Photo Release
If a participant, patron, or the parents or guardians of individuals under the age of 18 do not wish to be photographed, recorded, or have their name or personal information associated with any such recording, they are required to email info@williams-syndrom.org.
Individuals who have opted-out should also take responsibility for either relocating themselves from areas where photography or recording is taking place or informing the camera operator of their opt-out status. Failing to do so may lead to their unintentional inclusion in a photograph or recording, and this will be considered as consent for the use of such materials.
Please note that images and videos taken in public spaces and/or at public events do not require authorization for publication. Your presence in or around events at public venues and/or properties, constitutes your consent to the capture and/or use of your image and/or voice. This waives any claims or rights, whether in law or in equity.
When an opt-out email is on file, the WSA will make every effort to honor that individual's Opt-Out status, even in public spaces or at public events.
Waiver and Release of Liability Agreement for DIY Fundraising Event
By signing this agreement, I hereby release and waive any claims against the Williams Syndrome Association, along with its agents, employees, insurers, successors, and assigns, in relation to any and all legal actions, including but not limited to personal injury, property damage, medical expenses, loss of services, arising from or in any way connected to my participation in the third-party fundraising event.
This release absolves the Williams Syndrome Association from liability for any damages or injuries resulting from my negligence, the negligence of third parties, or negligence on their part. However, this release does not apply to intentional misconduct by the Williams Syndrome Association.
Furthermore, I pledge not to initiate any legal actions or claims against the Williams Syndrome Association for any matter covered by this agreement. In the event that a claim is brought against the Williams Syndrome Association in violation of this agreement, including derivative claims, I commit to defending and fully reimbursing the Williams Syndrome Association for any such claims, including attorney's fees and associated expenses incurred by them in their defense.
I acknowledge that the Williams Syndrome Association is not responsible for any lost, stolen, or damaged valuables or property during the third-party fundraising event.
I confirm that I have received and read the current rules and regulations governing the third-party fundraising event. I agree to fully comply with these rules and any subsequent amendments.
I have read and understood this Agreement. By signing it, I consent to be bound by its terms, including the waiver and release of any legal rights I may have to sue the Williams Syndrome Association for any costs they may incur due to a claim or legal action brought in violation of this Agreement. I also acknowledge that any violation of this Agreement's terms and conditions, as determined by the Williams Syndrome Association, will result in the voiding and termination of this Agreement.
