  • Wilderness Kids Alexandria ("WKA") provides multiple programs, listed above and referred to in this document. Collectively these are "the Programs", each a "Program." An After-School Program (the “After-School Program”), a High-School Club (the “Club”), a Cohort Programs (the “Cohorts”), a Summer Program (“Summer Program”) and a Weekend Outing Program (the “Weekend Program” and collectively with any or all other programs, “the Programs”, each a “Program”).

    Pick-up and Transportation to the Programs

    During our After-School Program, Club Program, and Cohorts, we will pick up your child (sometimes referred to herein as the “participant”) from his or her school after classes have ended and drive them to a park or natural area in or around Alexandria, spend approximately 60 to 90 minutes there participating in various activities, and then drop your child at their regular bus stop or at home after the After-School Program.

    The Weekend Program will take place on weekends and weekdays on which classes are off, as determined by WKA at the start of the Program. During the Weekend Program we will pick up your child at a specified location and time to be agreed with you on a rolling basis and drive them to a park or natural area in or around Alexandria, spend an amount of time there agreed with you on a rolling basis, participating in various activities, and then drop your child at a place and time to be agreed with you on a rolling basis after the Weekend Program. 

    The Summer Program will take place in June, July and August and transportation arrangements will be made with parents, in similar fashion to the Weekend Program. Distances traveled will be greater and will be explained at the time of the program.

    I give permission for WKA to pick my child up from either his or her school after classes have ended or from the specified location and time I agree to from time to time, as applicable, and to drive them to destinations for the Programs whether by car, van, bus or similar transportive means, where the Programs will take place on such day. Locations for Programs on school days may include, but are not limited to: Dora Kelley Nature Park, Winkler Nature Preserve, Holmes Run Park, Four Mile Run Park, Huntley Meadows Park, Monticello Park, Roosevelt Island and other natural areas in and near the City of Alexandria. Locations for Programs on days without school may include, but are not limited to: Great Falls Park, Chesapeake Bay, Shenandoah Park, Prince William Forest, and other natural areas in Virginia, West Virginia, Maryland, and Washington DC, or farther away during Summer. I give permission for WKA staff to choose the location of the activity based on the schedule of the applicable Program on any given day.

    Drop Off After the Programs

    I give permission to WKA to drop my child off after each Program at any of: my child’s typical bus stop, in front of my child’s residence, or at the specified location and time I agree to from time to time, as applicable (the “drop-off spot”). Further, I give permission for my child to be dropped without an adult present to collect them at the drop-off spot. I understand that WKA intends to drop my child off between 5:30 p.m. and 6:00 p.m for Programs taking place on school days and at times that WKA will inform me of after each Program on days without school. I recognize that some circumstances, including weather, traffic, road conditions, and others, are beyond the control of WKA and drop off times may be later or earlier than planned. In those cases, WKA staff will try to inform me of delays or early drop-offs. I agree that WKA is no longer responsible for my child after he or she has been dropped off at the designated drop-off site, and release WKA, its staff, agents, employees, managers, volunteers, operators and representatives from any liability for any injury experienced by my child following drop off.

    In summary, I give permission for my child to be picked up by WKA for the corresponding Program, driven to a Program location by WKA, and then dropped off at a specified bus stop, the child’s home or a specified location to be agreed on, as applicable, by WKA at the end of the corresponding Program.

  • Participant Waiver, Assumption of Risk, and Agreement of Release and Indemnity

  • Student Conduct

    I understand that alcohol, tobacco, vaping devices, and drugs are prohibited on all Wilderness Kids Programs and agree that my child may be removed from programs if they possess such items. I also understand that my child’s cell phone can become a distraction to their experience with Wilderness Kids and authorize Wilderness Kids to take my child’s cell phone away from them for the duration of any single program. I acknowledge that on Summer Programs, cell phones are completely prohibited from programming.

