THE ANIMAL PAD PARTICIPANT RELEASE AND WAIVER OF LIABILITY,
INDEMNIFICATION AND ASSUMPTION OF RISK AGREEMENT
(the “Release”)
This is a binding legal agreement. Clarify any questions or concerns before signing.
In connection with the opportunity to participate in Community service days with The Animal Pad, a 501(c)(3) nonprofit organization (collectively, together with its agents, directors, officers, employees, and volunteers, including all volunteers within the Community service days at “TAP”), the undersigned being the Participant and Participant’s Parent/Guardian (collectively the “Parties”) acknowledges and agrees to the following terms outlined in this agreement:
1) I am the Parent/Guardian of the Participant and have full legal responsibility for the decisions of the Participant. (or I am 18 or older and signing on the behalf of myself)
2)I understand that my child (or myself if 18 or older) will participate in Community service days that may include, petting, holding and playing with dogs, in addition to playing various games that invlove running but is not limited to (the “Activities”).
3)I am aware of the risks associated with the Activities, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, temporary or permanent disability, economic or emotional loss, being bitten, scratched, injured, or frightened by dogs and puppies, and/or death. Participants understand that the following are some, but not all of the risk associated with coming in contact with animals: bite or scratches from animals, internal or external parasites, zoonotic illnesses (human illness contracted from animals), animal illness exposure to Participant’s own animals, injuries related to lifting or holding animals, loss of or damage to personal property, any type of damage to a vehicle while parked near the Activities, damage to clothing from animals, fencing, chemicals, etc. TAP encourages the sanitizing and/or washing of hands before and after contact with the animals, and we provide hand sanitizer for participant use.
4)I understand and acknowledge that by this release I knowingly assume the risk of injury, harm and loss associated with the activities for my child. I also understand that TAP does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury, illness, death or property damage. If I require medical treatment while participating in, or as a result of my participation in, the Activities, I agree to bear all the costs incurred as a result of such treatment without the right to or demand for any contribution or reimbursement from TAP.
5)I understand these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence, or the condition of the premises where any of the Activities occur or the equipment used during the Activities.
6)I knowingly and freely assume all such risk, both known and unknown, of my participation in the Activities, even if arising from the negligence of TAP.
7) I, on behalf of my child, my heirs, successors and assigns, and personal representatives, hereby waive, release from liability, hold harmless, discharge, and indemnify TAP, their employees, contractors, agents, managers, members, shareholders, directors, officers, attorneys, representatives, fiduciaries, subsidiaries, affiliates, related companies, and any and all of their sponsors, contractors, members, managers, shareholders, directors, officers, attorneys, agents, representatives, fiduciaries, and employees (collectively, “TAP” from and against any and all loss, liability, injury, damage or death in any way related to or arising out of my participation in the Activities. I further agree not to make a claim or sue for injuries or damages against TAP related to my participation in the Activities.
8)I represent that my child is in good health and have no medical or physical condition which would affect my ability to safely participate in the Activities. Specifically, I represent that my child does not have a known serious allergy to dogs or puppies that would cause me to be in a life-threatening situation.
9)My child (or myself if 18 or older) will abide by TAP’s mission, rules, regulations, policies, and programs while participating in the Activities.
10)I intend this Release to be as broad and inclusive as is permitted under California law. If any portion of this Release is held to be invalid, I agree the remainder shall continue in full legal force and effect. Any modifications to this Release must be in a writing signed by both TAP, the Event Host and the undersigned.
11)The laws of the State of California shall govern the validity, construction and enforceability of this Release. Venue for all disputes relating to or arising out of the the Activities shall be in San Diego, California.
12)I hereby waive and release the use of my photograph or likeness for any reason or purpose arising from or related to my participation in the Activities.
13)This Release shall be effective as of the date executed below for all of the Activities that my child participates in.
I have carefully read, clearly understand and voluntarily sign this Release. No oral representations, statements or inducements apart from this Release have been made
