  • LIABILITY RELEASE

  • In consideration of my use of the exercise equipment and facilities provided by Changing Tides Alaska Inc, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of Changing Tides Alaska Inc.

    By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me. I hereby fully and forever release and discharge Changing Tides Alaska Inc, its insurers, employees, and associates from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the use of said equipment and facilities.

    I expressly agree to indemnify and hold harmless Changing Tides Alaska Inc. against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from the injuries or damages sustained by me. I agree to be solely responsible for safety and wellbeing of myself.

    I understand that Changing Tides Alaska Inc. does not provide supervision, instruction, or assistance for the use of the facility and equipment.

    I agree to comply with all the rules and regulations imposed by Changing Tides Alaska Inc. regarding the use of the facilities and equipment. I agree to always conduct myself in a controlled and reasonable manner, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose. I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death.

    I understand and acknowledge that Changing Tides Alaska Inc. is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises. I understand and agree that I am financially responsible for all damage to equipment, building, or property of Changing Tides Alaska Inc. that is caused by my negligence, intentional or unintentional vandalism or misuse of equipment.

  • ZERO TOLERANCE HARRASSMENT POLICY

  • Changing Tides Alaska Inc prohibits harassment, including sexual harassment, of any kind, and will take appropriate and immediate action in response to complaints or knowledge of violations of this policy.

    For purposes of this policy, harassment is any verbal or physical conduct designed to threaten, intimidate, or coerce an employee, member, or any person connected to Changing Tides Alaska Inc.

    Prohibited under this policy is harassment by staff, members, and prospective members.

    The following examples of harassment are intended to be guidelines and are not exclusive when determining whether there has been a violation of this policy:

    Verbal harassment includes comments that are offensive or unwelcome regarding a person's nationality, origin, race, color, religion, gender, sexual orientation, age, body appearance, and or disability. This includes epithets, slurs, and negative stereotyping. Verbal taunting that impairs an employee or member's ability to perform his or her job functions or workout is included in the definition of harassment. Verbal harassment of staff by the membership is also prohibited.

    Nonverbal harassment includes distribution, display, or discussion of any written or graphic material that ridicules, denigrates, insults, belittles or shows hostility, aversion, or disrespect toward an individual or group because of national origin, race, color, religion, age, gender, sexual orientation, pregnancy, appearance, disability, sexual identity, marital or other protected status.

    Hostile environment harassment creates an offensive and unpleasant gym environment for everyone. A hostile gym environment can be created by everyone in the gym environment, whether it be supervisors, other employees, or congregants. A hostile gym environment can also be created by repeated texts, emails or letters to members or staff denigrating another member or member of the staff. Harassment also includes any verbal or nonverbal expression of disagreement with a member or staff member's personal medical choices, including their choice to use or not use a medical face mask.

    Sexual harassment is unlawful and is prohibited under Changing Tides Alaska Inc. zero tolerance harassment policy. For the purposes of this policy, sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, and other verbal, physical, or written conduct of sexual nature when submission to or rejection of such conduct is used as a basis for membership decisions or such conduct has the purpose or effect of creating an intimidating, hostile or offensive gym environment.

  • No Photo/Filming Policy

  • The Anchor Point Gym is committed to ensuring the privacy, safety, and security of all its members.

    As part of this commitment, the gym prohibits the unauthorized taking of photographs or filming within its facility. This policy applies to all members, guests, and visitors of the Anchor Point gym.

    Photography and Filming: Without explicit permission from gym management and the consent of all individuals present in the vicinity of the photos or filming, members are strictly prohibited from taking photographs or filming within the gym premises.

    Filming of Other Members: Members are not allowed to film or photograph other members without their prior consent.

    Permission from Gym Management: Prior to any photography or filming within the gym premises, members must seek permission from gym management. This includes providing details about the purpose, duration, and intended use of the photographs or footage. Call or text 907-841-3592.

    Permission from Individuals: In addition to obtaining permission from gym management, members must also seek individual consent from every person who may be captured in the background of their photos or footage.

    No Member Background: Any photographs or videos taken within the gym premises should not feature other members in the background, unless explicit consent has been obtained from each individual.

    Violation: Violation of this policy, including unauthorized photography or filming, will result in immediate disciplinary action, which may include the termination of gym membership.

    Reporting Violations: Reporting Procedure: Any member who becomes aware of a violation of this policy should report it immediately to gym management at 907-841-3592.

  • Delinquent Payment Policy

  • Policy Overview: At Anchor Point Gym, we strive to provide a seamless and enjoyable experience for all our members. To ensure the gym's operational efficiency, we have established a clear policy regarding delinquent membership payments. This policy outlines the steps that will be taken if payments are not received on time. Key Points of the Policy:

    Membership payments are due on the date of the month for which you signed the original contract. If payment is not received within 5 business days after the due date, the member's key code access will be turned off until the outstanding payment is received. If a member's account remains unpaid for three months, the outstanding balance will be sent to collections. Members will be responsible for any additional fees incurred during the collections process.

    Late Payment Process:

    1. A reminder will be sent to the member if the payment is not received by the due date.

    2. If the payment remains unpaid 5 business days past the due date, the member's key code access to Anchor Point Gym will be deactivated. The member will be notified of the deactivation and reminded to settle the outstanding balance to restore access.

    3. If the member fails to make payments for three consecutive months, the account will be forwarded to a collection agency. The member will be liable for all collection costs in addition to the overdue.

    This policy helps ensure that all members understand the consequences of late payments and provides a clear procedure for handling overdue accounts. If you have any questions, please do not hesitate to contact us.