    In consideration of Wilderness Kids Alexandria Inc, its directors, employees, officers, volunteers, trustees, contractors and all other persons or entities associated with it (collectively referred to as "WKA") allowing my child or legal ward to participate as a participant in the after school Program provided by WKA, I, the student or other participant participating in the activities described below (in either case, the "Participant"), or the parent or legal guardian of a minor Participant, hereby enter into this agreement (this "Agreement") and acknowledge and agree as follows:

    Acknowledgment and Assumption of Risks

    I understand and acknowledge that the activities the Participant participates in with WKA, including but not limited to camping, including cooking over stoves, open fires or by other means, kayaking, canoeing, skiing, rock climbing, sailing, surfing, swimming, hiking, biking, horseback riding, caving, vehicle travel, service projects that may involve using tools, power equipment, ladders, or construction materials and other related activities (the "Activities"), may be dangerous and may involve the risk that my child will sustain serious injury, illness, temporary or permanent disability, paralysis, trauma, death, and/or property damage. I understand that the Activities may not be supervised, and that WKA does not provide medical services beyond basic first aid. I further acknowledge that any injury that my child may sustain while participating in the Activities may be compounded by negligent or delayed medical service or negligent or delayed assistance by WKA. I further acknowledge there may be other risks and economic losses, which may not be known to me or may be unforeseeable, that are presented by my child's participation in the Activities. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR IN CONNECTION WITH THE PARTICIPANT'S PARTICIPATION IN THE ACTIVITIES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED BY NEGLIGENCE OF WKA.

  • Agreements of Release and Indemnity

    I hereby fully and forever release, hold harmless, and agree not to sue WKA, its agents, and staff, including managers, interns and all other persons, representatives or entities acting under their direction ("Released Parties"), with respect to any and all claims or losses of any kind I may currently or hereinafter have, including, but not limited to, claims of loss or damage to person or property by reason of injury, temporary or permanent disability, death, damages, liabilities, expenses and/or causes of action, now known or otherwise suffered by the Participant, arising in whole or in part from my, or the minor Participant's, participation in the WKA program or any Other Programs, whether caused by the negligence of WKA or any of the Released Parties or by any other reason. I agree further to indemnify ("indemnify" means to defend, and pay or reimburse, including costs and attorney's fees) Released Parties against any claim or loss brought or caused by a member of my or the minor Participant's family, a rescuer, another participant, or any other person, which claim or loss arises in whole or part from an injury or other loss suffered by me or caused by me, or suffered or caused by the minor Participant, in connection with my, or the minor Participant's, participation in the WKA program or any Other Program. I acknowledge and agree that this release and waiver of liability is intended to be, and is, a complete release, to the full extent allowed by applicable law, of any responsibility of the Released Parties for all personal injuries, temporary or permanent disability, death, and/or property damage sustained by my child while participating in the Activities.

    I agree, on behalf of myself and the minor Participant, to accept and abide by WKA honor code and rules and that violating these rules and regulations could place the Participant and others in danger of injury or death. I understand and agree that WKA may search my, or the minor Participant's, belongings at any time in search of prohibited or other items.

    I agree that this Agreement and all other aspects of my, or the minor Participant's, relationship with WKA, contractual or otherwise, are governed by the laws of Virginia. TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY WAIVE ALL RIGHTS TO A TRIAL BY JURY IN ANY LEGAL ACTION TO ENFORCE OR INTERPRET THE PROVISIONS OF THIS AGREEMENT OR THAT OTHERWISE RELATES TO THIS AGREEMENT.

    I, the Participant, or my parent(s) or guardian if I am a minor, have carefully read, understood and accepted the terms and conditions stated herein and acknowledge that this Agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives and estate and all members of my family.

  • Medical Authorization & Release

    I have verified with the Participant's physician and other medical professionals, or otherwise satisfied WKA, that the Participant has no past or current physical or psychological condition that might affect his/her/their participation in the WKA Program. The Participant is able to participate without causing harm to himself or herself or to others. I understand that WKA admission of the Participant to the Program is not intended as a representation that WKA staff will be able to manage successfully a medical event or emergency related to a disclosed, or undisclosed, medical condition. The responsibility for determining a student's suitability for a course is not WKA's but, rather, the Participant's, guided by family and her or his or their physician. WKA reserves the right to refuse admission or remove a Participant from a Program for any reason it deems in the best interests of the student or of WKA. WKA is authorized to obtain emergency hospitalization or other medical care for the Participant.

  • Consent to Disclosure of Personal Information

    The Participant, or the parent or legal guardian of a minor Participant, understands and acknowledges that WKA may wish to disclose personal information about Participants, including their name, image, voice, and/or personal story collected during or in connection with participation in WKA activities for purposes of grant proposals and other financial support, promotional materials, community awareness, and other reasons, to third parties, including but not limited to social media platforms (e.g., Instagram, Facebook, Twitter, etc I understand that I am under no obligation to consent to the disclosure of my/my child or ward's personal information. | further understand | can withdraw my consent by notifying WKA's Executive Director in writing.

