Membership Cancellation
YOUR MEMBERSHIP IS ONGOING AND WILL ONLY STOP WHEN YOU NOTIFY US TO CANCEL IN WRITING. THIS IS AN ONGOING MEMBERSHIP AGREEMENT. THE AGREEMENT WILL CONTINUE UNTIL EITHER YOU OR US TERMINATE IT IN THE WAY DESCRIBED IN THIS AGREEMENT. IF AN AUTOMATIC DEBIT ARRANGEMENT IS IN PLACE, MEMBERSHIP FEES WILL CONTINUE TO BE DEBITED FROM YOUR CREDIT CARD OR BANK ACCOUNT UNTIL YOU OR YOUR FERNWOOD HOME CLUB CANCEL THE ARRANGEMENT BY NOTIFYING YOUR BANK OR CREDIT PROVIDER. IF YOU TERMINATE THE AGREEMENT OR STOP THE AUTOMATIC DEBIT ARRANGEMENT IN A MENNER NOT DESCRIBED IN THE AGREEMENT, THEN YOU WILL BE LIABLE FOR DAMAGES FOR BREACH OF CONTRACT.
If you need to cancel you must provide us written notice of the cancellation. Please email gregoryhills@fernwoodfitness.com.au or complete a Cancellation Request Form at Reception during Staffed Hours. YOU WILL NEED TO PROVIDE US WITH ONE MONTH NOTICE (2 FULL FORTNIGHTLY DIRECT DEBITS) and cancellation fee (if applicable).
CANCELLATION TERMS
12 month ongoing - $200 cancellation fee + 2 direct debit notices
18 month ongoing - $300 cancellation fee + 2 direct debit notices
Flexi - 2 direct debit notices
Your Fernwood Membership is ONLY to be used by you!
Only one member can enter the club at any one time. It is a serious breach of safety to allow other members, non-members, or children through the door with your access card, penalties will apply.
Please do not escort non-member/s into the club during unstaffed hours or give your key to anyone to use on your behalf. You will be contacted immediately and the following will apply as per our T&Cs:
+$250 non-compliance fee (added onto your next direct debit)
+Possible termination of membership

Deferral
You will be charged a freeze fee of $5.00 per week for each freeze as outlined in your Membership Fees & Charges. Please be aware that this is a pro-rated amount and will adjust your direct debit amount accordingly, depending on what date your freeze starts in line with your scheduled direct debit days. Must provide written notice of deferral. The period of the hold extends your minimum end term. If you have an active instalment plan this cannot be put on hold and debit along with your deferral.
Rejection fee
$15 (please ensure to have funds the night before the debit date to avoid a rejection fee. Please refer to our direct debit calendar).
DOWNGRADE FEE
If you wish to downgrade your membership from Reformer Pilates, FIIT30, or Platinum to a Standard Membership, the following applies:
Downgrade Fee: $100 + 1 DD notice. This can be paid via your next direct debit or an instalment plan.
Once notice is given to downgrade a component of your membership your next payment is your last (one direct debit notice is required per Clause 13.1).
Downgrading your Membership to the same contractual term e.g. 12 Month Reformer Pilates Membership to 12 Month Standard Membership will not renew your contract term. However, if you contract to a different contractual term e.g. 12 Month Reformer Pilates to 18 Month Standard Membership you will be locked in for that new lock-in term duration (in this case 18 Months). Please advise our Admin Team on your preferred option. If you are outside of your minimum end term date and wish to downgrade, the above terms still apply.
All Memberships are ongoing and continue until we receive written notice of your cancellation request.
You will need to complete our Membership Agreement Form to confirm your Membership Downgrade and applicable Terms and Conditions to your Membership. Further, you will also need to sign your new Membership Agreement in club to complete the downgrade since you have removed a component from your Membership.
Clause 13.0 DOWNGRADING YOUR MEMBERSHIP
13.1 Subject to clause 13.2, if you wish to remove any component of your membership, you may request us to downgrade your membership by giving us written notice of the downgrade and paying for all services used up until the date of the notice. Once notice is given to downgrade a component of your membership your next payment is your last.
13.2 You cannot downgrade your membership if your membership has been paid in full and you are outside your cooling off period
13.3 A downgrade fee may be applicable when changing your membership inside the minimum term of the contract. For example, changing from a 12 Month Reformer Pilates membership to a standard 12 Month membership inside the minimum term would incur a downgrade fee as per the membership fees & charges table.
13.4 If you do not pay the downgrade fee in full at the time of the downgrade request, the balance of the downgrade fee will be paid in instalments by direct debit, with the final instalment to be paid on or before the End Date or the Minimum Term End Date (as applicable).

Transfer of membership fee to non-member $90
Student Membership (University Students Only)
To be eligible for a Student Membership, you must hold a valid and current university enrolment and Student ID card at the time of joining. This discount only applies to Standard (Base) Memberships and does not extend to Reformer Pilates, FIIT30 or Platinum Memberships. If you decide to upgrade your membership to a Reformer Pilates, FIIT30 or Platinum Membership you will forfeit your Student Discount unless you downgrade back down to a Standard (Base) Membership.
We reserve the right to request verification of your student status at any time, including annually, to confirm continued eligibility.
If you cease to be a student or are unable to provide valid proof of enrolment, the Student Membership discount will be removed and the standard membership rate will apply from the next billing cycle.

ABUSIVE & AGGRESSIVE BEHAVIOUR IN CLUB OR OVER THE PHONE TOWARDS OUR STAFF OR MEMBERS.
WE ARE HERE TO HELP, BUT WE WILL NOT BE ABLE TO ASSIST IF WE BELIEVE YOU ARE SHOWING SIGNS OF AGGRESSION. IF STAFF OR MANAGEMENT BELIEVE YOU ARE EXHIBITING THIS TYPE OF BEHAVIOUR YOUR MEMBERSHIP WILL LIKELY BE TERMINATED AS PER THE CANCELLATION T&CS OUTLINED.
Direct Debit
Our Direct Debit cycle runs on a fortnightly basis on a Thursday. Please ensure to have sufficient funds and correct/valid payment details the night prior to the direct debit date to avoid a $15 rejection fee. Please see attached calendar below.
Class & Appointment Cancellation Policy
Please the above Class Booking Policy regarding our Class Cancellations, etc. We have a 'fair play' booking policy whereby we ask that you provide us appropriate notice for your booking. Please see summary below:
Group Fitness: 1 hour
Reformer Pilates: 6 hours + $10 No Show Fee automatically added to your next scheduled direct debit (for those on a Reformer Pilates Style Membership, Platinum Membership or Add-On). If you have purchased a session or used a session from a pack, failure to cancel outside of the cancellation window will result in the forfeiture of that session.
FIIT30: 6 hours + $5 No Show Fee automatically added to your next scheduled direct debit (for those on a FIIT30 Style Membership, Platinum Membership or Add-On). If you have purchased a session or used a session from a pack, failure to cancel outside of the cancellation window will result in the forfeiture of that session.
