The Alma Jean Foundation is a non-profit corporation and shall be operated exclusively for educational and charitable purposes within the meaning of section 501 (c) (3) of the Internal Revenue Code of 1986, or the corresponding section of any future federal tax code.

It is the mission, duty, and purpose of the Alma Jean Foundation to address, educate, coordinate, and provide resources to promote the importance of Academics, Leadership, Mentorship, and Athletics on a local and statewide level.

ACKNOWLEDGEMENT OF BACKGROUND CHECK:

AS A CONDITION OF VOLUNTEERING, I give permission for the ALMA Jean Foundation to conduct background check (s) on me now and as long as I continue to be active with the organization, which may include a review of sex offender registries (some of which contain name only searches which may result in a report being generated that may or may not be me), child abuse and criminal history records. I understand that, if appointed, my position is conditional upon the foundation receiving no inappropriate information on my background. I hereby release and agree to hold harmless from liability the Alma Jean Foundation, Peterson Farm Co. LLC, the officers, employees and volunteers thereof, or any other person or organization that may provide such information. I also understand that, regardless of previous appointments, the Alma Jean Foundation is not obligated to appoint me to a volunteer position.

As a member and participant of the Alma Jean Foundation, I agree to abide by the rules, policies and procedures. I understand that I am a member and participating at my own risk and that the organization, its board members, officers, employees and affiliates, cannot assume any responsibility for any liability for any accident, injury or health problem which may arise from any volunteer work I perform for the organization. I agree that all the work I do is on a volunteer basis and I am not eligible to receive any monetary payment or reward.

NOTE: The ALMA Jean Foundation will not discriminate against any person on the basis of race, creed, color, national origin, marital status, gender, sexual orientation or disability.

ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I hereby assume all of the risks of as a volunteer at the Alma Jean Foundation, Including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault. I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problem. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the Alma jean Foundation, and that it will govern my actions and responsibilities presented by the Alma Jean Foundation.I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: 

1. I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from any event presented by the Alma Jean Foundation. THE FOLLOWING ENTITIES OR PERSONS: Alma Jean Foundation its officers, representatives, and volunteers, Peterson Farm Co., LLC., its officers, members, and successors, Peterson Bros. Construction, Inc., its officers, employees, and successors Daniel A. Peterson JR. Trust, Joy K. Peterson, Trust, its successors

2.  I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned above in this paragraph from any and all liabilities or claims made as a result of my participation at the Alma Jean Foundation, whether caused by negligence or otherwise. I acknowledge that the Alma Jean Foundation, may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration. I consent and agree that the Alma Jean Foundation and/or their coaches; representatives or volunteers may take photographs or digital recordings of me as a participant during this event and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.

3. Insurance. I understand that I expressively waive any such claim for compensation or liability on the part of ALMA JEAN FOUNDATION.

4. Medical Treatment. I hereby release and forever discharge ALMA JEAN FOUNDATION from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with ALMA JEAN FOUNDATION.

5. Assumption of Risk. I understand that my time with ALMA JEAN FOUNDATION may include activities that may be hazardous to them including, but not limited to, construction activities, loading and unloading of heavy equipment and materials, and local transportation to and from fundraiser/program sites. We recognize and understand that my time with ALMA JEAN FOUNDATION may, in some situations, involve inherently dangerous activities (working around vehicles and roadways I hereby expressly assume the risk of injury or harm in these activities and release ALMA JEAN FOUNDATION from all liability for injury, illness, death or property damage resulting from the activities of my time at ALMA JEAN FOUNDATION

The accident waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.

The Undersigned does hereby represent that he/she is, in fact, acting in such capacity, has consented to the Alma Jean Foundation and has agreed individually ,to the terms of the accident waiver and release of liability set forth above. The undersigned further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to SO act and release said parties.

6. Photographic Release. I grant and convey unto ALMA JEAN FOUNDATION all right, title, and interest in all photographic images and video or audio recordings made by ALMA JEAN FOUNDATION during my volunteer time with ALMA JEAN

7. Other. As the volunteer I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of HAWAII in the United States of America, and that this Release shall be governed by and interpreted in accordance with the laws of the State of HAWAII. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall no otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