    Having been fully informed and considered the above, I authorize WKA to have my, or the minor Participant's, image, voice, name, and/or story collected during or in connection with participation in any activity with WKA or otherwise provided to WKA, and use such image, voice, name and/or story in any format, including video, print or electronic as WKA may deem appropriate to carry out its mission, including on the website and social media sites.

  • Wilderness Kids Alexandria (“WKA”) ofrece múltiples programas, enumerados anteriormente y mencionados en este documento. Colectivamente son “los Programas”, cada uno un “Programa”. Un Programa Extraescolar (el “Programa Extraescolar”), un Club de Secundaria (el “Club”), un Programa de Cohortes (las ”Cohortes”), un Programa de Verano (“Programa de Verano”) y un Programa de Salida de Fin de Semana (el “Programa de Fin de Semana” y colectivamente con cualquiera o todos los demás programas, “los Programas”, cada uno un “Programa”).

  • Recogida y transporte a los programas

    Durante nuestro Programa Extraescolar, Programa de Clubes y Cohortes, recogeremos a su hijo (a veces denominado en el presente documento «participante») en su centro escolar una vez finalizadas las clases y lo llevaremos a un parque o zona natural de Alexandria o sus alrededores, donde pasará aproximadamente entre 60 y 90 minutos participando en diversas actividades, y después lo dejaremos en su parada de autobús habitual o en su casa una vez finalizado el Programa Extraescolar.

    El programa de fin de semana tendrá lugar los fines de semana y los días laborables en los que no haya clase, según determine la WKA al inicio del programa. Durante el programa de fin de semana, recogeremos a su hijo en un lugar y a una hora acordados con usted de forma continua y lo llevaremos a un parque o área natural en Alexandria o sus alrededores, donde pasará el tiempo acordado con usted de forma continua participando en diversas actividades, y luego lo dejaremos en un lugar y a una hora acordados con usted de forma continua después del programa de fin de semana. 

    El programa de verano tendrá lugar en junio, julio y agosto y el transporte se organizará con los padres de forma similar al programa de fin de semana. Las distancias recorridas serán mayores y se explicarán en el momento del programa.

    Doy permiso a la WKA para que recoja a mi hijo/a en su escuela después de que hayan terminado las clases o en el lugar y hora especificados que yo acuerde de vez en cuando, según corresponda, y para que lo lleve a los destinos de los Programas ya sea en coche, furgoneta, autobús o medio de transporte similar, donde los Programas tendrán lugar ese día. Los lugares de los Programas en días lectivos pueden ser, entre otros: Dora Kelley Nature Park, Winkler Nature Preserve, Holmes Run Park, Four Mile Run Park, Huntley Meadows Park, Monticello Park, Roosevelt Island y otras áreas naturales en y cerca de la ciudad de Alexandria. Lugares para Programas en días sin escuela pueden incluir, pero no están limitados a: Great Falls Park, Chesapeake Bay, Shenandoah Park, Prince William Forest y otras áreas naturales en Virginia, West Virginia, Maryland y Washington DC, o más lejos durante el verano. Doy permiso al personal de la WKA para que elija el lugar de la actividad en función del horario del Programa aplicable en un día determinado.

    Entrega después de los programas

Entiendo que WKA tiene la intención de dejar a mi hijo/a entre las 5:30 p.m. y las 6:00 p.m. para los Programas Extraescolares y en los horarios que WKA me informará después de cada Programa de Fin de Semana. Reconozco que algunas circunstancias, incluyendo el tiempo, el tráfico, las condiciones de la carretera y otras, están fuera del control de WKA y las horas de entrega pueden ser más tarde o más temprano de lo previsto. En esos casos, el personal de WKA intentará informarme de los retrasos o de las salidas anticipadas. Estoy de acuerdo en que WKA no es responsable de mi hijo/a después de que haya sido dejado en el lugar de entrega, y libero a WKA, su personal, agentes, empleados, gerentes, operadores y representantes de cualquier responsabilidad por cualquier lesión experimentada por mi hijo/a después de ser dejado en el lugar de entrega.

