS REFERRED TO ABOVE; 

7. FURTHER AGREES that if, notwithstanding my execution of this Agreement, anyone on my behalf, or any of the Releasors make(s) a claim against the Organization Group. I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the relevant Organization Group parties from any litigation expenses, fees, losses, liabilities, awards, damages or costs, which any of the Organization Group may incur as a result of such claim;

8. FURTHER ACKNOWLEDGES that I have been informed of my right to obtain INDEPENDENT LEGAL ADVICE prior to signing this Agreement as I am GIVING UP IMPORTANT LEGAL RIGHTS as a result of accepting the terms and conditions of this Agreement in exchange for being permitted to participate in the Mission and have certain related expenses paid for by HTCNE.  I FURTHER ACKNOWLEDGE that by signing this Agreement I have either obtained independent legal advice or have WAIVED the right to obtain such independent legal advice and proceed fully understanding that I am GIVING UP THE LEGAL RIGHT TO SUE, even in the event of negligence or breach of duty/contract on the part of any of the Organization Group, and I AM WAIVING FOREVER any rights my dependents, heirs, assigns executors, next of kin, beneficiaries may have to sue the Organization Group, resulting from injury to my person or my death;

9. WARRANTS that I am not relying on HTCNE to carry or maintain any health, medical, disability, professional liability, or any other insurance coverage for me, and that I have considered the purchase of third-party medical and travel insurance for the purpose of insuring the risks assumed herein or otherwise.  Further, I have considered the purchase of professional liability insurance for the purpose of insuring any claims made against me alleging professional negligence as a result of my work on the Mission; and I FURTHER WARRANT that I am physically capable of participating in the Mission and traveling to the Mission Locations;

10.  FURTHER ACKNOWLEDGES, AGREES and REPRESENTS THAT I UNDERSTAND that political circumstances in the Mission Locations may change such that my movements and civil liberties may be restricted, or I may otherwise not be permitted to leave in a planned manner or time, and that HTCNE WILL NOT BE LIABLE IN ANY WAY for such an occurrence, or the results thereof, or for the provision of any consular or repatriation services which may be required to facilitate my movement within or exit from the Mission Locations.  I FURTHER AGREE TO TAKE SOLE RESPONSIBILITY for ensuring that I meet whatever requirements are specific to the Mission Locations for entry thereto, movement therein, and exit therefrom;

11. I ACKNOWLEDGE and AGREE that the within Agreement is a legally binding contract, which shall be governed and construed in accordance with the laws of the State of Connecticut and the federal laws of the United States of America applicable in the State of Connecticut, without giving effect to its conflict of laws rules or principles. Further, any dispute arising out of or in any way related to the within Agreement, including over its construction, application, validity, or enforceability shall be governed exclusively by and in accordance with the laws of the State of Connecticut, regardless of the jurisdiction of any underlying claim or litigation in which the application and enforceability of the Agreement is being adjudicated;

12. I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS AND CONDITIONS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS BY ACCEPTING THE TERMS OF THIS AGREEMENT, INCLUDING THE RIGHT TO SUE, ACCEPTED IT FREELY AND WITHOUT ANY INFLUENCE, INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT
