Terms & Conditions
1. Consent to Photograph /Videotape / Interview Individuals I hereby agree and give my permission for Mom.ME. and/or partners to record, film, photograph, audiotape or videotape myself (hereinafter collectively referred to as name mentioned in application) and to display, publish or distribute these works for the purpose of publishing, posting on the Mom.ME. website and posting on social media sites. I hereby waive any right to approve the use of these Works now or in the future, whether the use is known to me or unknown, and I waive any right to any royalties related to the use of these works. I understand that the works may appear in electronic form on the internet or in other publications outside of Mom.ME.’s and/or our partners’ control. I agree that I will not hold Mom.ME. responsible for any harm that may arise from such unauthorized reproduction.
2. LIMITED LIABILITY: Vendor expressly releases Mom.ME. and any of its affiliates, supporters, founders, volunteers, or any other associated individuals or companies from any liability and waives A) any and all demands, claims, and causes of action in law or in equity, related to any defect deficiency, failure or impairment of utilities or other facilities, including water, heating electricity, ventilation, refrigeration, or other mechanical systems failure; B) the conduct, negligence or claims of any exhibitor, volunteer, employee, creator, owner, contractor, or attendee or any other affiliated party associated with Mom.ME.; and C) any fire, flood, strike, terrorist attack, weathers or other force majeure beyond control of Mom.ME..
3. CANCELLATION: Organizers reserve the right to cancel this event at any time prior to the date of the event with refund of all amounts paid by participants to Mom.ME. in connection with this Agreement. Otherwise all payments are non-refundable. The organizers also reserve the right to cancel the vendor’s ability to vend at the expo based on the vendor’s behavior, display, products, or for any reason deemed appropriate by the event without refund to the vendor. The organizers deem that a rescheduled event is not a canceled event and no refunds will be given as you will be given a vending space with a new date and potentially a new location.
4. INDEMNIFICATION: Exhibitors display and exhibit property at their own risk. Mom.ME. and any of its affiliates, supporters, founders, volunteers, or any other associated individuals or companies does not assume any responsibility for loss or damage to Exhibitors property. Mom.ME. will not be held accountable for the death or injury of any person attending an event, or for any damages suffered by Exhibitor or its officers, agents, employees, or invitees as a result of any cause whatsoever. Exhibitor shall indemnify and hold Mom.ME., its parent, subsidiaries, affiliates, sponsors, and their respective officers, directors, agents and employees harmless from any suit or claim arising out of any action or failure to act by the Exhibitor. Exhibitor shall be liable for any and all damages caused by exhibitor to the event building’s grounds, landscaping, floors, walls, columns, or any other part of the building, or to the chattels and fixtures of the building or any other Exhibitor or person or entity having property at the events building’s premises. Exhibitors are advised to obtain insurance coverage for this risk.
