Assumption of Risk and Liability Waiver

I, [Visitor's Full Name], hereby acknowledge and agree to the following terms and conditions before participating in any activities at DRE'S Safe Place.

Assumption of Risk: I understand that participating in activities at DRE'S Safe Place, including but not limited to smashing items, using provided equipment, and engaging in physical activity, involves inherent risks. These risks include, but are not limited to, the risk of physical injury, property damage, and emotional distress. I voluntarily choose to participate in these activities with full knowledge of the potential risks involved.

Health and Safety:

I certify that I am physically and mentally capable of participating in the activities at DRE'S Safe Place. I have not been advised otherwise by any healthcare professional. If I have any medical/mental health conditions or concerns, I have consulted with my healthcare provider and obtained clearance to participate.

I understand that DRE'S SAFE PLACE DOES NOT CLAIM TO BE A MENTAL HEALTH OR MEDICAL FACILITY, WE DO NOT INTEND TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY MENTAL HEALTH DISEASE. WE DO NOT DIAGNOSE OR PROVIDE MEDICAL THERAPY OF ANY KIND.

Release of Liability: In consideration of being permitted to participate in the activities at DRE'S Safe Place, I hereby release, waive, discharge, and hold harmless [DRE'S Place, LLC], its owners, employees, contractors, and representatives (collectively, "the Released Parties") from any and all liability for any injuries, damages, losses, or expenses that I may sustain as a result of my participation. This includes liability for the negligence of the Released Parties.

Indemnification: I agree to indemnify and hold harmless the Released Parties from any claims, demands, losses, or damages, including legal fees, arising out of or related to my participation in the activities at DRE'S Safe Place.

Use of Safety Equipment: I agree to use all safety equipment provided by DRE'S Safe Place during my participation in the activities. I understand that failure to use safety equipment properly may increase the risk of injury.

Compliance with Rules: I agree to comply with all rules, guidelines, and instructions provided by DRE'S Safe Space during my visit. I understand that failure to follow these rules may result in my removal from the premises.

Minors: Prospective participants under the age of 18 years are required to have a parent or legal guardian read and also sign this release. The parent and the participant under 18 have read, understand, and agree to comply with this Release. By signing this document, the parent agrees to each of the provisions above including to indemnify and hold harmless DRE'S Safe Place, and all its subsidiaries, its agents or employees from any and all claims brought by the participant under 18 or resulting from the participant under 18's actions, whether DRE'S Safe Place and all its subsidiaries, its agents, partners or employees are negligent or not. Further, parent or legal guardian expressly agrees to monitor the minor at all times during the minor’s visit.

PHOTO/VIDEO RELEASE – I consent to photographs and videos being taken of me during my participation while visiting DRE'S Safe Place, and to publication of the photographs and videos by the Releasees for advertising, promotional and marketing purposes. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of the rage room, other than what is set forth in this Release Agreement.*

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE (RELEASEES), to the fullest extent permitted by law.