    En resumen, doy permiso para que mi hijo/a sea recogido por WKA para el Programa correspondiente, transportado a un lugar del Programa en o cerca de la ciudad de Alexandria por WKA, y luego sea dejado en una parada de autobús especificada, en la casa del niño/a o en un lugar acordado, según corresponda, por WKA al final del Programa correspondiente.

  • Renuncia del Participante, Asunción de Riesgos y Acuerdo de Liberación e Idemnización

    A cambio de que Wilderness Kids Alexandria Inc, sus directores, empleados, funcionarios, voluntarios, fideicomisarios, contratistas y todas las demás personas o entidades asociadas con ella (colectivamente denominados "WKA") permiten a mi hijo/a o pupilo legal participar como participante en el Programa extraescolar proporcionado por WKA, yo, el estudiante u otro participante que participa en las actividades descritas a continuación (en cualquier caso, el "Participante"), o el padre o tutor legal de un Participante menor de edad, por la presente firmo este acuerdo (este "Acuerdo") y reconozco y acepto lo siguiente:

    Reconocimiento y asunción de riesgos

    Entiendo y reconozco que las actividades en las que el Participante participa con WKA, incluyendo pero no limitándose a acampar, cocinar en estufas, fuegos abiertos o por otros medios, kayak, piragüismo, esquí, escalada, vela, surf, natación, senderismo, ciclismo, equitación, espeleología, viajes en vehículo, proyectos de servicio que pueden implicar el uso de herramientas, equipos eléctricos, escaleras o materiales de construcción y otras actividades relacionadas (las "Actividades"), pueden ser peligrosas y pueden implicar el riesgo de que mi hijo/a sufra lesiones graves, enfermedad, discapacidad temporal o permanente, parálisis, trauma, muerte y/o daños a la propiedad. Entiendo que las Actividades pueden no estar supervisadas y que WKA no proporciona servicios médicos más allá de los primeros auxilios básicos. Además, reconozco que cualquier lesión que mi hijo/a pueda sufrir durante su participación en las Actividades puede verse agravada por un servicio médico negligente o tardío o por una asistencia negligente o tardía por parte de WKA. Además, reconozco que puede haber otros riesgos y pérdidas económicas, que pueden no ser de mi conocimiento o ser imprevisibles, que se presentan por la participación de mi hijo/a en las Actividades. ASUMO VOLUNTARIA Y LIBREMENTE TODOS LOS RIESGOS Y PELIGROS QUE PUEDAN OCURRIR EN RELACIÓN CON LA PARTICIPACIÓN DEL PARTICIPANTE EN LAS ACTIVIDADES, INCLUIDO EL RIESGO DE LESIONES, MUERTE O DAÑOS A LA PROPIEDAD, INCLUSO SI SON CAUSADOS POR NEGLIGENCIA DE WKA.

    Acuerdos de liberación e indemnización

    Por la presente libero, eximo de responsabilidad y acepto no demandar a WKA, sus agentes y personal, incluyendo gerentes, becarios y todas las demás personas, representantes o entidades que actúen bajo su dirección ("Partes Exoneradas"), con respecto a todas y cada una de las reclamaciones o pérdidas de cualquier tipo que pueda tener en la actualidad o en el futuro, incluyendo, pero no limitado a, reclamaciones de pérdida o daño a la persona o propiedad por razón de lesión, incapacidad temporal o permanente, muerte, daños, responsabilidades, gastos y/o causas de acción, ahora conocidas o sufridas de otro modo por el Participante, que surjan en su totalidad o en parte de mi participación, o la del menor Participante, en el programa de WKA o en cualquier Otro Programa, ya sea causado por la negligencia de WKA o de cualquiera de las Partes Exoneradas o por cualquier otra razón. Acepto además indemnizar ("indemnizar" significa defender, y pagar o reembolsar, incluyendo costes y honorarios de abogados) a las Partes Exoneradas contra cualquier reclamación o pérdida presentada o causada por un miembro de mi familia o la del Participante menor de edad, un rescatador, otro participante o cualquier otra persona, cuya reclamación o pérdida surja en todo o en parte de una lesión u otra pérdida sufrida por mí o causada por mí, o sufrida o causada por el Participante menor de edad, en relación con mi participación, o la del Participante menor de edad, en el programa del WKA o en cualquier Otro Programa. Reconozco y acepto que esta exención y exención de responsabilidad pretende ser, y es, una exención completa, en la máxima medida permitida por la ley aplicable, de cualquier responsabilidad de las Partes Exoneradas por todas las lesiones personales, incapacidad temporal o permanente, muerte y/o daños a la propiedad sufridos por mi hijo/a durante su participación en las Actividades. 

