1. HEALTH OF THE PUPPY
At the time of delivery, the Puppy shall be in good health. The Puppy comes with up to date health records and has been vaccinated with 1 distemper (DA2PP) vaccines along with being tested for Coccidia & Intestinal parasites (worms). The Puppy will have also received 3 dewormings (3, 6 & 8 weeks).
Owner is responsible for any further vaccinations and overall health & wellbeing of the puppy after the time of drop off on _________________.
The Breeder recommends the Purchaser have a licensed veterinarian examine the puppy within 72 hours from final acceptance (pick-up/delivery) to certify such health by certified DVM at Purchaser’s sole expense. Any health issues discovered by Purchaser’s DVM during the health check appointment must be disclosed to Breeder in writing within the 72 hour period.
2. TEMPERAMENT:
We carefully evaluate the temperament of our puppies prior to sale. We raise the puppies to provide them with all the tools they need to develop into wonderful dogs; however, we do not warrant the temperament of our puppies after they leave our property. Environment plays a major role in determining a dog’s temperament. We carefully screen prospective purchasers; however, we have no control over the environment provided after sale. We highly suggest the Puppy attend a kindergarten class as well as a basic obedience class in a group setting along with continued training and socialization.
3. Genetic Health / HIP & ELBOW DYSPLASIA WARRANTY:
Providing our clients with sound dogs is extremely important to us.
The Puppy is guaranteed to be free of any terminal life threatening genetic illness or lameness due to “crippling” or “severe” hip / elbow dysplasia (under PennHip / OFA / SV Standards) until the Puppy is 25 months of age.
This is not a guarantee of perfect hips radiographically, but a guarantee of functional soundness until 25 months of age.
To exercise this warranty, have the puppy SV / Penn Hip / OFA x-rayed by a licensed veterinarian. The hip & elbow x-rays must be mailed to Penn Hip / OFA / SV for grading.
We DO NOT accept a veterinary note, the grade must be a certified rating from one of these organizations.
The diagnosis must state “severe” or “crippling” hip / elbow dysplasia.
A copy of the grade(s) and x-rays MUST be emailed to the breeder in order to honor this agreement.
*The microchip MUST also be on the x-ray and scanned by the vet prior to x-ray.
Because environmental factors (ie. Harsh exercise of a dog under 25 months, improper nutrition, various injuries, being overweight etc.) can have such a huge effect on hip soundness, we can only offer a 1⁄2 refund of purchase price (after deposit),
-if the Puppy is diagnosed with one of the following prior to 25 months of age AND with proof of Spay / Neuter of said Dysplastic Dog at 18 months- 36 months of age or after return of said dog.
*OFA Moderate or Severe Hip dysplasia Grade 2 or 3 Elbow dysplasia
*SV A4 or A5 ratings for Hips / Elbows *PennHip Moderate - Severe OA Hips
If one of our puppies gets diagnosed with any terminal genetic illness under the age of 25 months, we offer a 1⁄2 refund of purchase price (after deposit).
*This MUST be verified by two different veterinary practices.*
**We will take any dog back if owners would like -
Vom Clark’s offers no warranties besides what is expressly provided for herein.
4. RIGHT OF FIRST REFUSAL
In the event the Purchaser(s) decides at any time during the Puppy’s life to part with the Puppy, the Breeder shall have the option to take back the Puppy. The Purchaser(s) must notify the Breeder by Certified Mail Return Receipt Requested of their intent to part with the Puppy. The Breeder shall have fourteen (14) days from receipt of the notice to exercise their right of first refusal.
The buyer is responsible for the cost of relocating the dog back to the breeder (flight/ground transport etc).
*NO dog Vom Clark’s German Shepherds produces is ever allowed to be put into a Shelter or Rescue.
In the event that the Purchaser(s) breaches this clause, Purchaser(s) agrees to pay to the Breeder the amount of five thousand ($5000.00) dollars (the “damages”), plus any and all legal fees incurred in connection with the enforcement of this clause.
5. Diet
This Puppy is to ONLY be fed a high quality kibble based diet until at least 18 Months of age. If this is not followed and documented, the Hip / Elbow warranty is VOID.
6. RELOCATION
The Purchaser(s) agrees to inform the Breeder of any new address change in the event the Purchaser(s) relocates to an address different than what is listed on this agreement.
7. AKC LITTER REGISTRATION
Your puppy’s litter will be able to be AKC Registered, I, the breeder will send home the puppy akc registration form with puppy packet. The puppy comes with a LIMITED registration for AKC. If at the appropriate time 24 months of age, I the Breeder with Lift the Limited AKC registration to Full registration once passing health testing * Hips/ elbow X-rays * have been preformed. No exceptions
8. SPAYING/NEUTERING - NO BREEDING
Male puppies - Males Puppies shall be neutered no earlier than eighteen (18) months.
Proof of neutering must be sent to the Breeder if ever neutered.
Female puppies – Female Puppies shall not be spayed no earlier than eighteen (18) months of
age. Proof of spaying must be sent to the Breeder if ever spayed.
No Breeding = Under NO circumstances is the Puppy, male or female, to be bred without the
approval of Vom Clark’s German Shepherds written release for Breeding Rights. If any portion of Section 11 of this agreement is breached by the Purchaser(s), Purchaser(s) agrees to pay to the Breeder the amount of fifteen thousand ($15,000) dollars (the “damages”), plus any and all legal fees incurred in connection with the enforcement of this clause.
9. INHUMANE TREATMENT
The purchaser(s) agrees to the Breeder’s repossession of the puppy/dog without refund if evidence is found that the puppy/dog is receiving inhumane treatment as defined by the purchaser(s) local and/or state laws and ordinances.
10. CHOICE OF LAW AND FORUM
The terms and provisions of this Agreement shall be construed and governed in accordance with the laws of the State of Georgia, and any action or proceeding brought upon, or arising out of, this Agreement or its termination shall be brought in Hall County, Georgia.
11. ENTIRE AGREEMENT
The Purchaser(s) acknowledges that they have read this agreement in its entirety, all sections (1-11) has had full opportunity to consider its terms, and has had full and satisfactory explanation of the same, and fully understands its terms and agrees to such terms. The Purchaser(s) fully acknowledges that there are not additional or different terms or agreements other than those expressly set forth in this written agreement. Any modification or change to this agreement must be in writing and agreed upon by both parties. If any portion of this agreement is declared invalid, any remaining portion shall remain.
