THE HANGOUT WAIVER AND RELEASE OF LIABILITY 

Please read before agreeing

I have been presented with this waiver and release because I have chosen to visit, participate or bring the minor child(ren) identified and all minor children under my supervision and referred to individually and collectively herein as “Child” to participate in the activities (open play, classes, event) and use the facilities and equipment ("Play" or "Playing") at The Hangout LLC located at 777 N. Milwaukee Ave. Libertyville, IL 60048 (The Hangout). I represent that I am the parent or legal guardian of the participant(s) named above, or I have obtained permission from the parent/legal guardian of the participant(s) named above to execute this agreement on their behalf.

I acknowledge that as a condition of my participation I am required to read, understand and sign this waiver and release, and abide by the terms and conditions of my participation contained in this waiver and release, and all other rules of participation set by The Hangout. Further, I agree that this document is valid for all subsequent visits to The Hangout.

Assumption of Risk: I acknowledge and agree that there are inherent risks associated with the use of the facilities and participation in any activity or program at The Hangout. Such risks include but are not limited to falling, bumping, risks from abrasions, scrapes, cuts, broken, sprained or bruised limbs, and even serious injuries such as paralysis or death, as well as risk from the actions or omission of others. I acknowledge that I am aware of the risks involved in using the facilities and participating in any activity or program at The Hangout and assume all such risks, known and unknown.

Release and Waiver of Liability: I hereby release, waive, and forever discharge The Hangout, its members, managers, affiliates, agents, employees, contractors, successors, and assigns from any and all claims, demands, damages, actions, or causes of action, resulting from or arising out of my use of the facilities or participation in any activity or program at The Hangout, including but not limited to any claims for personal injury, property damage, wrongful death, or any other loss.

Indemnification: I agree to indemnify and hold harmless The Hangout, its members, managers, affiliates, agents, employees, contractors, successors, and assigns from and against any and all injuries, illnesses, medical conditions, damages, claims, liabilities, expenses or judgments, including attorney's fees and court costs resulting from any negligent or deliberate act or omission of my child(ren), caregiver or myself.

Code of Conduct: I understand that it is my responsibility to supervise my child(ren) at all times while at The Hangout. I understand that I am responsible for my child’s safety and behavior during each visit. I acknowledge and agree to abide by all posted safety signs, rules, and verbal instructions as conditions for using the facilities and participating in any activity or program at The Hangout. I further acknowledge that any inappropriate behavior, such as, but not limited to, harassment, physical or health endangerment of self or another person, or foul language will result in the immediate removal from the premises.

Personal Property: I understand and acknowledge that I am solely responsible for any personal property brought onto the premises of The Hangout, and that The Hangout shall not be liable for any loss, damage or theft of such personal property. I acknowledge that I am responsible for ensuring the safekeeping of my personal property while on the premises of The Hangout, and that The Hangout shall not be held responsible for any damage, loss or theft of such personal property under any circumstances.

Photo Release: Participants hereby grant The Hangout permission to use images or likeness in a photograph, video, or other digital media in all of its publications, including web-based publications, without payment, consent, or other consideration.