    Estoy de acuerdo, en mi nombre y en el del Participante menor de edad, en aceptar y cumplir el código de honor y las normas de WKA y en que la violación de estas normas y reglamentos podría poner al Participante y a otros en peligro de lesión o muerte. Entiendo y acepto que WKA puede registrar mis pertenencias, o las del Participante menor de edad, en cualquier momento en busca de objetos prohibidos o de otro tipo. 

    Acepto que este Acuerdo y todos los demás aspectos de mi relación, o la del Participante menor de edad, con WKA, contractuales o de otro tipo, se rigen por las leyes de Virginia. EN LA MEDIDA EN QUE LA LEY LO PERMITA, RENUNCIO POR LA PRESENTE A TODOS LOS DERECHOS A JUICIO CON JURADO EN CUALQUIER ACCIÓN LEGAL PARA HACER CUMPLIR O INTERPRETAR LAS DISPOSICIONES DE ESTE ACUERDO O QUE DE OTRO MODO ESTÉN RELACIONADAS CON ESTE ACUERDO.

    Yo, el Participante, o mi(s) padre(s) o tutor si soy menor de edad, he leído cuidadosamente, entendido y aceptado los términos y condiciones aquí expuestos y reconozco que este Acuerdo será efectivo y vinculante para mí, mis herederos, cesionarios, representantes personales y patrimonio y todos los miembros de mi familia.

  • Conducta de los estudiantes

    Entiendo que el alcohol, el tabaco, los dispositivos de vaporización y las drogas están prohibidos en todos los programas de Wilderness Kids y estoy de acuerdo en que mi hijo puede ser retirado de los programas si poseen tales artículos. También entiendo que el teléfono celular de mi hijo puede convertirse en una distracción para su experiencia con Wilderness Kids y autorizo a Wilderness Kids a quitarle el teléfono celular a mi hijo durante la duración de cualquier programa. Reconozco que en los Programas de Verano, los teléfonos celulares están completamente prohibidos en la programación.

    He verificado con el médico del Participante y otros profesionales de la medicina, o satisfecho de otro modo a WKA, que el Participante no tiene ninguna condición física o psicológica pasada o actual que pueda afectar a su participación en el Programa de WKA. El Participante es capaz de participar sin causarse daño a sí mismo ni a los demás. Entiendo que la admisión del Participante al Programa por parte de WKA no pretende ser una representación de que el personal de WKA será capaz de gestionar con éxito un evento o emergencia médica relacionada con una condición médica revelada, o no revelada. La responsabilidad de determinar la idoneidad de un alumno para un curso no es de WKA, sino del participante, guiado por su familia y su médico. WKA se reserva el derecho de rechazar la admisión o retirar a un participante de un programa por cualquier motivo que considere en el mejor interés del alumno o de WKA. WKA está autorizada a obtener hospitalización de urgencia u otro tipo de atención médica para el Participante.

  • Consentimiento para la divulgación de información personal

    El Participante, o el padre o tutor legal de un Participante menor de edad, entiende y reconoce que WKA puede desear divulgar información personal sobre los Participantes, incluyendo su nombre, imagen,VOZ y/o historia personal recopilada durante o en relación con la participación en las actividades de WKA con fines de propuestas de subvenciones y otras ayudas financieras, materiales promocionales, concienciación de la comunidad y otras razones, a terceros, incluyendo pero no limitado a plataformas de medios sociales (por ejemplo, Instagram, Facebook, Twitter, etc Entiendo que no estoy obligado a consentir la divulgación de la información personal de mi hijo/a o pupilo. Además, entiendo que puedo retirar mi consentimiento notificándolo por escrito al Director Ejecutivo de WKA.

    Habiendo sido plenamente informado y considerado lo anterior, autorizo a WKA a que mi imagen, voz, nombre y/o historia, o la del participante menor de edad, sean recogidos durante o en relación con la participación en cualquier actividad con WKA o proporcionados de otro modo a WKA, y a utilizar dicha imagen, voz, nombre y/o historia en cualquier formato, incluyendo vídeo, impreso o electrónico, que WKA considere apropiado para llevar a cabo su misión, incluyendo en el sitio web y en los sitios de medios sociales.
