Terms and Conditions for Spot On/Tonic “His & Hers” Sunglasses Giveaway
1. The promoter of the Spot On/Tonic “His & Hers” Sunglasses Giveaway (“the Promotion”) is Spot On Fishing Tackle Pty Ltd (ABN 11 095 255 842, of PO Box 175, Fullarton, SA 5063 ("Promoter").
2. Information on how to enter the Promotion and prize forms part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry.
3. Entry is open to Australian residents who satisfy the entry requirements set out in these terms and conditions, with entrants under the age of 18 to enter with parent/guardian permission. The following persons are not eligible to enter namely:
a. officers, agents, employees, consultants and professional advisers (and immediate family of an officer, agent, employee, consultant or professional adviser) of the Promoter,
b. any licensee or franchisee of the Promoter,
c. the officers, agents, employees, consultants and professional advisers (and immediate family of an officer, agent, employee, consultant or professional adviser) of any licensee or franchisee of the Promoter,
d. the agencies associated with this Competition, and their related bodies corporate.
4. To enter, participants must purchase a product in any Spot On store or online, fill in their details on the online entry form (including proof of purchase) via www.spotonfishing.com.au, or via the URL or QR Code, social and other media.
5. The Promotion starts at 12:01 AM ACST Wednesday 6th December 2023 and closes at 11:59 PM ACST on Tuesday 6th February 2024. All entries must be submitted by 11:59 PM ACST Tuesday 6th February 2024.
6. Prize draw will be conducted at Impressive Advertising, 118 Halifax Street, Adelaide on Wednesday 7th February 2024 (“the prize draw date”).
7. Prize winner (“the winner”) will be notified by phone or text and email (with details of how the prize may be collected), and the winner will be published on the Spot On website and social media.
8. There are 2 prizes to be won:
- 1 x Tonic Outback Green Mirror Sunglasses, valued at $299.00.
- 1 x Flemington Grey Photochromic Sunglasses, valued at $299.00.
9. Total prize pool valued up to $598.00.
10. The winner agrees to be reasonably available for marketing purposes including for photography, TV, radio interviews and social media. The winner consents to being recorded, filmed and photographed for the purposes of marketing, advertising and promotion of the Promoter and its businesses. The winner also consents to any audio, video or photographs containing their voice and/or image taken in connection with the Promotion to be published by the Promoter for the purpose of marketing, advertising and promotion and for other purposes connected with the Promoter or its business.
11. No responsibility will be accepted for late, lost or misdirected entries and entry is not valid until it is received by the Promoter and recorded for the purposes of the Promotion. Entry does not occur at the time of transmission by the entrant to the Promoter. While the Promoter will use all reasonable efforts to facilitate the receipt and recording of entries, if an entry is not received or recorded by the Promoter for any reason it will not be valid, and the entrant will have no recourse.
12. Drawn entries will be checked for validity against the rules of entry as they are drawn. Any entries deemed not valid will be discarded and the draw will continue until the prize is allocated.
13. The Promoter's decision as to the winner is final and no correspondence will be entered into.
14. All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the Promotion. If the information requested is not provided with the entry, the entry will not be valid. By entering the Promotion, unless an entrant advises the Promoter to the contrary, each entrant agrees that the Promoter may use this information to contact you for future promotional, marketing and publicity purposes. Entrants' personal information may be disclosed to State and Territory lottery departments and the winner's name published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out above.
15. The Promoter and its officers, employees and agents will not be liable for any damage or loss (including but not limited to, indirect or consequential loss) which is suffered or sustained in connection with the Promotion or any prize, except to the extent that liability cannot be excluded by law.
16. The Promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated in the course of or in connection with the Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
17. The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in the Promotion.
18. If for any reason the Promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the Promotion subject to the written directions of any competent authority.
19. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
