Acceptance to Event
Submittal of application does not guarantee acceptance into the event. After screening, vendor will receive notification of acceptance and total booth fees that are due to Salisbury Parks and Recreation Department. Upon acceptance, Vendor will have until 3/14/25 to submit payment in full or booth space will be forfeited.
Application Deadline: 2/7/25
Applications received by 2/7/25 will be considered for acceptance to the Cheerwine Festival and will receive confirmation on or before 2/28/25.
Hours of Operation
ALL vendors agree to remain open for business between the hours of 10:00 am-7:00pm on day of event. Early departure will be subject to denial to participate in future events.
Vendor will remove all of its equipment, fixtures, inventory, and other property from the festival site no later than 9:00 pm, 5/17/25.
Set-Up Operations
Accepted Vendors will receive a confirmation packet prior to the event with detailed load in and set up instructions. Vendor is encouraged to decorate their location in an attractive and becoming manner consistent with the theme décor and concept of the Festival. All decorations and tenting must be flameproof and pass safety inspection.
General Policies
Failure to abide by all rules and regulations, as well as specific instructions, provided in the confirmation packet will result in forfeiture of acceptance to future events. This includes attitude and demeanor to all Festival staff, directors, agents, employees, and volunteers.
Vendor agrees to conduct its business in a manner likely to enhance the success of the Cheerwine Festival and the reputation of the City of Salisbury. Shall the Festival determine that the Vendor is acting in a manner detrimental to the event, the Festival may expel the Vendor from the event, and the Vendor shall forfeit its entry fee.
No food sales will be allowed unless you have been added to the Health Permit and accepted to the event as a food vendor.
Vendor is responsible for meeting all Rowan County Health Department regulations.
Vendors and their personnel shall not consume or use alcoholic beverages or other drugs at any time during the event or prior to the completion of all performances under this application.
If the Festival is shut down by the City of Salisbury or emergency services for any reason (ex: inclement weather, major emergency) all vending must cease and remain closed until given the go ahead to resume.
Refunds
Written cancellation is required for a refund. Refunds will only be granted if and when booth space can be filled, less a $100.00 processing fee. Refunds will not be issued for the Cheerwine Festival if the Vendor is a no-show, is dismissed, booth space is forfeited, or Vendor is in violation of any of the Terms and Conditions.
Product
Vendor agrees only to offer the approved items in their application. The selling of unapproved items may result in dismissal from the Cheerwine Festival and Vendor will not be invited back. Vendor will not receive a refund. Festival reserves the right to limit your approved items.
Items referencing violence, weapons, drugs, profanity, nudity, or any other topic deemed inappropriate for this family-friendly event will be prohibited.
Beverages
As a vendor, you are participating and profiting in a Cheerwine themed event, therefore, vendors are not allowed to bring in outside beverages to sell at the festival. This includes all beverage types—soft drinks, water, tea, lemonade, energy drinks, etc.
Vendors must purchase from Piedmont Cheerwine for all drinks sales.
Insurance
Food and Beer vendors, upon acceptance, will be required to obtain a copy of General Liability Insurance naming the City of Salisbury and Carolina Beverage Corporation as additionally insured, for a minimum of $1,000,000 per occurrence.
Booth Requirements
If the Vendor’s application is accepted, the Vendor will be assigned a space within the Cheerwine Festival area. Locations are not guaranteed and are made at the discretion of the festival organizers. All items, equipment and materials MUST fit inside purchased booth space. No items will be allowed to be positioned outside of the approved area.
Sidewalks, walkways and throughways MUST remain clear of items for safety.
Vendors are required to supply their own tents, tables and chairs. Failure to comply will result in removal from event.
The Vendor will be solely responsible for the appearance of its space. The Vendor shall maintain its space in a neat, clean and sanitary condition during the Cheerwine Festival and will surrender its location at the end of the Festival in the same or better condition than originally occupied.
Vendor is responsible for any loss or damages to space or equipment.
Generators
Vendors needing electricity are required to provide their own WHISPER QUIET generator/inverter with a maximum decibel level of 65.
Food Vendor Information
Vendor is responsible for receiving and storing its food and related inventory during the Festival.
Vendor is responsible for securing adequate refrigeration. Vendor can purchase ice on site from Festival ice vendor.
Overnight cooking must be completed by vendor load in time. This time will be noted in the Vendor Information Packet received upon acceptance.
Weather
The Cheerwine Festival is a rain or shine event, unless severe weather creates safety risks for attendees or staff. Any changes will follow advice from local emergency services or the National Weather Service. Please stay updated on weather conditions and follow official instructions during the event. There are no refunds due to weather. Typically May is a hot month and booths are located on asphalt. Vendor is required to provide their own shade tent if desired.
Dismissal from Event
Vendor may be dismissed or removed from the Cheerwine Festival if found to be in violation of any Terms and Conditions. In the event the Vendor is dismissed from the Cheerwine Festival, they will be asked to vacate booth space immediately, take all belongings and will not be allowed to participate onsite for the remainder of the event.
Sound Restrictions
Vendor agrees to not have amplified sound of any type within booth. Vendor with amplified sound may be asked to vacate space and will not receive a refund.
Booth Security
Cheerwine Festival is not responsible for any items lost, stolen or damaged in booth space. This includes, but is not limited to vendor product, tents, tables, chairs, signs, and decorations.
Vendor will be responsible for their own equipment, fixtures, inventory, and other property.
Parking
Vendors will be sent clear directions on all parking requirements prior to the start of the event in the confirmation packet. All vehicles will be directed as to the proper procedures allowed for parking.
Remote parking may be necessary and Vendors will need to plan accordingly.
Vendor’s vehicles will NOT be allowed in pedestrian areas until after closing time and permission from a representative from the Festival is given. Failure to abide by these rules will result in dismissal from event and forfeiture of acceptance to future events.
Photos
Vendors agree to allow the Cheerwine Festival to take pictures of booth and product during the event, with no additional compensation. Photos may be used in future promotional materials.
