The use of small business reorganizations under subchapter 5 of the Bankruptcy Code has continued to grow following Congress’s increase of the eligibility debt limit for small business debtors to $7.5 million. This panel will discuss the most significant developments in the case law, including eligibility, dismissal or conversion, 363 sales, and confirmation issues.
